C -PC ' l RECEIVED The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the Use by Special Review Standards in the Commercial/Industrial zoned district. Our comments and requirements are as follows: COMMENTS: WCR 50 is designated on the Transportation Plan Map as an arterial status road, which requires a 100-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,Article III, Section 23-3-50, the required setback is measured from the future right-of- way line. WCR 15.5 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of- way line. The average daily traffic (ADT) count for WCR 15.5 is 44 vehicles taken in a 24-hour period on 9/18/97. WCR 50 has an ADT count of 718 vehicles, and it was taken 8/23/2000. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. Future Right-of-Way: The applicant should reserve an additional 20 feet of property parallel to the WCR 50 right-of-way for future build out. This should all be delineated on the plat. There shall be no new residential/commercial accesses allowed on to roadways classified as an arterial. If secondary accesses are available from non-arterial status roads. Off Street Parking: The off-street parking spaces at the main office parking lot, including the access drive shall be surfaced with gravel, asphalt, concrete or the equivalent and shall be graded to prevent drainage problems. EXHIBIT 2002-0498 112 USR-1366, Stacey & Sha Greathouse December 20, 2001 Page 2 Access Points: Both accesses shall be placed in such a location to have adequate sight distance in either direction and not below the crest of a hill or where physical obstructions are present. If a culvert is required,a 15-inch corrugated metal pipe is the County's minimum size requirement. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. Direct access from a public road shall be limited; one access is allowed per legal residential parcel. No circle drives will be allowed. (Building envelope for a residential location only). Storm Water Drainage: The applicant indicated that the storm water drainage will be contained on site by routing run-off to existing ditches on the property. The plat drawing shows that the surrounding USR property is either dry land pasture mixture or farm ground. The Hillsboro Ditch Company does not accept any liability or responsibility for loss occurring to life or real property caused by flooding or over flow of the ditch. Flooding is not an uncommon event on the property. 2. Section 5H referring to water on property. Little Thompson Water is mentioned which is domestic only. There is no known irrigation water for this 45.88 acres of prime farm land. Hillsboro Ditch Company Dean Binder,Director Memorandum tt "l ige TO: Kim Ogle, Weld County Planning DATE: January 3, 2002 LC) COLORADO FROM: Charlotte Davis, Environmental Health Services SUBJECT: USR-1366-Greathouse, Stacey and Shawn (Majestic Fencing) Environmental Health Services has reviewed this proposal for a storage area and shop with office space for a fencing business. We have no objections to the proposal,however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. In event the shop is equipped with a floor drain, the applicant must apply for an Underground Injection Control (UIC) Class V Injection Well permit through the Environmental Protection Agency (EPA), for the floor drain system that serves the maintenance shop, or provide evidence that the applicant is not subject to the EPA Class V requirements. 2. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health & Environment, for approval prior to operation. 3. An individual sewage disposal system is required for the proposed shop/office and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 5. In the event vehicles or equipment are washed on site, the applicant shall provide evidence that any vehicle or equipment washing area will be designed and constructed to capture all effluent and prevent any discharges from the washing of vehicles and/or equipment in accordance with the Rules and Regulations of the Water Quality Control Commission and the Environmental Protection Agency. USR-1366 Greathouse, Stacey and Shawn Page 2 We recommend that the following requirements be incorporated into the permit as "development standards": 1. The facility shall operate in accordance with the approved dust control plan. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a "solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 5. Fugitive dust shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 7. Adequate hand washing and toilet facilities shall be provided for employee and patron use. 8. The facility shall utilize the existing public water supply. (Little Thompson Water) 9. If applicable,the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health& Environment, Water Quality Control Division. 10. Any vehicle or equipment washing area(s) shall capture all effluent and prevent discharges from the washing of vehicle and/or equipment in accordance with the Weld County Code, the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency.
