Dear Sir or Madam:
We live near the Varra Sand and Gravel Pit Located on Highway 66 in Platteville. At the
time of their application for permits to operate their gravel pit, your agency issued Varra a
permit to discharge water in to the Saint Vrain drainage. That permit expires on September
30, 2002. We are asking that you NOT renew the permit until Varra changes its method of
operation to wet mining. We are also asking that we be included as parties in any public
process conducted by your agency in the discharge permit renewal process.
Varra is currently mining several deep pits, the largest of which is permitted to extend over
83+ acres and up to 40 feet deep. When Varra started mining in' 2000, it is our
understanding that wells in the immediate vicinity went dry and were deepened. As their
mining operation has progressed, neighbors within 1.5 miles of Varra's operation have
documented a severe drop in the levels of their wells that has coincided with the opening of
the largest of the pits. Meanwhile the Varra operation is pumping copious amounts of
groundwater into the Saint Vrain River to the North and downstream of our wells. This
artificially lowers the water table accessed by well owners to the East and South of their
operation, and artificially inflates surface water available downstream from the point of
dewatering.
Currenty, permitting agencies are requiring other mining applicants the immediate vicinity
of Varra's Highway 66 operation to wet mine. Varra's continued dry mining will undermine
the efforts of other gravel pit owners to preserve the water table.

The current drought has contributed to a water shortage for all of Colorado. The dry
mining operation Varra Sand and Gravel is using has greatly exacerbated the impacts of the
water shortage on surrounding wells and has distorted the natural allocation of surface and
groundwater available to users. The Department of Public Health and Environment can
remedy this situation by denying the renewal of Discharge Permit Number COG-50000,
Facility Number COG-500346.

Subject: Milliken Annexation
Hi Kim and Robert,
I was at your offices yesterday to FYI and discuss the proposed Milliken annexation of the Platte Trust
Property south of town. I wanted to give you a 'heads-up"and some background since I assume one or
both of you will be getting the referal.
First, this is, for your reference and all practical purposes, the S&H mine property from the previous Weld
County USR application last year.
Second, the owners, Platte Trust, have requested inclusion in Milliken's Comprehensive Plan's planning
area. Part of the property is already included in the Milliken Comp Plan's area. They want to include the
remainder as well.
Third, we expect an annexation request will be heard soon. Sean Walsh and Holland and Hart from
Denver are handling the annexation. The property will be brought in as either ag zoning or conservation
district zoning and will include a request to waive the necessity for public water and sewer infrastructure
since it will be agriculture uses, open space and mineral extraction. Residential development will not
occur since the property is substantially in the floodplain.
Fourth, we will be contacting Frank Hempen and Lee Morrison today to start back in to the road
improvements agreement. The haul route plan is to go east on WCR 38 to Highway 60 to US 85 south.
(exact details in the traffic study).
Finally, we are aware of the Coordinated Planning Agreement made between Milliken and the County
even though section 19-10-80 C indicates the agreement terminated on June 30, 2002. We are
proceeding just like the agreement is in full effect unless you tell me otherwise.
