RE: APPROVAL OF RECORDED EXEMPTION #3009 - GEORGE BYDALEK
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., determined at a public meeting held in the Chambers of the
Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #3009, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land," and
WHEREAS, the request for Recorded Exemption #3009 was submitted by George
Bydalek, 8188 Weld County Road 39, Fort Lupton, Colorado 80621, do Pamela Edens, P.O.
Box 459, Hudson, Colorado 80642, for property which is located in part on the following
described real estate, to-wit:
NW1/4 of Section 32, Township 1 North, Range 64
West of the 6th P.M., Weld County, Colorado
being more particularly described in the plat which shall be provided by the applicant and known
as Exhibit"A," said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 29.706 acres and 3.521 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,
exempt from the definition of the terms, "subdivision" and "subdivided land."
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #3009 by George
Bydalek is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic
system shall be installed according to the Weld County Individual Sewage
Disposal System (I.S.D.S.) Regulations.
2. The Applicant has proposed a well as the source of adequate water for Lot A
and Lot B. Property owners are advised that the quantity of water available for
usage may be limited to specific uses, i.e., "Domestic Use Only," etc. Because
each situation is unique, the Department of Planning Services encourages
property owners to contact the Office of the State Engineer, Division of Water
Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone
303-866-3581), to discuss each individual situation.

3. Topographic or physical features of proposed Lot A, such as ravines, ditches,
streams, etc., may limit the area available for a new or replacement septic
system. Prior to recording the plat it is recommended that the applicant review
the Weld County Code pertaining to septic systems to assure that any installed
septic system will comply with all setback requirements found in the Code. In the
event the proposed lot is not of sufficient size to allow the installation of a septic
system the lot may need to be enlarged.
4. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 1475-32-2 RE-3009
B. In accordance with Chapter 8, Article II, of the Weld County Code, Lot B
shall be granted one residential/agricultural access. The access road
shall be graded and drained to provide all-weather access. The access
shall be placed in such a location as to have adequate sight distance in
both directions, shall not be placed below the crest of a hill or where
physical obstructions are present, and shall be a minimum distance of 75
feet from any intersecting County or State roadway.
C. Lot A shall use the existing agricultural access point as no additional
accesses shall be granted.
D. All approved accesses shall be clearly shown on the plat. The applicant
shall contact the Weld County Department of Public Works to determine
if a culvert is necessary at any approved road access point. If a drainage
culvert is required, a 15 inch Corrugated Metal Pipe (CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert,
he should contact the Weld County Department of Public Works to
adequately size the culvert.
E. Weld County Road 4 is designated on the Weld County Transportation
Plan Map as a local gravel road, which requires 60 feet of right-of-way at
full build out. There is presently 60 feet of right-of-way. A total of 30 feet
from the centerline of Weld County Road 4 shall be delineated right-of-
way on the plat. This road is maintained by Weld County.
F. The Southeast Weld Soil Conservation District has provided information
regarding the soils on the site. The applicant shall submit written
documentation that he has reviewed the information and will use it to
positively manage on-site soils.
G. The applicant shall provide the Weld County Department of Planning
Services with a certificate from the Weld County Treasurer showing no
delinquent taxes exist for the original parcel.

H. The applicant shall contact the Weld County Extension Office to develop
a Weed Management Plan. Evidence that a plan has been created shall
be submitted to the Weld County Department of Planning Services.
The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property
is located. Pursuant to the definition of setback in the Weld
County Code, the required setback is measured from the future
right-of-way line. No building or structure as defined and limited
to those occupancies listed as Groups A, B, E, H, I, M, and R in
Table 3-A of the 1997 Uniform Building Code, shall be
constructed within a 200-foot radius of any tank battery or within a
150-foot radius of any wellhead. Any construction within a
200-foot radius of any tank battery, or 150-foot radius of any
wellhead, shall require a variance from the terms of the
Section 23-6-10 of the Weld County Code.
2) Any future structures or uses on site must obtain the appropriate
zoning and building permits.
3) Potential purchasers are hereby notified that Horse Creek
Reservoir is located directly south of the site. Off-site impacts
that may be encountered include flooding and spill from the
Reservoir.
4) Prior to the release of building permits, the applicant shall submit
a recorded deed describing the Lot upon which the building permit
is requested with the building permit applications. The legal
description on such deed shall include the Lot designation and
Recorded Exemption number.
5) Prior to the release of building permits, the applicant shall submit
evidence to the Department of Planning Services that Lots A
and B have an adequate water supply of sufficient quality,
quantity and dependability.
6) Potential purchasers should be aware that Lot A and Lot B may
not be eligible for a domestic well permit which allows for outside
irrigation and/or the watering of stock animals. The State Division
of Water Resources issues all well permits.

