RE: ACTION OF BOARD CONCERNING CHANGE OF ZONE #569 FROM R-5 (MOBILE
HOME RESIDENTIAL) ZONE DISTRICT TO R-2 (DUPLEX RESIDENTIAL) ZONE
DISTRICT - JER, A PARTNERSHIP, C/O LIFESTYLE HOMES, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 24th day
of July, 2002, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of JER, a partnership, do Lifestyle Homes, Inc., 920 54th Avenue, Suite 200,
Greeley, Colorado 80634, for Change of Zone #569 from the R-5 (Mobile Home Residential)
Zone District to the R-2 (Duplex Residential) Zone District on the following described real
estate, to-wit:
Lot B, Hill-N-Park First Filing, located in the S1/2 of
Section 26, Township 5 North, Range 66 West of
the 6th P.M., Weld County, Colorado
WHEREAS, on behalf of the applicant, Billy McDivitt, Project Manager, has submitted a
letter to the Board, dated July 22, 2002, requesting the application for Change of Zone #569 be
withdrawn, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to accept said request to withdraw
said application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of JER, a partnership, do Lifestyle Homes, Inc., to
withdraw the application for Change of Zone #569 from the R-5 (Mobile Home Residential)
Zone District to the R-2 (Duplex Residential) Zone District on the hereinabove described parcel
of land be, and hereby is, accepted.

SUBJECT: Request to withdraw Z-569
The Department of Planning Services has received a letter from Elmer Lundvall and John
Shupe from J.E.R. partnership regarding Z-569. The letter states that the contract between
J.E.R. and Clarkson Land (Lifestyle Homes) is not valid. Mr. Lundvall and Mr. Shupe have
been in contact with Clarkson Land regarding this issue. Billy McDivitt from Clarkson Land has
faxed a memo formally withdrawing the pending re-zone application. The Department of
Planning Services is requesting the case be closed due to the circumstances stated above.

Dear Carla:
We have been notified that Lifestyle Homes
is proceeding with a rezoning request to rezone
Lot B, Hill N Park, from mobile homes to R-2 .
It is our understanding that only an owner of
record or a valid contract for sale signed by
all owners of record be permitted to request
a change of zone.
We want to inform you that the contract for
sale that you have in file is NOT a valid
contract . Not only has it not been signed by
all three owners of J.E.R. to date , Lifestyle
has not paid the $10000 . earnest money deposit .
Please halt all work relating to Lifestyle ' s
rezoning request until such time that you do
have a valid contract in your possession.
