A plan review may be required for each building. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. Check with a plans examiner to determine the exact plan review requirements for each building. 2. A separate permit is required for the picnic shelter. 3. New structures and additions or renovations to buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999 NEC and Chapter 29 of the Weld County Code. 4. They are placing signage at the entrance to the development showing address locations, they are providing housing numbers which will be visible from the road at residences, they are providing a picnic shelter which will be used as a covered shelter for children waiting for school bus, and they have agreed to put a mail delivery station at the same location. It appears that the roads within the subdivision will be maintained as private roads into perpetuity. These roads need to be maintained to ensure that emergency vehicles have emergency access during adverse weather conditions. Residents should also be notified prior to purchase that the Sheriffs Office has significant enforcement limitations on private drives. I have no further input regarding this minor subdivision. It is our understanding that these are existing lots but are not yet formally approved under the subdivision process. The proposed water supply is two decreed wells (35062-F and 35063-F) for 12 lots and an existing unpermitted well for the remaining lot. The decreed wells were described in an existing plan for augmentation, 94CW217, and were specifically designated as water supply for 12 lots. Irrigation of up to 3 acres of lawn and garden and firefighting is allowed. Well permits 35062-F and 35063-F issued pursuant to this decree allows for a total annual withdrawal of 4.5 acre-feet to provide water up to 12 single family dwellings and irrigation of up to 60,000 square feet of lawn and garden. The remaining residential lot (the 13th lot) will be provided water from an existing pre-1972 well to serve two dwellings on this lot and for irrigation of up to one acre of lawn and garden. Based upon the field inspection done by this office, we agree with these claimed uses. The State Engineer's office through a Memorandum dated August 7, 1995 inform the counties that effective August 31, 1995, this office will no longer respond to land use actions that do not involve the subdivision of land as defined in Section 30-28-101(10)(a) C.R.S. (see-attached memorandum). These actions include but are not limited to lot line adjustments, zone change request, special use land and division by exemption. Although a copy of a well with Permit No. 35062-F was included in the submittal material, this referral does not appear to qualify as a "subdivision" therefore the material submitted to this office is hereby returned. Additionally this office reviewed the status of the well with Permit No. 35062-F and determined that this well in conjunction with the well with Permit No. 35063-F may be used for ordinary household use purposes in up to 12 single family dwellings and irrigation of a maximum 60,000 square feet of gardens and lawns. These wells are authorized to operate under an augmentation plan approved in the Water Division 1 Water Court (Case No. 94-CW-217). However if the applicant is planning to subdivide this land to use water from the above described wells for thirteen residential lots a preliminary water supply plan of the proposed subdivision should be submitted to this office for comments on the potential for injury to existing water rights and the adequacy of the proposed water supply plan. (1986 Repl, Vol.). In June of 1992, HB92-1156, required that recommendations be made within 21 days after the mailing by the county. No additional staff was allocated to implement this accelerated review. I find that with the increased development activity in the state, my staff cannot respond in a timely manner to all of the land use referrals we receive. Therefore, in order to allow our timely comments on all SUBDIVISION OF LAND referrals as mandated by section 30-28-136(h)(I) C.R.S., effective AUGUST 31, 1995, THIS OFFICE WILL NO LONGER RESPOND TO LAND USE ACTIONS THAT DO NOT INVOLVE TILE SUBDIVISION OF LAND AS DEFINED IN SECTION 30-28-101- (10)(a) C.R.S. Comments made during this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. COMMENTS: External Roadways: ❑ WCR 69 is classified by the County as a local road and requires a 60-foot right-of-way. This right-of-way shall be shown on the final plat. The existing 60-foot right-of-way shall be verified by the applicant and the documents creating the right-of-way noted on the final plat. If the right- of-way cannot be verified, it will be dedicated on the final plat. ❑ WCR 69 serving this development is paved. The additional residential traffic added to the roadway system will not have enough impact to require off-site roadway improvements. A traffic study will not be required. ❑ Irrigation water runs along the west side of WCR 69 adjacent to the development. The applicant shall verify the ditch location. If the ditch is outside the existing right-of-way,an easement shall be provided. Internal Roadways: ❑ The internal roadway of the development is gravel with very little grade. There are no ditches or culverts. Attention shall be given to roadside drainage throughout the development. ❑ There are two internal roadways which are shown dead-ended on the Change of Zone plat. A rough gravel road is currently being used,which connects these two dead-ends on the PUD site. The applicant shall address the intended use of this rough gravel road. ❑ Internal roads shall meet Weld County criteria for a PUD. The right-of-way is shown as Outlot A and Note 2 calls for the right-of-way to be deeded to the home owners association. The internal roadway right-of-way shall