7) Potential purchasers should be aware that groundwater may not
meet all drinking water standards as defined by the Colorado
Department of Public Health and Environment. The Weld County
Department of Public Health and Environment strongly
encourages well users to test their drinking water prior to
consumption and periodically thereafter.
8) Should noxious weeds exist on the property or become
established as a result of the proposed development the
applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II, of the
Weld County Code.
9) Any disturbance of wetlands shall require the applicant to contact
the Army Corps of Engineers for permits pursuant to Section 404
of the Clean Water Act.
10) Weld County's Right To Farm statement, as it appears in the
Weld County Code, Appendix 22-E, shall be placed on the Plat
5. The applicant shall submit a paper copy of the plat for preliminary approval to the
Weld County Department of Planning Services. Upon approval of the paper
copy the applicant shall submit a Mylar plat along with all other documentation
required as Conditions of Approval. The Mylar plat shall be recorded in the office
of the Weld County Clerk and Recorder by the Department of Planning Services.
The plat shall be prepared in accordance with the requirements of
Section 24-8-70 of the Weld County Code. The Mylar plat and additional
requirements shall be submitted within sixty (60) days from the date of the Board
of County Commissioners resolution. The applicant shall be responsible for
paying the recording fee.

The Department of Planning Services'staff has reviewed this request and recommends that this request be denied
for the following reasons:
1. It is the opinion of the Department of Planning Services'staff that the applicant has not shown compliance with the
following criteria as listed in Section 24-8-40.B.1 through 24-8-40.6.6 of the Weld County Code:
A. Section 24-8-40.8.2- Compatibility with existing surrounding land uses.
The site lies directly below the Horsecreek Reservoir along the Horsecreek draw. In a referral dated February
5, 2001, the Henrylyn Irrigation District indicated that during a 100-year storm event, this parcel would be
flooded.
B. Section 24-8-40.6.3-Consistency with the intent of the zone district the recorded exemption is located within
as expressed in Chapter 23 of the Weld County Code.
In Weld County the minimum buildable lot size is 80 acres.On March 29, 1978 Kenneth and Mary Bydalek sold
thirty-five(35)acres of an eighty-eight(88)acre parcel to George Bydalek. They also sold 45 acres to Glen
Dorkins and 4 acres to Gene Beck. In all, one non-buildable and two illegal lots were created. Mr. Dorkins and
Mr. Beck did apply for Recorded Exemption 929 to correct their illegal lots. Only after they submitted a
engineering report proving that building would be possible on their lots was approval granted.
Mr. Bydalek was asked to provide evidence that building on the lots would be possible. He has been unable
or unwilling to do so.
C. Section 24-8-40.6.4 - Consistency with the purpose of efficient and orderly development as expressed in
Section 24-1-30 of the Weld County Code.
1) Section 24-1-30.A -Assisting orderly and integrated development.
2) Section 24-1-30.B-Promoting the health, safety, and general welfare of the residents of the County.

