RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR SITE PLAN
REVIEW#324- HOME LUMBER AND SUPPLY COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated April 28, 2002, the Board did approve the application of
Home Lumber and Supply Company, 8037 Midway Drive, Littleton, Colorado 80125, for a
lumber storage operation on the following described real estate, to wit:
Lot 10, Block 1, Rademacher Business Park Final
Planned Unit Development; located in the NW1/4
of Section 23, Township 3 North, Range 68 West
of the 6th P.M., Weld County, Colorado, and
WHEREAS, on August 21, 2000, the Board of County Commissioner of Weld County,
Colorado, did approve an Improvements Agreement According to Policy Regarding Collateral
for Improvements (Private Road Maintenance) for Site Plan Review, SPR #324, between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, and Home Lumber and Supply Company with terms and conditions being as
stated in said agreement, and did accept company check#019330, drawn on the Bank of
America, N.A., Atlanta, Georgia, in the amount of 10,000.00, and
WHEREAS, staff from the Weld County Departments of Planning and Public Works
have conducted a visual inspection and recommends release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the collateral currently being held, in the amount of$10,000.00 be,
and hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate issuing party.

On October 26, 2002, the Department of Planning Services' performed a site investigation of
the completed improvements on Lots 10, 11, 12 and 13, Block 1 of the Amended Rademacher
Business Park at the request of Brent Guetz, General Manager of Home Lumber and Supply
Company. The completed improvements for which a draw is being requested includes the
replacement of all dead on-site landscaping.
Kim Ogle of the Weld County Department of Planning Services' inspected the property and
finds the property to be in compliance with the above referenced Site Plan Review Plat.
Given that the improvements have been completed for the Home Lumber and Supply Company
properties, the Department of Planning Services recommends that the ten thousand and
no/100s (10,000.00) dollars held as collateral be released. Staff's recommendation is to
release the collateral, in the form of a Personal Check. (Check Number 019330 from Bank of
America Bank, N.A., Atlanta, Georgia). This release is not conditioned.

Subject: Request for Release of Collateral

Amended Rademacher Business Park
Dear Mr. Guetz,
The Department of Planning Services' performed a site investigation on July 13, 2001 and
September 11, 2001 of the completed improvements on Lot 10, Block 1 of the Amended
Rademacher Business Park (Site Plan Review 324) per your request. The completed
improvements for which a draw is being requested includes the on-site landscaping.
Chris Gathman of the Weld County Department of Planning Services has inspected these items
and recommends the withholding of the improvements collateral until the two dead, dying trees
have been replaced and all areas containing noxious weeds have been addressed and re-
seeded. The improvements Agreement for Site Plan Review 324, items 8.1.5 and 8.1.6, states
that fifteen (15) percent of the landscaping monies shall be retained for a period of one year. If
at the end of one year, if no replacement landscaping is needed for the site, the fifteen (15)
percent collateral shall be released. Money needed for the replacement collateral is in the
amount of six-hundred and twenty ($62O.00) dollars. This is more than the fifteen (15) percent
collateral amount of Three-hundred ($300.00) dollars. Materials to be replaced include the two
dead, dying evergreen trees, removal of all noxious weeds and the re-seeding of the proposed
grass area within the 30-foot setback from the right-of-way of Camelot Drive as indicated on the
recorded Site Plan Review (SPR) 324 Plat Map recorded on September 5, 2000.
It is my understanding in conversations with Kim Ogle that you are looking into rolling $3,000 of
the $10,000 Letter of Credit for SPR-324 to cover improvements for SPR-289. We request that
an additional $620 dollars be withheld from your Letter of Credit to cover landscaping
improvements for SPR-324. If not, we would request that you provide new collateral to cover
landscaping costs. If you have any questions or concerns, please contact me at the above

SUBJECT: Release of collateral for SPR-324 (Lot 10 - Home Lumber)
Attached is a release of collateral request for USR-324. You have had correspondence with
Kim Ogle regarding release of collateral for SPR-289 (Lots 11-13). This request is for an
adjacent lot which is part of the Home Lumber complex. Proposed grass areas for this site are
in weeds and both trees on this site appear to be either dead or dying. I am waiting to get
confirmation from the Mountain View Fire District on the Fire Hydrant and from Public Works on
the other improvements. At a very minimum, staff will request that a portion of the collateral be
kept to cover landscaping.
