BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
NOVEMBER 13, 2002

The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial
Center, Greeley, Colorado, November 13, 2002, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:
Commissioner Glenn Vaad, Chair
Commissioner David E. Long, Pro-Tem
Commissioner M. J. Geile
Commissioner William H. Jerke - EXCUSED
Commissioner Robert D. Masden

MINUTES: Commissioner Long moved to approve the minutes of the Board of County Commissioners
meeting of November 6, 2002, as printed. Commissioner Masden seconded the motion, and it carried
unanimously.
READ ORDINANCE BY TAPE: Commissioner Masden moved to read Code Ordinances #2002-10,
#2002-11, and#2002-12 by tape. Commissioner Long seconded the motion, which carried unanimously.
CERTIFICATION OF HEARINGS: Commissioner Long moved to approve the Certification of Hearing
conducted on November 6, 2002, as follows: 1) A Site Specific Development Plan and Use by Special
Review Permit#1400, Cordell and Crystal Dye. Commissioner Geile seconded the motion,which carried
unanimously.
ADDITIONS TO AGENDA: There were no additions to the agenda.
CONSENT AGENDA: Commissioner Long moved to approve the consent agenda as printed.
Commissioner Masden seconded the motion, and it carried unanimously.
COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports.
PUBLIC INPUT: There was no public input.

WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants
for approval by the Board:
All Funds $1,667,227.12
Electronic Transfers - All Funds $2,701.00
Commissioner Long moved to approve the warrants as presented by Mr. Warden. Commissioner Geile
seconded the motion, which carried unanimously.
BIDS:
PRESENT BIDS: Mr. Warden stated there are no bids to present.
APPROVE MOTORGRADER BLADES BID - DEPARTMENT OF PUBLIC WORKS: Mr. Warden stated
the Department of Public Works recommends approval of the low bid from Wagner Equipment Company,
in the amount of $63,830. Commissioner Geile moved to approve said bid as recommended by staff.
Commissioner Masden seconded the motion. In response to Commissioner Masden, Frank Hempen,Jr.,
Director of Public Works, stated this amount is based on the anticipated usage for one year. He stated
there are 40 graders, which use an average of two or more blades per month. There being no further
discussion, the motion carried unanimously.
NEW BUSINESS:
CONSIDER CONTRACT FOR COMMUNITY CORRECTIONS SERVICES AND AUTHORIZE CHAIR TO
SIGN - CORRECTIONAL MANAGEMENT, INC.: Jan Zuber, Community Corrections Board, stated this
is a standard sub-contract for clients who may be placed out of County, and this particular facility is in
Boulder County. Commissioner Geile moved to approve said contract and authorize the Chair to sign.
Seconded by Commissioner Long, the motion carried unanimously.
FIRST READING OF CODE ORDINANCE #2002-10, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 5 AND APPENDICES 5-A THRU 5-L, OF THE WELD
COUNTY CODE: Mr. Warden stated these fee adjustments have been considered through the course of
the budget process. He stated the Paramedic Services fees were approved mid-year by Resolution and
are being codified at this time. He stated the Sheriffs Office fees which are being amended relate to
concealed weapons and renewal, as well as the addition of an annual fee for sex offender registration.
Mr. Warden stated the Geographical Information Services(GIS)is amending fees for maps, and there are
also changes to the land use application fees. He further stated the bid amount will remain unchanged
at $10,000. Monica Mika, Director of Planning Services, stated the Planning Commission reviewed and
approved the proposed fee changes last Tuesday, with one change to the mining operation fees. She
further stated staff proposed the fee be increased to$2000,with$100 per acre above ten acres; however,
the Planning Commission modified the fee to $5,000, with $20 per acre above ten acres. No public
testimony was offered concerning this matter. Mr. Warden added the Board also approved the fee
changes for the Department of Public Health and Environment mid-year by Resolution, and those changes
are also being codified. Commission Geile moved to approve Code Ordinance#2002-10 on first reading,
with the understanding he would like more discussion and explanation of the proposed change by Planning
Commission for mining operation fees at second reading. Commissioner Long seconded the motion,
which carried unanimously.

FIRST READING OF CODE ORDINANCE #2002-11, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 20 ROAD IMPACT FEES, OF THE WELD COUNTY
CODE: Mr. Warden stated this Ordinance will repeal the current road impact fees for Southwest Weld
County and the Windsor area, and reenact new county-wide road impact fees. He stated a formal
presentation will be made at second reading; however, he explained the methodology is similar to the
existing system, and this will support the seven strategic roads in the County. Mr. Barker reiterated the
structure is the same, the duties of the Committee will be designated to the Director of Planning Services,
with input from the Director of Public Works. Mr. Warden stated the provisions have also been amended
to designate the Board of Weld County Commissioners as the appeal body. Mr. Barker stated staff is still
waiting on information from the consultant to complete Appendices 20-A, 20-B, and 20-C; however, the
information will be available prior to second reading. Responding to Chair Vaad, Mr. Warden stated the
four benefit areas have been incorporated, and he described the boundaries for the record. He clarified
funds collected in a specific benefit area will be spent on projects in that area. Responding to
Commissioner Long, Mr. Barker stated they have received the initial results from the consultant regarding
being able to spread the funds to more projects, and they have also asked for additional information. Mr.
Warden added the consultant should be providing the findings on commercial activities in agricultural
areas. No public testimony was offered concerning this matter. Commissioner Masden moved to approve
Code Ordinance #2002-11 on first reading. Commissioner Geile seconded the motion, which carried
unanimously.
FIRST READING OF CODE ORDINANCE #2002-12, IN THE MATTER OF REPEALING AND
REENACTING,WITH AMENDMENTS,CHAPTER 2 ADMINISTRATION,CHAPTER 3 PERSONNEL,AND
CHAPTER 9 INFORMATION SERVICES OF THE WELD COUNTY CODE: Mr. Warden stated the
diversity policy and the authorization for use of County heavy equipment to assist in fire fighting were
previously approved by Resolution and are now being codified. He stated this also clarifies and expands
the policy regarding the private use of County property, particularly the use of hand held computing
devises. He stated this clarifies the Personnel section pertaining to neglect or willful damage or waste of
public property and also updates the protection of confidential information. Mr. Warden stated this
Ordinance also addresses the Internet policy and the storage and safeguarding of County data on
personalized hand held devices. Chris Eikenberg, County resident, stated the proposed changes are
prohibitive of First Amendment rights to be able to communicate with whatever means available. She
stated this is a duplication of policies that are already in place. Commissioner Long moved to approve
Code Ordinance #2002-12 on first reading. Commissioner Geile seconded the motion, which carried
unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent
agenda. Code Ordinances #2002-10, #2002-11, and #2002-12 were approved on first reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