3) Section 24-1-30.G- Safeguarding the interests of the public, the homeowner, and the subdivider.
4) Section 24-1-30.N-Preventing flood damage to persons and properties and minimizing expenditures
for flood relief and flood control projects.
In a referral dated February 5, 2001, the Henrylyn Irrigation District indicated that during a 100-year
storm event, this parcel would be flooded. Further, in a referral dated March 13, 2001, the Southeast
Weld Soil Conservation District indicated that there is considerable potential for flooding due to the
proximity to Horse Creek Reservoir. Mr.Bydalek was asked if he would propose mitigation for flooding.
He has been unable or unwilling to do so.
5) Section 24-1-30.0-Restricting or regulating building in flood hazard overlay district areas,shorelands,
areas covered by poor soils, or in areas poorly suited for building or construction.
In order to subdivide the adjacent property, the applicants submitted an engineering report for
subsurface soils and percolation tests.Their application stated"having received results of soil test on
lot B, have found few places that are currently suitable building locations." In a referral dated March
13, 2001, the Southeast Weld Soil Conservation District indicated that on site soils have a moderate
to severe limitation for septic tank absorption fields and a moderate limitation for buildings.
6) Section 24-1-30.R-Ensuring the planning for and provisions of an adequate and safe source of water
and means of sewage disposal.
D. Section 24-8-40.8.5 -Compliance with the recorded exemption standards set forth in Section 24-8-80 of the
Weld County Code.
1) Section 24-8-80.B - An adequate sewer service is available to serve the uses permitted on both
proposed lots. The sewer service shall comply with the requirements of the applicable zone district and
the Weld County Health Department.
E. Section 24-8-40.8.6-Adequate provision for the protection of the health,safety,and welfare of the inhabitants
of the neighborhood and the County.
Should the Board of County Commissioners approve this request, the Department of Planning Services' staff
recommends the following conditions be attached:

10) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural
counties in the United States,ranking fifth in total market value of agricultural products sold. The rural
areas of Weld County may be open and spacious, but they are intensively used for agriculture.
Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts
with longstanding agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views,
spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life.
Without neighboring farms, those features which attract urban dwellers to rural Weld County would
quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well run agricultural
activities will generate off-site impacts,including noise from tractors and equipment;slow-moving farm
vehicles on rural roads;dust from animal pens,field work,harvest,and gravel roads;odor from animal
confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of
pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening the efficient
delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public
or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices
that are commonly or reasonably associated with agricultural production.
Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware)with
more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of
the area to be served stretches available resources. Law enforcement is based on responses to
complaints more than on patrols of the county and the distances which must be traveled may delay
all emergency responses, including law enforcement,ambulance,and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to emergencies. County
gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected
from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not
be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are
of the lowest priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers
must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban setting. Farm
equipment and oil field equipment,ponds and irrigation ditches,electrical powerfor pumps and center
pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock
present real threats to children. Controlling children's activities is important, not only for their safety,
but also for the protection of the farmer's livelihood. Parents are responsible for their children.
5. The applicant shall submit a paper copy of the plat for preliminary approval to the Weld County Department of
Planning Services. Upon approval of the paper copy the applicant shall submit a Mylar plat along with all other
documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County
Clerk and Recorder by Department of Planning Services'Staff. The plat shall be prepared in accordance with the
requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements shall be

(see attached letter). Should you wish not to proceed with the Recorded Exemption, then the
Department of Planning Services will need to be notified in writing of your decision. If you do not wish to
withdraw the application and are unable to supply the additional information, you will be scheduled for a
Board of County Commissioners hearing. Planning Staff will be recommending denial of your request at
the hearing. If your application is denied by the Board of County Commissioners, the decision could
effect future land development applications located on the parcel. Withdrawing the applications will not
effect future applications.

Dear Ms. Edens:
The Weld County Planning Staff has reviewed Recorded Exemption 3009 (RE-3009) for George
Bydalek. Concerns regarding the soil conditions and on site flooding were raised during this review. The
site lies directly below Horse Creek Reservoir and appears to have few suitable areas for building
locations.
The property directly east of this proposed application was divided by a Recorded Exemption in 1986.
The application submitted for the previous Recorded Exemption included a Subsurface Investigation and
percolation test results executed by a professional engineer in order to verify the suitability for
constructing dwellings and septic systems. The application further stated "having received results of soil
test on lot B, have found few places that are currently suitable building locations."
Prior to a decision by Planning Staff, we will require additional information to determine that both Lot A
and Lot B have locations that can be safely and feasibly built upon. A Subsurface Investigation Report

