We are the owners of Lot"B"of Recorded Exemption RE2310, being part of
S2NW4 of Section 16, T1N, R66W, containing 74 acres, more or less. The
Assessor's Parcel Number for this property is 147116000045.
The property is currently under contract for sale to Robert L. Wiley and Janet
Sue Wiley by a Contract to Buy and Sell Real Estate dated March 25, 2002. The
contract is contingent upon the Wileys obtaining approval from the Weld County
Department of Planning Services for a Use By Special Review on the property for
a small trucking operation in conjunction with their planned residence.
We hereby authorize the Wileys, or their authorized agent, to make application

Explain,in detail,the proposed use of the property.
Response: This USR application is only to encompass 2 to 4 acres in the existing 9 acre
building envelope as exhibited on attached map for Lot B of Recorded Exemption No.
1471-16-2-RE2310,recorded September 25, 1998 as Reception No. 2642664,being a
part of S1/2NW1/4 1/4 of Section 16,Township 1 North,Range 66 West of the 6th P.M.,
County of Weld, State of Colorado. The Wiley Trucking&Farm facility is a proposed
construction of a 50'x75' (3750 sq.feet)shop to be shared with equipment pertaining to
the farming operation on the 74 acre farm and a parking area for 4 tandem-pup trucks.
Wiley Trucking is a small aggregate hauling company that has been in business since
1979. Two of the trucks are equipped to haul agricultural products and have been used
in that capacity in the past,however the bulk of work pertains to aggregate hauling for
infrastructure expansion in the surrounding Front Range. At this time,the company
employees 5 people; 2 of these are the proposed owners of the property who also plan to
build a residence on the farm. There are no plans for expansion of the trucking company
at this time,however,the addition of a fifth truck could be possible within five to seven
years. The primary goal of locating the building in the Northwest corner of the property
is to preserve as many acres under irrigation as possible. The existing access to the
property is via County Road 29,south from County Road 10,which dead-ends at the
entrance to the property.
2. Explain how this proposal is consistent with the intent of the Weld County
Comprehensive Plan.
Response: This proposal is consistent with the goals and policies of Section 22-2-10.
Agriculture. The proposed use is not incompatible with the surrounding rural area. The
bulk of the 74 acre farm shall continue to be irrigated and fanned. Agricultural uses
contain structures of similar size,height and scale,hours of operation and vehicular
activity is similar in nature.
3. Explain how this proposal is consistent with the intent of the Weld County Zoning
Ordinance and the zone district in which it is located.
Response: This proposal has been designed in accordance with the Weld County Zoning
Ordinance as described in Section 24—Uses by Special Review. The Agricultural Zone
allows commercial activities by Special Review and in this situation,the truck/farm shop
shall be used for parking and maintenance only. There is one soil type within the
building envelope(#76 Vona Sandy Loam)per Soil Conservation Service Office report.
4. What type of uses surround the site?Explain how the proposed use is consistent and
compatible with surrounding land uses.
Response: The surrounding uses,those located within''mile,are agricultural crop
production,dairy production, or rural residential sites. In some cases,both uses exist on
a piece of property. Our site shall incorporate landscaping consistent with any well-
maintained home/farm. As part of many fanning/dairy operations in the area,there is a
variety of farm vehicles using the roads. The types of vehicles that will be parked at this
facility are similar in nature.

