Ready Mix Concrete (Robert Baumgartner) The Weld County Public Works Department had reviews this proposal; this project fall primarily under the purview of the Use by Special Review Standards, Weld County code, Chapter 23,Article II, Division IV, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 4 at the US Highway 85 interchange is designated as a section line access to the west. Robert Baumgartner, owner/applicant of the proposed USR, has a Non-exclusive License Agreement along with two easement deeds and a perpetual easement to access his property adjacent US Highway 85. The WCR 4 and US Highway 85 interchange is identified on the US Highway 85 Access Corridor Plan as a public street closure. The short-range identifies that the express way (optional) is to close the medium with a right-in,right-out entrance,and deceleration lane. The long-range freeway designation is to close the intersection and replace with a frontage road on the west side. In discussing the US Highway 85 Corridor Plan with Gloria Hess-Idler, CDOT, I verified that the applicant has contacted CDOT to discuss traffic issues at the intersection of WCR 4/US Highway 85. There is no proposed increase in the traffic or change in the traffic flow. Gloria indicated on a memo dated November 15, 2001, based on the information provided that CDOT does not have the warrants needed to request access changes. In a previous memo dated March 20, 2000, on SPR-320, CDOT indicated that if traffic at the site increases by more than 20%, Mr. Baumgartner may be responsible for improvements to the highway. Attached are the three easement agreements and CDOT's documentation for the intersection. REQUIREMENTS: Dust Control: Rocky Mountain Ready Mix Concrete, Inc. will apply dust suppressant chemicals on the intersection of WCR 4 through the existing 50-foot access easement referred to as Book 902, Reception No. 1823523, which parallels US Highway 85 then west on the existing and proposed access, Reception No. 2761491 for a total of approximately 1000 feet. The dust abatement shall be placed approximately 24 feet in width to accommodate two-way traffic for the facility. The application shall be on an"as needed"basis as determined by the Weld County Public Works Department no less than twice a year. EXHIBIT 2002-1239 I 1 USR-1373, Rocky Mt. Ready Mix Concrete February 6, 2002 Page 2 REQUIREMENTS: Off-Street Parking/Circulation:The off-street parking including the access drive shall be surfaced with gravel, asphalt, concrete or the equivalent and shall be drained to prevent drainage problems. This is a new site circulation; it appears to be adequate from the plat drawing to accommodate the facility. Storm Water Drainage: In Item No. 8 of the questionnaire, the applicant indicated that the storm water drainage plan was attached. I did not receive this item. My requirement reflects Section 23, Section 24-7-120, Storm Drainage Requirements Al. A drainage report shall is required. It shall be prepared, certified, signed, and submitted by a registered professional engineer licensed in the State of Colorado. The Department of Health and Environment may want to review the storm water report if the retention pond is being used to retain site run-off associated with washing out the concrete trucks. Additional items that need to be placed on the plat drawing: 1. At the location of WCR 4 and US Highway 85, the attached document Reception No. 2761490, dated 4/13/2000 identifies the easement deed for access across the Chavez property. This Reception number needs to be shown on the easement. 2. Reception No. 2761491, dated 4/13/2000, identifies the easement deed at the south end of the property that has an access across Double B Corporation. This needs to be placed on the plat. 3. Additional information on the type of 20-foot easement is identified on the south portion of the proposed USR. (Is it a utility, adjacent property or drainage easement?) 4. Status of the existing truck washout. I did request this from the applicant. High Plains Engineering has supplied a drainage report. Environmental Health Services has reviewed this proposal for a concrete batch plant. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. Submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to the Air Pollution Control Division, Colorado Department of Health and Environment for emissions of criteria, hazardous or odorous air pollutants. • 2. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health & Environment, for approval prior to operation. 3. If applicable, a CPDS Permit shall be obtained from the Water Quality Control Division of the Colorado Department of Health for any proposed discharge into State Waterways. 4. The applicant shall provide evidence that any vehicle washing area will be designed and constructed to capture all effluent and prevent any discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission and the Environmental Protection Agency. 5. The applicant shall provide evidence to the Weld County Department of Public Health and Environment, and the Department of Planning Services, that the water well has been appropriately permitted/registered with the Colorado Department of Public Health and Environment, Water Quality Control Division. 6. An individual sewage disposal system is required for the proposed dispatch office and driver break room and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage EXHIBIT 13 • USR-1373 Rocky Mountain Ready Mix Concrete, Inc Page 2 Disposal Regulations. The installation of the septic system shall comply with the Weld County I.S.D.S. flood plain policy. 7. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. The facility shall operate in accordance with the approved dust control plan. The facility shall have sufficient equipment available to implement appropriate dust control. Additional control measures shall be implemented as required by the Weld County Health Officer. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 5. Fugitive dust shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 7. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 8. If applicable, the water system shall comply with the requirements for a community water system as defined in the Primary Drinking Water Regulations (5 CCR 1003-1). 10. Adequate hand washing and toilet facilities shall be provided for employees. 11. The operation shall comply with the Occupational Safety and Health Act (OSHA). 12. Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum washing and the washing of vehicles in accordance with the Weld County Code, the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. Building permits shall be obtained prior to any construction. Permits are also required for the demolition of any building. 2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for the permit. 3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999 NEC and Chapter 29 of the Weld County Code. 4. Buildings will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and Chapter 3. Setback and offset distances shall be determined by Section 23-1-90 of the Weld County Code. 6. Rocky Mountain Ready Mix Concrete, Inc. currently operates a concrete batch plant on property to the east and contiguous to the proposed site. It is the company's intention to replace the existing, twenty year old plant with a new batch plant. Upon completion of the new plant, the old plant with be decommissioned. We will be operating the same number of trucks we currently operate with the same traffic flow. The lbllowing describes the current and proposed traffic flow: Vehicles access the site from State Highway 8) via Weld County Road 4. Westbound horn Highway 85, WCR 4 serves only the industrial park in which our existing property is situated. Traffic enters and exits our existing property from the east, bordenng Highway 85.
