• • RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #3351 -JOHN AND SANDRA TRUE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., determined at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #3351, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and WHEREAS, the request for Recorded Exemption #3351 was submitted by John and Sandra True, 7370 Weld County Road 1, Longmont, Colorado 80504, for property which is located in part on the following described real estate, to-wit: Part of the NW1/4 SW1/4 of Section 30, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A," said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 15.4 acres and 1.6 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that Recorded Exemption #3351 by John and Sandra True is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. Topographic or physical features of the proposed Lot A, such as ravines, ditches, streams, etcetera, may limit the area available for a new or replacement septic system. Prior to recording the plat, the Weld County Department of Public Health and Environment recommends that the applicant review the Weld County Code pertaining to septic systems tG &asure that any installed septic system will comply with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a septic system, the lot may need to be enlarged. (C` -/a22002-2204 '6�L RE3351 • • RE #3351 - JOHN AND SANDRA TRUE PAGE 2 3. Prior to recording the plat: A. The plat shall be titled: Recorded Exemption No. 1313-30-3 RE-3351. B. The applicant shall submit to the Weld County Department of Planning Services a recorded copy of any access easement agreement signed by all of the owners of the property crossed by the access easement. The access easement shall be for ingress and egress, and shall be referenced on the plat by the Weld County Clerk and Recorder's reception number. In addition to the applicants, the access easement shall be signed by the owners of Lot B of Recorded Exemption #1754, located in the NW1/4 SW1/4 of Section 30, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado. C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access. If a drainage culvert is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert, contact the Weld County Department of Public Works to adequately size the culvert. D. Weld County Road 1 is designated on the Southwest Study Area Capacity Improvement Needs as an arterial status road, which requires 100 feet of right-of-way at full build out. There is presently 60 feet of right- of-way. A total of 50 feet from the centerline of Weld County Road 1 shall be delineated on the plat as right-of-way reservation for future expansion of Weld County Road 1. This road is maintained by Weld County. E. The applicant shall address the requirements of the Weld County Department of Public Health and Environment as stated in the referral response received June 26, 2002, and set aside an area for a septic system replacement envelope on Lot A of the Recorded Exemption. F. The applicant shall address the requirements of Saint Vrain Valley School District RE-1J as stated in the referral response received July 3, 2002. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. G. The applicant shall attempt to address the requirements of the Mountain View Fire District as stated in the referral response received June 19, 2002. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. 2002-2204 RE3351 RE #3351 -JOHN AND SANDRA TRUE PAGE 3 H. The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M, and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead, shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the Building Permit is requested with the Building Permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 4) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot A has an adequate water supply of sufficient quality, quantity and dependability. 5) Prior to the release of building permits on Lot A, the Lot owner shall contact the nearest Town/City or Sanitation District to determine the location of the nearest sanitary sewer line. In accordance with the Weld County Code, if a sewer line exists within four hundred (400)feet of the property line and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. 6) Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2002-2204 RE3351 RE #3351 - JOHN AND SANDRA TRUE PAGE 4 7) Weld County's Right To Farm statement, as it appears in the Weld County Code, Appendix 22-E, shall be placed on the Plat. 4. The applicant shall submit two paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copy the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date the Board of County Commissioners Resolution was signed. The applicant shall be responsible for paying the recording fee. 5. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. It is the opinion of the Department of Planning Services' staff has concerns that the applicant has not shown compliance with Section 24-8-40.6 of the Weld County Code, as follows: A. Section 24-8-40.84-Consistency with the purpose of efficient and orderly development as expressed in Section 24-1-30 of the Weld County Code. 1) Section 24-1-30.A - Assisting orderly and integrated development. Lot A of this Recorded Exemption will be an island lot configuration.Section 24-7-50.J of the Weld County Code states "A flag lot configuration shall be avoided when possible."The creation of an"island lot"is even less desirable than the flag lot configuration. Residents of proposed Lot A will be required to cross a separate property(most likely under separate ownership) in order to access their own property. This creates the potential for future conflicts between private property owners in regards to access. 2) Section 24-1-30.H- Securing equitable handling of all subdivision plans by providing uniform procedures and standards. Planning Staff has consistently avoided island lot configurations where other viable alternatives are available. B. Section 24-8-40.8.5 -Compliance with the recorded exemption standards set forth in Section 24-8-80 of the Weld County Code. 1) Section 24-8-80.J-The proposed recorded exemption does not evade the statement of purpose as set forth in Section 24-1-30 of the Weld County Code. The location of proposed Lot A is not -2-2204 f • i considered orderly and integrated development. There is sufficient area along the western portion of the property to designate a recorded exemption lot that directly borders a county road (Weld County Road 1). c. Section 24-8-40.8.6-Adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and the County. Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached: 1. