RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST THOMAS THOMPSON FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Thomas Thompson, VI #0100268, is allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of February, 2002, a public hearing was held before the
Board of County commissioners for the purpose of hearing testimony relating to said violation,
at which time the matter was continued to March 12, 2002, to allow adequate time to discuss
alternative solutions with the property owner, and
WHEREAS, on the 12th day of March, 2002, a public hearing was again held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Thomas Thompson, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until April 12, 2002, to allow adequate time for the property owner to
obtain all final inspections.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0100268 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Thomas Thompson to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until April 12, 2002, to allow adequate
time for the property owner to obtain all final inspections.

Dear Mr Thomas Thompson:
The property referenced above remains in violation of the Weld County Building Code Ordinance. I have
scheduled a meeting with the Board of County Commissioners on February 12,2002 at 10:00 a.m., to consider
the violations occurring on the property. As we discussed the above mentioned property is in violation of the
following Section(s) of the Weld County Code:
Chapter 23,Article III, Div I "A(Agricultural)Zone District"
Section 29-3-50 "Existing use or occupancy"
Section 29-840 "Expiration of permit"
This meeting will take place in the County Commissioners' Hearing Room, First Floor,Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance
to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties a few days before the
Violation Hearing (indicated above).
The Department of Building Inspection will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please call

In reviewing our records we noticed that permit PR-9930026, which was for a blocked & tied mobile
home located at 50501 WCR 103, has not had a final inspection or approval. We are contacting all
permit holders with incomplete permits in an effort to clean up our records. Please call our office and

CONDf11ONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(ll)(A) as the only well on a tract of land of 40 acres described as the
NE 1/4, SE 1/., Sec. 21, Twp. 9 North, Rng. 60 West, 6th P.M., Weld County.
4) The use of ground water from this well is limited to ordinary household purposes inside up to 3 single family
dwellings, fire protection, the watering of poultry, domestic animals, and livestock on farms and ranches, and the
irrigation of not over one (1) acre of home gardens and lawns.
5) The maximum pumping rate shall not exceed 15 GPM.
6) The return flow from the use of the well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
