Nelson Pipeline Facility
The Weld County Public Works Department has reviewed this proposal; this project falls primarily
under the purview of the Use by Special Review Standards,Weld County Code, Chapter 23,Article
II, Division IV, Section 23. Our comments and requirements are as follows:
COMMENTS:
The Colorado Department of Transportation(CDOT)has jurisdiction over all accesses to the State
highways. Please contact Gloria Hess-Idler of Tess Jones at the Greeley office to verify the access
permit or for additional requirements that may be necessary to obtain or upgrade the permit. This
access is on State Highway 52.
The applicant has supplied a traffic impact study analysis to accompany the application. A copy
of this traffic study should be forwarded to CDOT for evaluation and comments.
The proposed access, utility, and drainage easement usually are 30 feet to 60 feet in width. By
making this easement 60 feet in width, the applicant should include the concrete pads and flower
garden, which appear to be half in the easement and half on the James Terry property.
REQUIREMENTS:
Access Improvements/State Highway 52. The applicant shall provide evidence of consultation
from CDOT regarding the adequacy of their intersection to accommodate turning movements of
large construction traffic trucks. Any improvements required by CDOT shall be assumed by the
applicant.
The Weld County Public Works Department recommends a stop sign is placed at the appropriate
location prior to entering on to State Highway 52.
Off-Street Parking and Circulation:The off-street parking spaces including the access drive shall
be surfaced with asphalt or equivalent and shall be graded to prevent drainage problems. The
equipment yard shall be surfaced with gravel, asphalt, concrete, or equivalent, and shall also be
graded to prevent drainage problems. There is one main access to the internal site, equipment,
and storage area. The drawing shows that the gate is at a 45° angle.
I recommend the gate is placed across the approach pad at a 90° angle as not to cause back ups
at the intersection. The circulation throughout the equipment yard appears to be adequate for the
fence facility. The remaining portion of the site approach is paved with adequate parking spaces
and turn-a-round capabilities.

Storm Water Drainage: The applicant submitted a storm water drainage report which has been
prepared by a registered professional engineer licensed in the State of Colorado. This report has
been certified and signed by this engineer. By certifying this report,the Weld County Public Works
accepts the storm water drainage report.
Easement: The USR property is defined on the plat drawing. The applicant defines the proposed
access, utility, and drainage easement that access the facility. A secondary easement is a
proposed utility easement, which is identified as a 15-foot easement that crosses the middle
section of James Terry's property. Both easements shall be defined on the plat drawing with
adequate documentation of record.

Environmental Health Services has reviewed this proposal for a 23,000 sq. ft. contractor's office and shop facility for
a pipeline business. We have no objections to the proposal,however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. In event the shop is equipped with a floor drain, the applicant must apply for an Underground
Injection Control (UIC) Class V Injection Well permit through the Environmental Protection
Agency (EPA), for the floor drain system that serves the maintenance shop, or provide evidence that
the applicant is not subject to the EPA Class V requirements.
2. An individual sewage disposal system is required for the proposed office/shop and shall be installed
according to the Weld County Individual Sewage Disposal Regulations. The septic system is
required to be designed by a Colorado Registered Professional Engineer according to the Weld
County Individual Sewage Disposal Regulations.
3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services
Division of the Weld County Department of Public Health & Environment. The plan shall include
at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include expected
volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including the facility name,
address, and phone number).
4. In the event vehicles or equipment are washed on site, the applicant shall provide evidence that any
vehicle or equipment washing area will be designed and constructed to capture all effluent and prevent
any discharges from the washing of vehicles and/or equipment in accordance with the ' - .

Regulations of the Water Quality Control Commission and the Environmental Protection Agency.
5. In accordance with the Above Ground Storage Tank Regulations (7 CCR 1101-14) a spillage retention
berm shall be constructed around the tank battery. The volume retained by the spillage berm should be
greater than the volume of the largest tank inside the berm. Alternative protective measures may be
allowed provided they comply with the Above Ground Storage Tank Regulations.
6. If applicable,the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public
Health&Environment,Water Quality Control Division.
We recommend that the following requirements be incorporated into the permit as "development standards":
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those
wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites
and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site. In the event the Weld County Department of Public
Health and Environment determines that an excessive amount of dust is generated from this site, a
dust abatement plan and subsequent implementation may be required.
5. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone
as delineated in 25-12-103 C.R.S., as amended.
6. Adequate hand washing and toilet facilities shall be provided for employee and patron use.
7. The facility shall utilize the existing public water supply. (Central Weld County Water)
8. If applicable,the applicant shall obtain a stormwater discharge permit from the Colorado
Department of Public Health& Environment, Water Quality Control Division.
9. Any vehicle or equipment washing area(s) shall capture all effluent and prevent discharges from the
washing of vehicle and/or equipment in accordance with the Weld County Code, the Rules and
Regulations of the Water Quality Control Commission, and the Environmental Protection Agency.

1. Building permits shall be obtained prior to any construction.
2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when applying for the
permit.
3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999
NEC and Chapter 29 of the Weld County Code.
4. Buildings will require an engineered foundation based on a site-specific geotechnical report
or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by Section 23-1-90 of the Weld
County Code.
6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.