5. Describe,in detail,the following:
a. How many people will use the site?
Response: On-site employees:
Office: 1 (owner in home office)
Shop: 4 as needed on Saturday, 3 of these report to the facility but
work at various metro locations,one of the four is the homeowner.
b. How many employees are proposed to be employed at this site?
Response: The total is 5. Two are the property owners and will occupy the
residence.
c. What are the hours of operation?
Response: Normal hours are 6:00am to 4:30pm;Monday-Friday and some Saturday
hours as well.
d. What type and how many structures will be erected(built)on this site?
Response: One structure on the 2 to 4 acre proposed USR site. The shop shall be
shared by the truck and farm operation.
e. What type and how many animals,if any,will be on this site?
Response: No animals will be within the proposed USR area.
f What kind(type, size,weight)of vehicles will access this site and how often?
Response: Two tractors,a manure spreader and various farm implements will be
perminately located at the site. A swather,baler and stack wagon will access the site
periodically during haying season. Four(4)tandem-pup trucks will leave daily
from this site,empty leaving and returning empty. Empty vehicle weight average is
30,0001bs. Three employee vehicles(cars or pickups)will arrive and depart once
each way daily. A service or delivery type truck may be necessary on occasion.
g. Who will provide fire protection to the site?
Response: Fort Lupton Volunteer Fire Department.
h. What is the water source on the property?(Both domestic and irrigation).
Response: Domestic water from existing well permit#229705(attached)to be
drilled.Irrigation water is from the Fulton Irrigating Ditch company;23 shares
included with the purchase contract,to supply the existing pivot sprinkler.
i. What is the sewage disposal system on the property?(Existing and proposed).
Response: There is no sewage disposal systems on the(vacant land)property. The
proposed system shall be an on-site septic system per Weld County Health
Department standards. A septic permit will be obtained prior to building the shop.
Employee restroom will be provided in the shop.
j. If storage or warehousing is proposed,what type of items will be stored?
Response: Storage in the shop will be tools,maintenance items(filters,lubricants,
small parts,and spare tires),oil and antifreeze totes for purposes of truck and tractor
maintenance. The 4 trucks are parked overnight. Fuel storage: 250 gallon diesel and
250 gallon gasoline in overhead tanks per required standards for farm equipment.
The trucks are fueled daily off-site.The gas and diesel tanks are primarily for farm
equipment or emergency use. No job materials, such as aggregates,are stored on-
site. There shall be no type of inventory sales onsite except possible hay storage
pending sale.

6. Explain the proposed landscaping for the site.
Response: The property owner will plant two rows of 3'to 4' Scotch or Austrian pines on the
North edge of the proposed USR site as a screen from the nearest neighbor.Equipment will be
parked behind(East)or inside the shop to maintain a visually pleasing view from the nearest
through road(Rd 27)to the West(one mile away). Columnar Buckthorn shrubs will screen
graveled employee-parking area. The dumpster shall be located on the South of the shop,
screened by a 5'cedar privacy fence. The screening on the West end of the farm is not
appropriate as the shop structure will screen outside parking of trucks and the absence of
residences West of the facility negates the need for additional screening. East side screening
is not necessary as the East boundary of the farm abuts the west property line of the Howard
Binder fann off road 31(1 mile East). Please note:the Fact side of the building envelope is a
minimum of 2135'from the Binder property line. The Southerly boundary will be partially
screened by owners proposed horse barn(not a part of this USR application).
7. Explain any proposed reclamation procedures when termination of the Use by Special Review
activity occurs.
Response: The proposed use is for a permanent facility on the farm,as such there are no
reclamation plans.
8. Explain how the storm water drainage will be handled on the site.
Response: Storm water runoff from the shop will be collected with gutters and with the use of
underground drain pipes diverted to nearby trees or shrubs for supplemental watering.
9. Explain how long it will take to construct this site and when construction and landscaping is
scheduled to begin.
Response: Actual construction time for the shop should be 1-2 months. We plan to start
/'" construction in fall 2002. Landscape construction will begin as soon as feasible, subject to
time of year and/or weather conditions
10. Explain where storage and/or stockpile of waste will occur on this site.
Response: The trucking and fanning operation does not create any waste product as such. A
dumpster is to be used for ordinary waste; any scrap iron or recyclable items will be kept in
bins. Waste oil from equipment is sometimes stored in small amounts and is transported off-
site by a waste oil recycling company. (Tri State Oil-EPA#COR000001677). On occasion,
equipment washing shall take place on the site;biodegradable soap will be used.

Telephone conversation with Tom Schaffer, Water Quality Control District Engineer for Weld County, CO.
RE: Washing of farm tractors and Wiley Trucking vehicles.
As long as washing involves equipment that we own there are no special requirements. There are no
regulations at this time,however things could change in the future. He said if we were concerned about
runoff,diverting water to a lined pond type area to allow for evaporation could be an idea. I told him we
always use a biodegradable soap and at most washing would be a twice-monthly schedule,weather
permitting. He is transferring to Grand Junction but will also cover Weld County until his replacement is
hired.
On 4/23/02 I called Mr. Schaffer's voice mail and requested a fax summarizing our conversation
(recommended by Trevor Jiricek,Director of Environmental Health 970-304-6415 X2214)Trevor told me
if USR is approved they would list containing any runoff water on our property(standard disclaimer).
