The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment;slow-moving farm vehicles on rural roads;dust from animal pens, field work, harvest, and gravel roads;odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads,no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not • • • be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. 4. As per our response to the Weld County Planning Department on August 7, 2002, the District has established a cash-in-lieu payment for residential development within the District in order to provide adequate educational opportunities as a result of that development. We understand your recorded exemption is being requested in order to achieve better irrigation on the larger parcel. It is not your intent at this point in time to build a home on the larger parcel. As a result of your intent, we will not request the cash-in-lieu fee to be paid at this time. Should you apply for a building permit through Weld County or sell or issue a deed to another party the cash-in-lieu fee at the then current rate will be paid immediately to the District. The property has an existing water tap and water is metered from North Central Weld County Water District. b. There will be no irrigation water with the small parcel 2. The smaller parcel has an existing septic system. Attached is a copy of the septic permit. The larger parcel will be used for grazing livestock and crops. 3. The proposed smaller parcel is currently a rural residence, the site is approximately 9.1 acres. There is a main house, and a 24 x 40 shop. There is also two small out buildings and various livestock pens The larger parcel is for crops and grazing livestock. 4. We would like this recorded exemption to allow my son to continue to live on the smaller parcel, raise a few head of livestock, and continue farming the larger parcel. The house is located on difficult to irrigate, non productive farm ground, (approx 9.1 acres). With limited irrigation water available for this ground the smaller parcel will forfeit the irrigation water to better irrigate the crops on the larger parcel where we will continue to grow crops and graze livestock 5. The proposed smaller parcel site is approximately 1000 feet north of the intersection of Road 76 and Road 49 on the east side. The proposed lot is currently used as a residence. 6. N/A 7. The house is only 5 years old and was built according to Weld County codes which meet all the minimum setback and offset requirements for the zone district in which the property is located. 8. We do not choose to place a conservation easement on the property. 9. No building envelope will be designated on any of the parcels. 10. The proposed lot although not suitable for crops, will remain an agricultural site suitable for raising and pasturing livestock. 11. The existing buildings are all compatible with other rural residences in the area. 12. The proposed sight is not productive farm ground and is not currently being used for grazing, therefore it would be consistent with the intent of the district it is located in. 13. The proposal is consistent with efficient and orderly development as defined by Weld County subdivision ordinance, section 1:3 because it has been used as rural residence and for small agricultural purpose and will remain rural residence. It has enough acreage for small agricultural production, the larger parcel will remain agricultural. The smaller parcel is a very difficult section to irrigate so it is not prime farm ground, it does however make a nice rural/ag family home. 02O7°2cVVY/ REFERRAL LIST NAME: Howard &Rita Trostel CASE NUMBER: RE-33 REFERRALS SENT: July 15, 2002 REFERRALS TO BE RECEIVED BY: August 15, 2002 COUNTY TOWNS and CITIES _Attorney Ault _X Health Department Brighton Extension Service Broomfield Emergency Management Office Dacono Sheriffs Office Eaton _X Public Works Erie Housing Authority Evans Airport Authority Firestone Building Inspection Fort Lupton X_Code Enforcement Frederick STATE _Garden City Division of Water Resources Gilcrest Geological Survey Greeley Department of Health Grover Department of Transportation Hudson Historical Society Johnstown Water Conservation Board Keenesburg Oil and Gas Conservation Commission Kersey Division of Wildlife: LaSalle Loveland Lochbuie _X_Greeley Longmont Division of Minerals/Geology Mead FIRE DISTRICTS Milliken Ault F-1 New Raymer _Berthoud F-2 Northglenn Briggsdale F-24 Nunn Brighton F-3 _Pierce Eaton F-4 Platteville Fort Lupton F-5 Severance X_Galeton F-6 Thornton Hudson F-7 Windsor Johnstown F-8 La Salle F-9 Mountain View F-10 COUNTIES Milliken F-11 Adams Nunn F-12 Boulder Pawnee F-22 Larimer Platteville F-13 Platte Valley F-14 FEDERAL GOVERNMENT AGENCIES Poudre Valley F-15 US Army Corps of Engineers Raymer F-2 USDA-APHIS Veterinary Service Southeast Weld F-16 Federal Aviation Administration Windsor/Severance F-17 Federal Communication Commission Wiggins F-18 Union Colony F-20 SOIL CONSERVATION DISTRICTS Brighton OTHER Fort Collins _X School District RE-2 _X_Greeley _X_Eaton Ditch Company Longmont West Adams • • p Weld County Referral C.
