ACHZIGER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 568, being the property of Mr. and Mrs. Charles L. Achziger, described as part of the SW1 NWo, Section 4, T5N, R64W of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded., does not come within the purview of the defi- nition of the terms, "subdivision" and "subdivided land" , pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended. NOW, THEREFORE., BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove des- cribed parcel of land owned by Mr. and Mrs. Charles L. Achziger for a recorded exemption. The property on which the request has been made is described as part of the SW11 NW3, Section 4, T5N, R64W of the 6th P.M., Weld County, Colorado. This property is located six miles east of Greeley on Highway 263. The request is to divide the property into two parcels of 1.5 acres, more or less. A residence presently exists on the proposed Lot "A". The applicants propose to build and fell a residence on the proposed Lot "B". Based upon the information submitted and the adopted policies of the County, the Department of Planning Services staff recommends the request be denied for the following reasons: 1. The proposed request does not comply with the Weld County Comprehensive Plan because it would promote nonagricultural use of agricultural land and it would encourage urban encroach- ment on rural land use. At present there is one residence on the three acre parcel. Approval of the recorded exemption would create an additional residential use and therefore, would be incompatible with the agricultural district uses. 2. It is the opinion of the Department of Planning Services staff that the request is not in compliance with Section 9-2 E. (c) of the Weld County Subdivision Regulations. 820649 Board of County Commissioners August 18, 1982 Page 2 The subject property is located six miles east of Greeley's City Limits. Because of the distance from the town, future development of this site and surrounding area is intended to remain agricultural in nature. This proposal is not compat- ible with the future development of the surrounding area, as permitted by the existing zone and comprehensive plan. There is no proximity to a town and an additional residence in a rural area would place a greater demand on the services which residential uses require. The parcel is located 61 miles east of Greeley on 8th Street, which is across the highway to the north of our farm and residentre. This property has been deteriorating for several years and has been a detriment to the area. We purchased the property from the bank earlier this year, after the former owners lost it through fore- closure. The property has been cleaned up, by us hauling off truck loads of trash and getting rid of the weeds,remodeling the home, installing a sprinkling system, and is now as attractive home on a huge lot. There is a large demand for homes in the country that provide area for families to have a few 4-H animals or hobby animals, but this parcel is to large and turns out to be to much work for the average family with full time jobs. We feel if the property was divided approximately in half from North to South it would give two nice size parcels. Each parcel would have over 200 foot frontage on State Highway 37 and would be within 10 minutes driving time from downtown Greeley. There are two existing water wells on the property. Enclosed is a copy of a replacement permit from the Colorado Division of Water Resources which gives us permission to plug one of the existing wells and redrill it on the West half of this parcel. This will give each parcel their own well for water for livestock, lawn, and garden. Enclosed also is a copy of a letter from North Weld Water District which states there is a tap for the existing home and would be water available for a tap for a new home. The property is located in the Platte Valley School district and volunteer fire district which could serve the property well and have no objection to additional basis for revenue. This property is unique and leans itself very well to a split because of its location on the State Highway, closiness to Greeley, the location of the existing buildings, and availability of water.