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts,including noise from tractors and equipment;slow-moving farm vehicles on rural roads;dust from animal pens,field work,harvest,and gravel roads;odor from animal confinement,silage,and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses,including law enforcement,ambulance,and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads,no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases,will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 4. Exhibit E describes the east 30' of their property, which will be used for the road, as well as for utility lines, if necessary. The road will have a 24' x 15" culvert installed along the south side of Road 16 'h, as well as another 24' x 15" culvert placed at the point where the new access road crosses the existing irrigation ditch. Size and length of these culverts have been shared with both Don Carroll of Weld County and those neighbors who currently run irrigation water in the ditch. They have both indicated that the culverts were acceptable. • The road itself will be raised by use of dirt from the barrow pits,which will then be compacted. Next, a layer of pit run gravel will be put in place. Following that, a topcoat • of % inch crushed gravel will be applied. The road will be approximately 16' wide, will accommodate trucks used during construction, as well as support any fire apparatus that needs to access the site, if necessary. The surveyors have indicated a discrepancy between the location of the boundary of the RE 3351 lots and the lots to the north recorded under RE-1754. The RE 3351 survey indicates that the lot boundary between RE-3351 and RE-1754 is actually 14.5 feet south of the lot boundary that was indicated on the recorded RE-1754 plat. I have checked the original survey that outlines the lot boundaries as outlined in the original survey of the property that was recorded in 1973. It appears that the RE-1754 recorded plat may be in error. * My question is how do we address this situation. Can we record the RE-3351 plat as shown or does the RE 1754 plat need to be potentially amended first? Is this an issue between the adjacent property owners or is it an issue that the County needs to have addressed prior to recording the RE-3351 plat? * I have attached copies of all of the applicable plats and surveys. After living on this piece of property for 25 years, we have found it necessary,because of health problems, to consider asking my son and his family to move into our house. We would like to build a small, easier to maintain, residence close to our present house. In order to do this, we need approval of the requested recorded exemption. I have been told that building a new house down in front of our current home on WCR 1 would be viewed as more acceptable than the request we have submitted. With the increase in traffic on WCR 1, we don't find it very desirable to build close to Road 1. Also, that part of our property is the most productive land that we have. It produces the hay needed to winter our cattle. We are able to irrigate that field, vs. the lesser productive dry land that we have designated for the exemption. We also believe that clustering the houses close together on the NE corner of our property will leave more of our property open for agricultural use. I have talked to a member of the Planning Staff and they have indicated the concern about flag polling the property. I can see this needs to be taken into account when considering a proposal such as ours. We also understand that decisions need to be made on a consistent basis. Therefore, I would like to point out that three recorded exemptions have been approved within a mile of our property during the last two or three years. The access for each of these exemptions is either a private drive, and/or crosses another person's property. I have enclosed a map showing where each of these pieces of property are in relationship to our land. I hope this information helps to clarify our request. No irrigation water has been removed from the property during the last 25 years that we have been the owners. However,we continually find that the quantity of water we have available each year is not adequate to irrigate the entire property. 2. Sewage Disposal Disposal of sewage will be by use of a septic system and leach field. The current facility has an approved septic system. See attached sewage disposal system permit#748, dated 6-27-75. 3. Use of Property Currently on the 17A there is one principal residence, which has been there for 25 years. The land, which is used for pasturing 6 cattle, is approximately 12A(prime) irrigated pasture, and the other 5A(non- prime), which includes the proposed parcel is primarily dry land. There are 3 outbuildings near the existing home. There are no oil well production facilities on the property. 4. Reason for Proposal Exemption Because of various health problems, it has become necessary for me to ask for assistance in maintaining the property. My son and his wife have expressed a desire to move their family to the original principal residence, provided we would be able to build a smaller home for our use on the proposed exemption. With their assistance, we hope to be able to remain here in the area, which has been our home for the past 25 years. Our son grew up on this land and has an understanding of what needs to be done in order to properly maintain the property. 5. Proposed New Lot The proposed lot would be 1.6A of hilltop non-prime land located on the NE corner of the current property. The parcel that is being divided from the larger piece of land is the least desirable for use as farmland. The property will remain very rural in nature, and the new residence will blend well with the surrounding community. 13. The District has reviewed the development proposal in terms of future student impacts and available school capacity and has the following RECOMMENDATION: the District is OPPOSED to the approval of this application due to this development's impact on already overcrowded school facilities. The Board of Education has established a District-wide policy of opposing new developments that add to the student enrollment of schools projected to be at or above 125% of their capacity. This particular application, which is currently located in the Erie Elementary and Erie Middle/Senior High School Feeder, will add 1 new single-family dwelling unit with a potential impact of 1 additional student in this feeder. The District opposes this development because, as indicated in the chart below, Erie Elementary and Erie Middle/Senior High schools will exceed 125% of their capacity with the addition of students from this development. The District may reconsider this opposition should the developer wish to discuss how the development can be better timed to coincide with the District's construction of new facilities, or if other mitigation measures can be taken to accommodate this development's contribution of new students in light of school capacity shortfalls. Our comments and requirements are as follows: COMMENTS: WCR 1 is designated on the Southwest Study Area Capacity Improvement Needs as an arterial status road,which requires a 100-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Boulder County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application.