be sixty(60)feet in width including cul-de-sacs with a sixty- five(65) foot radius at the dead ends, and dedicated to the public. The typical roadway section of interior roadway shall be shown as two 12-foot paved lanes with 4-foot gravel shoulders on the zone change plat. Cul-de-sac edges of pavement radiuses shall be fifty(50)feet. Stop signs and street name signs will be required at all intersections. EXHIBIT 1i ❑ The applicant shall provide a pavement design prepared by a professional engineer along with the final plat submittal. U Roadway and grading plans along with construction details will be required for the final plat. Drainage: ❑ A final drainage report stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be submitted with the final plat application. The 5-year storm and 100- year storm drainage studies shall take into consideration off-site flows both entering and leaving the development. Increased runoff due to development will require detention of the 100-year storm developed condition while releasing the 5-year storm existing condition. ❑ Final drainage construction plans, conforming to the drainage report, shall be submitted with the final plat application. RECOMMENDATION: We recommend approval of this Change of Zone application.The following Conditions of Approval shall be fulfilled prior to final plat acceptance. Conditions of Approval: 1. The rights-of-way need to be verified and shown on the final plat for WCR 69. If the rights-of- way cannot be documented, they should be dedicated on the final plat. 2. Show on the change of zone plat a typical section: sixty(60)foot interior roadway right-of-way, two 12-foot paved lanes and two 4-foot gravel shoulders. 3. Roadway and grading plans along with details must be approved. Indicate stop signs and street names on final roadway plans. Provide a pavement design along with the final plat submittal. 4. A final drainage report, addressing the issues outlined previously, shall be approved. 5. Department of Publi COLORADO Health and Environment CASE NO.: CZ-632 NAME: John Kadavy/Cottonwood Falls The Weld County Health Department has reviewed this proposal. The applicant proposes a 13 lot PUD. Twelve of the 13 homes were built in 1989 for employee housing at National Hog Farm. Two wells serve the twelve homes, and a third well serves the thirteenth home. The minimum lot size (.96 acres) coupled with the overall density of one septic system per 1.92 acres does not meet the current Department policy. However, the Department acknowledges this is an existing housing development. The application has satisfied Chapter 27 of the Weld County Code in regard to water service. Previously, as employee housing with National Hog Farm, the two wells were designated as a public water system. The submitted application and requested additional documents indicate there will now be three wells serving a total of thirteen homes in the proposed PUD. In order to determine compliance with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1), the applicant should submit a plan review for a potable water supply facility to the Drinking Water section of the Water Quality Control Division of the Colorado Department of Public Health and Environment for re- evaluation. For information regarding the plan review process, the applicant must contact the Drinking Water Section of the Water Quality Control Division of the Colorado Department of Public Health and Environment at (303) 692-3500. The third well is in the process of being registered with Colorado State Engineer's Office. There is inconsistency in documents submitted in the application. Revised covenant item C-14 (received May 20, 2002) indicates the third well will be included in the residential well maintenance administration. However, the 'Real Estate Purchase Agreement', 'Water Lease Agreement' and 'Bargain and Sale Deed and Assignment' documents included in the original application materials only make reference to the two wells serving the twelve homes. These documents should be updated to include the third well. The revised covenant item C-14 is still vague in outlining the duties of the Association. The covenant should be specific in the management of the Public Water System requirements, the funding source, etc, and enforcement provisions. The application has not satisfied Chapter 27 of the Weld County Code in regard to sewer service with regard to minimum lot size and overall density, as previously stated. However, the Department acknowledges this is an existing housing development. Sewer will be provided by individual sewage disposal systems. Septic systems have been installed on all lots. Lots 1, 5 and 11 have had replacement absorption fields installed, and Department records show that for all three lots the first absorption field was abandoned (trenched through) and is now unusable. Therefore, the primary and secondary envelopes for these lots, as submitted, must be changed. Additionally, the Department recommends that septic envelopes be preserved in a manner that will allow its future use in the development covenants. Specifically, the development covenants should address activities such as landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.) should be expressly prohibited in the designated septic envelopes. Lot 13 has a pre-existing home on the property. There is no record of a septic system in the John Kadavy/Cottonwood Falls CASE NO.: CZ-632 Page 2 Department files. Therefore, the septic system must be evaluated as a part of change of zone process. Additionally, the Change of Zone Plat submitted in the application materials does not delineate the location of the existing septic system, the location of replacement envelopes (meeting setbacks to the well and other pertinent physical features, or the location of the existing well and a potential replacement well for Lot 13). Also, based on septic system documentation for Lot 7, the existing absorption field is approximately 144 feet from residential well #2. Based on the scale on the Change of Zone Plat submitted in the application materials the setback between the septic system and well is approximately 60 feet. The initial impact plan submitted in the application materials appears to address all the environmental impacts of Section 27-6-40. The Department recommends the applicant amend the Change of Zone Plat to: 1. Include the location of the existing septic system, replacement envelopes (meeting setbacks to the well and other pertinent physical features, and the location of the existing well and a potential replacement well for Lot 13. 