508 RESOLUTION RE: ACTION OF THE BOARD CONCERNING MOBILE HOME PERMIT, ZPMH #2313 - JENNIFER AND RICHARD CROSS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 22nd day of July, 2002, considered the request of Jennifer and Richard Cross, 10133 Weld County Road 110, Carr, Colorado 80612, fora mobile home to be used as a Temporary Accessory to the Farm, and WHEREAS, said mobile home to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: S1/2 SW1/4 of Section 35, Township 10 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that, pursuant to Section 23-4-170 of the Weld County Code, said request should be denied for the following reasons: 1. The applicant has failed to prove that the mobile home will be occupied by persons who are principally employed at, or principally engaged in, the operation of the use where the mobile home is to be located. 2. The applicant has failed to prove that the mobile home is necessary for the effective and economic operation of the use and/or protection of the agricultural use. LEGAL DESCRIPTION: S2 SW4 of Section 35, T1 ON, R67W of the 6th P.M., Weld County, Colorado PARCEL NUMBER: 0303 35 3000006 PARCEL SIZE: 80 acres ZONE DISTRICT: A(Agricultural) WATER SOURCE: Individual well SEWER SOURCE: Septic system The Department of Planning Services' staff has reviewed this request and recommends that this request be denied for the following reasons: 1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 23-4-170 of the Weld County Code, as follows: a. The mobile home will be occupied by persons principally employed at or principally engaged in the operation of the use where the mobile home is located. Accessory farm use of the mobile home shall be established and revalidated on an annual basis as follows: Evidence shall be submitted by the applicant or property owner by the first of each year for review and acceptance by the Department of Planning Services verifying that the mobile home occupant is principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax records, employment agreements or other documentation as determined suitable by the department of planning services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. The property owner has not shown any evidence that the occupant of the mobile home will be principally employed on the site. b. The mobile home is necessary for the effective and economic operation of the use and/or protection of the agricultural use. The site is currently dryland pasture, with upon a site inspection, six cattle were visible in the pasture. The question as to whether or not a parcel of this size can house two dwelling structures is not under consideration. There are other options the applicant may seek to obtain this objective. The applicant has failed to establish just cause for the issuance of this structure. 2002-1946 Should the Board of County Commissioners approved this request, the Department of Planning Services' staff recommends the following conditions be attached: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 and 2 stated above. 4. The mobile home will be occupied by persons principally employed at or principally engaged in the operation of the use where the mobile home is located. Accessory farm use of the mobile home shall be established and revalidated on an annual basis as follows: evidence shall be submitted by the applicant or property owner by the first of each year for review and acceptance by the Department of Planning Services verifying that the mobile home occupant is principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax records,employment agreements or other documentation as determined suitable by the department of planning services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. 5. The MOBILE HOME will not be used as an income source by the applicant for rental to persons who are not principally employed upon the LOT. 6. The applicant shall submit documentation to the Department of Planning Services by August 1st of each year describing the status of the mobile home for accessory to the farm. This permit is temporary and shall terminate once the use ceases to exist, or at which time Planning Staff determines the use is no longer justified. The applicant shall have thirty (30) days to remove the mobile home from the property. 7. The property is in violation of Chapter 23 of the Weld County Code (Violation #01000346). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer and submit a copy of the closure letter indicating compliance with Chapter 23 of the Weld County Code. 8. All derelict vehicles located on the property must be operational with current license plates, be screened from all adjacent properties and public rights of way,or be removed from the property.All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights-of-way. 9. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 10. Any future structures or uses on site must obtain the appropriate zoning and building permits. 11. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.)regulations. 12. The applicant shall utilize the residential access to this parcel, not additional accesses shall be granted. 13. Weld County Road 110 is designated on the Weld County Transportation Plan Map as a local gravel road,which requires 60 feet of right-of-way at full build out.There is presently 60 feet of right-of-way. This road is maintained by Weld County. 14. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant to Section 15-1-10 of the Weld County Code. 15. The applicant shall maintain compliance with Section 23-4-170 of the Weld County Code at all times. Note to file: ZPMH-2313 7/3/02 I talked with Lynn Ross on the phone regarding the hearing date and again had asked her about the animals on the site. Ms. Ross indicated that there were currently about 10 cows and a bull on site, and that more would be coming. Ms. Ross said they also had about 8 sows and that her son raised exotic banti chickens and that she also cared for 1 acre of garden. Dear Applicants: On June 21, 2002,the Department of Planning Staff met to discuss your request for an accessory to the farm. Upon review of the information provided and conducting a site visit, it has been determined that the use is not justified and staff is denying your request as it does not meet the intent of Section 23-4-170 of the Weld County Code. The applicant must demonstrate that the unit is needed for the economic well being of the farming operation, and that there is a viable farming operation on the site. The economic well being criteria has generally been accomplished by showing that the person who will reside in the temporary unit is principally employed on the parcel. Additionally, the size and physical condition of the parcel, such as water availability, farming practices, and soil quality must be shown to also encourage the farming or animal husbandry activities on the parcel. The parcel is not in a productive farming operation. Also upon a site inspection, the number of animal units justify an additional home to be placed on the parcel. I am strongly against the placement of a mobile hone on the property. When I purchased the 80 acres that home was well kept. Now it looks like a junk yard. There is an automobile transmission repair shop business on the property. They do not use the farm for business. The animals on their property are minimal and do not produce income for the farm to qualify them for an additional home. I would suggest and inspection of the property and to assure that the electrical codes are also being followed. I have seen some changes there that are very likely not up to code.
