Please review the enclosed notice and ordinance pertaining to the aforementioned annexation proposal and
return any comments to the Town of Windsor at the address shown below no later than Friday, June 211
2002. If the Town has not received comments from your agency within this review period, the Town will
consider the lack of a response to be a positive response to the proposal in its current form. However, for
the purposes of having a complete file on this proposal, the Town would appreciate a response from
your office even if your only comment below is "no comment." Please note the map on the reverse side of
this notification showing the location of this annexation.
Public Meeting: The Windsor Board of Trustees will hold a public meeting at 7:00 p.m. on Monday,June
24,2002 in Windsor Town Hall, 301 Walnut Street to consider this annexation proposal.

NOTICE OF PROPOSED ADOPTION OF AN ORDINANCE ANNEXING
CERTAIN TERRITORY KNOWN AS THE 'BUSCH ANNEXATION
TO THE TOWN OF WINDSOR, COLORADO"
Notice is hereby given that the Board of Trustees of the Town of Windsor, Colorado, will
consider the adoption of the Ordinance on the following page at 7:00 p.m. on Monday, June 24,
2002, at the Windsor Town Hall, 301 Walnut Street, Windsor, Colorado 80550.
TOWN OF WINDSOR
ORDINANCE NO. 2002-
BEING AN ORDINANCE ANNEXING CERTAIN TERRITORY KNOWN AS THE "BUSCH
ANNEXATION TO THE TOWN OF WINDSOR, COLORADO."
WHEREAS, pursuant to the Municipal Annexation Act of 1965, as amended, the Town
desires to annex certain territory known as the "Busch Annexation to the Town of Windsor,
Colorado,"more fully described hereafter; and
WHEREAS, pursuant to § 31-12-106, C.R.S., the Board of Trustees has concluded that
the territory, which is the subject of this Ordinance, is an enclave, having been entirely contained
within the boundaries of the Town of Windsor for a period in excess of three years; and

WHEREAS, pursuant to § 31-12-106(1), C.R.S., notice of this proposed annexation has
been given in accordance with the requirements of§ 31-12-108(2), C.R.S.; and
WHEREAS, a community of interest exists between the territory to be annexed and the
Town of Windsor; and
WHEREAS, the territory to be annexed is urban or will be urbanized in the near future
and has been integrated, or is capable of being integrated, within the Town of Windsor; and
WHEREAS, the Board of Trustees finds that all relevant provisions of the Municipal •
Annexation Act of 1965, as amended,have been complied with; and
WHEREAS, an Annexation Agreement outlining all of the conditions of said annexation
has been executed by the Town of Windsor and the sole owner of the territory to be-annexed, and
said Annexation Agreement shall be adopted by this Ordinance and thereafter recorded in
conjunction with the annexation map in the office of the Weld County Clerk and Recorder;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF WINDSOR, COLORADO, AS FOLLOWS:
1. That the recitals set forth above are hereby incorporated into the body of this
Ordinance.
2. That the territory to be annexed is located in the County of Weld, State of
Colorado, and is precisely described in Exhibit "A," attached hereto and incorporated herein by
this reference.
3. That the territory is an enclave, having been entirely contained within the
boundaries of the Town of Windsor for a period in excess of three years.
4. That notice of the proposed adoption of the within Ordinance has been given
pursuant to § 31-12-106, C.R.S., and in accordance with § 31-12-108(2), C.R.S.
5. That the described territory is hereby annexed to the Town of Windsor, Colorado.
6. That the annexation of the aforesaid territory shall be deemed complete on the
effective date of this Ordinance except for the purpose of general property taxes pursuant to §
31-12-113, C.R.S.
7. That the territory annexed by this Ordinance shall be known as the "Busch
Annexation to the Town of Windsor, Colorado."
8. That the Annexation Agreement dated May 28, 2002, between the Annexor, John
Busch, and the Town of Windsor is hereby approved and adopted by the Board of Trustees.
9. That the territory to be annexed shall be zoned Single-family Residential (SF-1)
as shown on the Annexation Map on file in the office of the Director of Planning for the Town of
Windsor, Colorado.
10. That the official Zoning District Map of the Town of Windsor shall be changed in
accordance with this Ordinance, and an entry shall be made thereon, noting the annexation of the
aforesaid territory. Such entry, together with a brief description of the nature of the change, shall
be signed by the Mayor of the Town of Windsor, attested to by the Town Clerk, and properly
filed with the Weld County Clerk and Recorder.

LEGAL DESCRIPTION
Lot Eighteen (18), Block Two (2), Coon Addition to the Town of Windsor, as recorded in Weld
County Records under Reception No. 244282, Northeast Quarter(NE ''A) of Section Twenty-one
(21), Township 6 North (T.6.N.)Range 67 West(R.67W.) of the 6th P.M., Weld County, State of
Colorado and being more particularly described as follows:
COMMENCING at the Northeast Corner of said Section 21 and assuming the North line of said
NE 'A to bear North 90°00'00"West with all bearings contained herein relative thereto:
THENCE North 90°00'00" West along said Nort$ line a distance of 1,090.00 feet to the
Northeast corner of Axtel Annexation as recorded in Weld County Records, said point also being
the Northwest corner of Lakeview Cemetery & Municipal Ball Park Annexation;
THENCE South 00°00'00" West, along the West line of said Lakeview Cemetery & Municipal
Ball Park Annexation a distance of 30.00 feet to the South Right-of-Way (ROW) line of
Colorado State Highway 392;
THENCE North 90°00'00" West along said ROW a distance of 326.36 feet to the Northeast
Corner of said Lot 18, said point being the POINT OF BEGINNING;
THENCE along said Lot 18 the following four(4) courses and distances:
THENCE south 00°39'58"East a distance of 180.00 feet;
THENCE North 90°00'00"West a distance of 75.00 feet;
THENCE North 00°39'58"West a distance of 180.00 feet;
THENCE South 90°00'00"East a distance of 75.00 feet to the POINT OF BEGINNING.
