RE: DENIAL OF MOBILE HOME PERMIT NO. 793 - YVONNE MANNON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado on the 12th day of October, 1983 , considered the request
of Yvonne Mannon to place more than one mobile home to be used
as an accessory use to the principal use in a Commercial Zone
District (C-3 District) , on a parcel of land more particularly
described as follows:
Part of the NWq NE;, Section 3 , T1N, R68W
of the 6th P.M. , Weld County, Colorado
WHEREAS, the Board of County Commissioners, after hearing
the testimony and studying the evidence presented in this matter,
finds that the request for said mobile home does not meet the
criteria as outlined in Section 43 of the Weld County Zoning
Ordinance and; therefore, should be denied.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the request of Yvonne
Mannon to place a mobile home to be used as an accessory to the
principal use on the above described parcel of land, which was
found not to be in compliance with the Weld County Zoning Ordi-
nance, Section 43 , be, and hereby is, denied.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 12th day of
October, A.D. , 1983 .

COMMENTS:
Access to the 3.71 acre lot is from 1-25 Frontage Road. The improvements on the
property consist of a mobile home.
Other items on the property were a recreation vehicle, the subject mobile home (red
tagged) , a shed that is to be attached to the subject mobile home, a truck and trailer,
three vehicles that don't appear to run and scrap or junk material.
There is no commercial operation on the property.

The attached application and related items are in reference to a request
from Yvonne Mannon for a Zoning Permit for more than one Mobile Home to
be used as an accessory use to the principal use in a Commercial Zone
District. The parcel of land on which
this

described as part of the NWT NE1, Section 3, equ
Weld County, Colorado. The property is presently zone "C-3" (Commercial
Three) .
The property is located approximately 2.5 miles west of the town of
Dacono at the southwest corner of Colorado State Highway 52 and Inter-
state 25.
Mrs. Mannon has indicated, in a letter dated August 29, 1983, that she is
requesting a second mobile home to be used as a construction trailer and
office until she gets a building constructed for a diesel repair garage.
There are currently two (2) mobile homes located on the subject property.
One is permitted under ZPMH #434. The other was moved onto the property
without the required permits.
Based upon the submitted information and criteria as outlined in the
Weld County Zoning Ordinance the Department of Planning Services staff
recommends the request be denied for the following reasons:
1. The applicant has failed to demonstrate, in the submitted
written materials or in oral statements made prior to the
formulation of the staff's recommendation, that the mobile
home is necessary for the efficient and economic operation
of the commercial activity. The staff field check revealed
that there is no commercial operation on the property.
2. The applicant has failed to demonstrate, in the submitted
materials or in oral statements made prior to the formula-
tion of the staff's recommendation, that the mobile home
will not be used for residential purposes other than for
the purpose of protection or control of the principal use.

The applicant has failed to adequately show the need for
a second mobile home to be utilized for the purpose of
protection or control of the principal use when the
principal use of the property appears to be for residen-
tial purposes.
3. On September 20, 1983, Rod Allison contacted Mrs. Mannon
by telephone who explained to him that the person renting
the existing mobile home on the property is employed by
the Coor's Recycling Plant near Fort Lupton and is a night
watchman on the subject site in the evening.
There is also a recreational vehicle on the subject site
with two (2) people living in it. They apparently do
construction in the Northern Colorado area and would like
to rent the proposed second mobile home on the property.
Until such time that the applicant meets the criteria as outlined in
Section 43 of the Weld County Zoning Ordinance the staff would recommend
this application be denied.

Planning Staff contacted Mrs. Mannon on September 20, 1983 to discuss the
findings of the field check completed on September 19, 1983.
Mrs. Mannon explained that the mobile home existing on the property is rented
to a person for $200.00 a month plus a portion of the utilities. The person
renting the mobile home is employed by the Coors Re-cycling Plant in Ft. Lupton
and is a night watchman on the subject site in the evening.
There are two (2) people living in a recreational vehicle at the subject site.
The people living in the R.V. do contract construction work in the northern
Colorado area and would like to rent the second mobile home on the property under
consideration for the permit.
The owners of the commercial lot plan in the future to construct a building.
The building would then be advertised for commercial rental space. The people
living in the R.V. could help build the proposed building on evenings or
weekends.

I, the undersigned, understand and agree to the conditions of this Zoning
Permit which are as follows:
1. One (1) mobile home is permitted as an accessory use to the principal
use in any "B" Business District, "C" Commercial District

2. All zoning permits for mobile homes as accessory uses to the prin-
cipal use in the B, C, or I District are temporary. Such permits shall
automatically expire, and the mobile home shall be removed upon the
cessation of the use of the mobile home as an accessory use to the
business, commercial or industrial activity.
3. More than one zoning permit for a mobile home in the B, C, or I
Districts as an accessory use to the principal use may be issued only
upon approval by the Board of County Commissioners.
Further, I, the undersigned, meet the following conditions which are
required to be eligible for this permit.
1. The mobile home is necessary for the effective and economic operation
of the business, commercial or industrial activity.