RECORDED EXEMPTION- BYDALEK
1) The two proposed lots that are being created by this Recorded Exemption are to be
service by domestic water wells. Well permits will be applied for upon approval of this
recorded exemption. The State of Colorado Water Resource Department will not issue
well permits for a parcel of land until a legal parcel is created. It is being proposed that
the following note be placed on the Recorded Exemption plat. "No building permits or
other permits will be issued until a well permit is received from the State."
This parcel is dryland and has no irrigation rights.
2) These parcels will be serviced by individual septic systems.
3) This 33.227 acre parcel is currently being used for agricultural purpose. It has one
pole barn on it.
4) This Recorded Exemption is being proposed by Mr. Bydalek so that he can have a
legal buildable site and sell the 3 acre site. There are no proposed changes at this time
other than creating two lots.
5) The 33.227 acre parcel is in the NW quarter of Section 34, Township 1 North, Range
64 West of the 6th. P.M., Weld County, Colorado. The parcel Currently is being used for
agricultural purposes.
6) This parcel has a natural division of land with the horse creek overflow ditch dividing
it.
7) All future buildings will meet setback requirements.
8) At this time the applicant does not with to place a conservation easement of the
property.
9) There will be no designated building envelopes on either parcel.
10) This Recorded Exemption is consistent with the Weld county Comprehensive Plan as
no major changes are being proposed other than dividing the parcel into two parcels.
Access to these parcels will be from Weld County Road 4.
11) The land surrounding this parcel is primarily agricultural with residences. No changes
are being proposed for this parcel other than creating two parcels so that the smaller
parcel can be sold.
12) This Recorded Exemption is consistent with the Weld County Comprehensive Plan
and Weld County Zoning Ordinances as no major changes are being proposed other than
dividing the parcel into two parcels.

and orderly development as defined in the Weld County Subdivision Ordinance,

In consultation with the Natural Resources Conservation Service (NRCS) ,
we have reviewed the above referenced case and have the following
comments .
SOILS/LIMITATIONS: The soils found on this parcel are classified as
Haverson loam (26) and Vona sandy loam (77) . The Haverson soil is a
deep, well drained soil found on terraces and flood plains . This soil
has moderate permeability and high water holding capacity. The Vona soil
occupies the higher terraces . Permeability is moderately rapid with only
moderate water holding capacity. Both soils will support plant growth
with rooting depths to 60 inches . The Vona has a severe limitation for
septic tank absorption fields and the Haverson has a moderate
limitation. Both soils have moderate limitations for buildings .
PRIME FARMLANDS: Both soil s would be considered as 'prime ' farmland, if
irrigated.
SOIL EROSION POTENTIAL: Runoff is slow from both soils but there is a
high potential for wind erosion.
OTHER: The applicant should contact Ron Broda at Weld County Weed
Management Department (970-356-4000 ext. 3770) to develop a weed
management plan. This parcel does not show as being in a defined flood
plain (FEMA) but there is considerable potential for flooding due to the
proximity to Horse Creek Reservoir.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system(s)
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
Additionally, please note the following:
1) This application is proposing a well(s) as its source of water. The applicant
should be made aware that while they may be able to obtain a well permit from
the Office of the State Engineer, Division of Water Resources, the quantity of
water available for usage may be limited to specific uses, i.e. domestic use only,
etc. Also, the applicant should be made aware that groundwater may not meet
all drinking water standards as defined by the Colorado Department of Public
Health and Environment. We strongly encourage the applicant to test their
drinking water prior to consumption and periodically test it over time.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Weld County Recorded Exemption Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 4 is designated on the Transportation Plan Map as a local gravel road,which requires a 60-foot right-of-way
at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to
the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required
setback is measured from the future right-of-way line.
WCR 53 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant
to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required
setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present.
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert.
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No circle
drives will be allowed. This policy shall apply to all new and existing accesses within the unincorporated areas
of Weld County. Properties within municipalities or other counties that access Weld County roads are also subject
to this policy.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation. No
additional accesses shall be granted.
Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.