2. Correct the approximate absorption field/well setback on Lot 7 from 60 feet to 144 feet. 3. Relocate the primary and secondary envelopes on Lots 1, 5 and 11. Prior to recording the Change of Zone plat: 1. The PUD must show evidence that the plan review process has be initiated with the Drinking Water section of the Water Quality Control Division of the Colorado Department of Public Health and Environment. 2. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health&Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for the septic system located on the proposed Lot 13 of this proposed PUD. This existing septic system which is not currently permitted through the Weld County Department of Public Health & Environment, will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. 3. Update the 'Real Estate Purchase Agreement', 'Water Lease Agreement' and 'Bargain and Sale Deed and Assignment' documents to include the 3'well. 4. Revise covenant item C-14 to specify the management of the Public Water System requirements, the funding source, etc, and enforcement provisions. The Department recommends approval with the following conditions: 1. All thirteen homes must be served by the Public Water System. John Kadavy/Cottonwood Falls CASE NO.: CZ-632 Page 3 2. A Weld County septic permit is required for any repair or alterations to a septic system and shall be installed according to the Weld County Individual Sewage Disposal System Regulations. Each septic system shall be designed for site-specific conditions, including but not limited to maximum seasonal high groundwater, poor soils, and shallow bedrock. 3. Language for the preservation and/or protection of the second absorption field envelope shall be placed in the development covenants. The covenants shall state that activities such as landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures,dirt mounds, etc.) are expressly prohibited in the designated absorption field site. 4. The applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment, if required. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 5. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 6. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 7. "Weld County's Right to Farm"shall be placed on any recorded plat. The Department recommend that the following requirements be incorporated into the permit as 'development standards': 1. The PUD must be in compliance at all times with the requirements of the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). After discussing the submitted materials with Lee Morrison we agree that the application is incomplete in regard to Chapter 27 of the Weld County Code in regard to water service. Once we receive the info described below we will provide a referral. Please call me with any questions, etc. 1. The application materials are not consistent in terms of the number of wells on the property. There is some discrepancy concerning the number of wells. We have rec'd well permit data for well 35062-F. It appears that well Permit 35063-F is the second well permitted for service to 12 homes, but we have not rec'd any data on that well. Also, Page 3, item 17 of the Cottonwood Falls PUD Specific Development Guide states there are three wells on the property. No information about the third well has been provided in the application materials. Additionally, the third well has not been located on the Preliminary Plat map submitted in the application. 2. It is our understanding that the third well is in the process of being registered with the Division of Water Resources. However, no evidence that the third well has been registered, or is seeking registration from the Division of Water Resources, has been included in the application. We need additional info concerning the status of the third well. 3. No information was provided in the covenants (C12 - subdivision maintenance) regarding the water system administration,who it will be administered by(HOA or separate entity and the formation of that separate entity). Lee Morrison suggests legal consultation on the administration of the water system. Also, there is no information on how the third well will be incorporated into the water system, if at all, or whether that well will be privately owned and the responsibility of the owner of Lot 13. 4. Item C14 of the covenants is inadequate in regards to the water association. Lee Morrison concurs with that observation. Language should be placed in the covenant to incorporate the administration and maintenance of the water system. Since these houses have been in existence and historically have had families whose children attend the district, we do not anticipate any significant positive or negative impact to the school district. The district already services the area with school transportation and do appreciate the improvements for bus stops that have been proposed with the development upgrade. We believe that it is in the general benefit of the community to have the houses occupied and families involved in the school and community rather than vacant houses.
