We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as "development standards": 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 6. Adequate handwashing and toilet facilities shall be provided for employees and the public. 7. The facility shall utilize the existing public water supply. (Central Weld County Water District) 8. The site shall be used as a storage building only. No vehicle washing, concrete processing, mixing, pouring, or forming shall be conducted on the site. Our comments and requirements are as follows: COMMENTS: WCR 50 is designated on the Transportation Plan Map as a local gravel road,which requires a 60- foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. Traffic Counts: The average traffic count(ADT)for WCR 50 was 162 vehicles,taken in a 24-hour period November 17, 1999. WCR 49 has an ADT count of 3100. REQUIREMENTS: Access: The applicant is proposing a second access approximately 500 feet east of WCR 49. ✓ There is existing access to the residence. I would recommend utilizing one access point and teeing off the existing access lane to access the proposed facility and parking lot, thereby reducing additional accesses on to WCR 50. Approach Road and Off-Street Parking: The off-street parking spaces, including the access drive, shall be surfaced with gravel or equivalent, and shall be graded to prevent drainage problems. Storm Water Drainage: The proposed parking lot and new building will displace storm water runoff. Building permits shall be obtained prior to any construction. 2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for the permit. 3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999 NEC and Chapter 29 of the Weld County Code. 4. Buildings will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and Chapter 3. Setback and offset distances shall be determined by Chapter 23 of the Weld County Code. 6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the 100-year flood plain. Please contact me for any further information regarding this project. The traffic volume in and out of this business as well will be limited and will have no impact on the surrounding traffic flows. The Sheriffs Office has no comment towards this USR with the exception that prior to the building of the building that they be interested in sitting down with Mr. Birtus and Mrs. Banowetz and discussing how we can make their building and business more secure.
