RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 477 - HEARST
AND NANCY PRESSLY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority Of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 21st day of January, 1981, the Board of
County Commissioners approved Recorded Exemption No. 477 con-
cerning property described as part of the SW4, Section 18 , T2N,
R67W of the 6th P.M. , Weld County, Colorado, and
WHEREAS, Hearst and Nancy Pressly are requesting that Re-
corded Exemption No. 477 be amended by decreasing the size of
Lot "A" from ten (10) acres, more or less, to eight (8) acres ,
more or less, and
WHEREAS, the Board of County Commissioners has studied said
request to amend Recorded Exemption No. 477 and deems it advis-
able to approve the amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove amend-
ment to Recorded Exemption No. 477 for Hearst and Nancy Pressly
be, and hereby is , approved.
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant showing a continuation of the
twenty (20) foot wide access easement along the west boundary on
Lot "A" from Lot "B" to the proposed two (2) acre lot north of
Lot "A" on the Recorded Exemption plat before recordation by the
Office of the Clerk and Recorder.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
November, A.D. , 1982.

Re: Amended Reocrded Exemption #477
Dear Commissioners:
The attached application, plat and related items are in reference to a
request to amend Recorded Exemption #477 from Hearst and Nancy Pressly.
The property is described as part of the SW14, Section 18, T2N, R67W of
the 6th P.M. , Weld County, Colorado. The land is located one-fourth
(' ) mile north of the northern edge of the incorporated boundary of
Firestone.
The request is to amend Recorded Exemption #477 by decreasing the size
of Lot "A" from ten (10) acres, more or less, to eight (8) acres, more
or less. The applicant wishes to exclude a two (2) acre parcel from
Lot "A" that is located at the north portion of Lot "A" for their daughter
so that she may construct a residence.
Based upon the information submitted, the Department of Planning Services
staff recommends approval of this requested amendment for the following
reasons:
1. The impact on surrounding agricultural land uses would
not appear to be any different than the original request,
which has been approved.
2. This request is in compliance with Section 9-2 C of the Weld
County Subdivision Regulations, Submission Requirements.
3. This request is in compliance with Section 9-2 E. of the Weld
County Subdivision Regulations, with the exception of 9-2 E.
(k) where the Board may exempt from this definition.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall show a continuation of the twenty (20)
foot wide access easement along the west boundary on Lot "A"
from Lot "B" to the proposed two (2) acre lot north of Lot
"A" on the Recorded Exemption plat before recordation by the
office of the Clerk and Recorder.

COMMENTS:
Parcel has one set of existing improvements located on it. (Residence) Access to property
is over and across 20' easement on west side of Lot B of RE-477. WCR 20 is gravel surfaced.
There is also an oil and/or gas improvements located on property or to the south of property.
It was hard to determine where the east/west property line was. North can of parcel is
higher that south end. Two residence exist to the south of prrcperty. Several small tracts
with residential dwelling are located to the east of this property.

This office represents Hearst J. and Nancy A. Pressly, the recorded
owners of Lot A, Recorded Exemption No. 1311-18-3-RE477.
Mr. and Mrs. Pressly own a mobile home on the south portion of
Lot A. They wish to give the north two acres of Lot A to their
daughter, Sandra Jo Matzke and her husband, Paul Edward Matzke
so that they can build a home on the two acres. Sandra is pregnant
and would very much like to have construction begin as soon as
possible so that the home might be completed by the time her baby
is born.
