The Weld County Public Works Department has reviewed this proposal; this project falls primarily
under the purview of the Use by Special Review Standards, Weld Code, Chapter 23, Article II,
Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
WCR 27 (83r° Avenue) is designated on the Transportation Plan Map as a arterial status road,
which requires a 100-foot right-of-way at full build out. The applicant has reserved an additional
20-foot right-of-way adjacent to WCR 27 for a total of 50 feet from the center line of WCR 27. This
has been designated on the plat as future expansion for WCR 27. This facility is located within the
Windsor Study Capital Improvement Needs Area.
WCR 64.5 is designated on the Transportation Plan Map as a collector status road,which requires
a 80-foot right-of-way at full build out. The applicant has reserved an additional 10-foot right-of-way
adjacent to WCR 64.5. A total of 40 feet from the center line has been designated on the plat for
the future expansion for WCR 64.5. This location is also identified in the Windsor Study Capital
Improvement Needs Area.
Through a former USR, the applicant has an existing Road Improvements Agreement in place with
the Weld County Public Works Department on the designated haul route to the facility.
Improvements to the entrance have been completed with an acceleration and deceleration lane.
All commercial trucks will utilize this designated haul route.
REQUIREMENTS:
Off Street Parking: The off-street parking spaces adjacent to the office and scale area shall be
utilized for the additional retail landscaping amenity.
Traffic Circulation/Loading Area: Significant space shall be provided in loading/service areas
to accommodate vehicles without encroachment upon truck traffic circulation.
Miscellaneous: With the amendment to the USR for the landscaping material, does the applicant
need to amend or obtain a flood hazard permit, as the material is stockpiled within the 100-year
flood plain?

Environmental Health Services has reviewed this proposal for 2n° amendment of USR-
1125 for the use of a retail landscaping yard. We have no objections to the proposal,
however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. Submit an amended dust abatement plan to the Environmental Health Services,
Weld County Department of Public Health & Environment, for approval prior to
operation.
2. If applicable, the applicant shall amend the existing Emission Permit for the
modification in the operation if the Colorado Department of Public Health and
Environment determines that such a modification represents a significant change
in emissions or production.
3. The septic system serving the concrete batch plant shall be reviewed by a
Colorado Registered Professional Engineer. The review shall consist of
observation of the system and a technical review describing the systems ability
to handle the proposed hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public
Health and Environment. In the event the system is found to be inadequately
sized or constructed the system shall be brought into compliance with current
Regulations.
4. If necessary, the applicant shall amend the existing CPDS Permit from the
Water Quality Control Division of the Colorado Department of Health.
We recommend that the following requirements be incorporated into the permit as
"development standards":
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for

final disposal in a manner that protects against surface and groundwater
contamination.
K 2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of"solid
waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
6. The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
7. The facility shall provide an adequate water supply for drinking and sanitary
purposes.
8. Adequate handwashing and toilet facilities shall be provided for employees.
/J. The facility shall operate in accordance with the approved dust control plan. The
facility shall have sufficient equipment available to implement appropriate dust
control. Additional control measures shall be implemented as required by the
Weld County Health Officer.
10. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
11. The operation shall comply with all applicable rules and regulations of the
Colorado Division of Minerals and Geology.
12. All fuel tanks, septic tanks, temporary buildings, and any other hazardous items
that might wash away during flooding shall be securely anchored and adequately
flood proofed to avoid creation of a health hazard.
13. The operation shall comply with all applicable rules and regulations from the
Colorado Department of Labor and Employment, Oil Inspection Section.
14. The operation shall comply with the Occupational Safety and Health Act (OSHA).

1. Building permits shall be obtained prior to any construction. A separate permit is required
for the removal of existing buildings and the installation and/or construction of new buildings.
2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when applying for the
permit.
3. Manufactured buildings shall be installed in accordance with the requirements of the State of
Colorado Division of Housing Manufactured Home Installation Program (MHIP). All inspections
will be performed by Weld County inspectors.
4. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by Chapter 23 of the Weld
County Code.
5. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.

Dear Mr. Gathman:
The Town of Windsor Planning Commission reviewed this referral at its regular meeting of March
20, 2002. The subject property is located outside the growth management area but within the
community influence area and is depicted partially as Community Separator and partially as Parks,
Open Space and Floodplains on the Land Use Plan map. The Comprehensive Plan states that the
Community Separator land use depiction provides for areas of open space and open lands which
generally have little or no development, with the exception of agricultural activities. The Parks,
Open Space and Floodplains depiction provides for lands that are open and generally undeveloped.
Since no development is proposed for the property, the Planning Commission forwards a
recommendation of approval of the amendment to the Use by Special Review, subject to all
requirements of the Windsor-Severance Fire Protection District being addressed to the District's
satisfaction.

Dear Mr. Gathman:
The City of Greeley has reviewed the Site Specific Development and USR Permit for an open-cut gravel
mining operation, asphalt and concrete batch plant, and a recycling plant along with a Use Permitted by
Right, Accessory Use, or a USR in the Commercial or Industrial Zone Districts for stockpiling and retail
sale of landscaping materials in the A (Agricultural) Zone District. This site is within the City of
Greeley's Long-Range Expected Growth Area(LREGA), which is the area within which the City of
Greeley expects to grow within the next twenty(20) years, but outside of the City's Mid Range
Expected Service Area(MRESA), the area within which the City expects to be able to provide a full
range of municipal services within the next five (5) years. Because the subject property is located
outside of the MRESA, the City does not object to the proposed use on the property; however, because
the property is located within the City of Greeley's LREGA, the Planning staff recommends that the site
be developed in compliance with the City's Development Code requirements.
Section 18.46.160 of the Development Code contains specific design review criteria for outdoor storage.
These criteria include:
• Outdoor storage shall not be permitted within any applicable setback, public rights-of-way, or
in landscaped areas.
• Outdoor storage of all materials stored in an unenclosed area shall be screened from the view
of the public rights-of-way. Screening shall be accomplished through the use of a solid fence or
wall of sufficient height to fully screen all stored materials, or through the use of landscaping
(including plant materials and /or berm) which provides year-round screening of a sufficient
height to fully screen all stored materials, or through a combination of fencing, walls and
landscaping.

Parking is also a concern for this site. Paved parking should be designated on the site plan and the
parking should comply with City Standards including the following:
• An adequate number of parking spaces should be provided. Retail sales require one (1) space
per 250 square feet of gross floor area, plus one (1) space per 300 square feet of gross area
outdoor display.
• Parking lots should be screened from adjacent right-of-way and at least 5% of the interior of
the parking lot should contain landscaping.
• Parking should not be located in any required setback or any non-paved surface.
It should also be noted that this site is in the 100-year flood plain and is considered a High Impact Zone
for Areas of Ecological Significance. Structures within the 100-year flood plain should be elevated to
one foot above the 100-year elevation, and a biologist's report should be completed to ensure that
further development of the site does not impact any significant plant or animal species which may be
found on the property.
There is a question on the height of the piles of landscaping materials. On March 14, 2002, I contacted
the applicant, Hall-Irwin, to determine the proposed height of the piles. As of today there has not been a
response from Hall-Irwin. The City of Greeley Planning Department recommends that the pile heights
not exceed ten (10) to twelve (12) feet in height.

I. The lot shall have its own access; each access shall be designed to carry a
designed wheel load of 18000pounds (80000 pound gvw) (H2O loading).
2. The access shall be constructed of a permanent all weather road base.

4. Addresses shall be posted clearly on the structures.
