HomeMy WebLinkAbout20023279.tiff EMERGENCY ORDINANCE NO. 226 IN THE MATTER OF THE ANNUAL APPROPRIATION FOR WELD COUNTY, COLORADO, FOR FISCAL YEAR 2003 BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it is necessary to set the annual appropriation for Weld County, Colorado, for Fiscal Year 2003, and WHEREAS, the Board of County Commissioners of Weld County, Colorado adopted the annual budget in accordance with the Local Government Budget Law, on December 11, 2002, and WHEREAS, in compliance with Section 3-8 of the Weld County Home Rule Charter for Weld County, Colorado, which provides that the Board of County Commissioners shall act only by ordinance in matters of contracts, and inasmuch as this Appropriation Ordinance provides for authority to expend or contract to expend or to enter into any contract which, by its terms, involves the expenditure of money for any purpose recited in this Appropriation Ordinance. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners in and for the County of Weld, State of Colorado, that all monies received from the sources and for the purposes named in Exhibit A, attached hereto and incorporated herein as a part of this Ordinance, be, and hereby are, appropriated for the County's operations for said Fiscal Year, commencing January 1, 2003, as estimated at this time to be, and which will become, available during the year 2003. BE IT FURTHER ORDAINED by the Board that an emergency exists inasmuch as State law requires that the budget Ordinance of Weld County, Colorado, be enacted on or before the 31st day of December, 2002; therefore, this Ordinance is declared to be an Emergency Ordinance under the provisions of Section 3-14 of the Weld County Home Rule Charter. BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. The above and foregoing Ordinance No. 226 was, on motion duly made and seconded, adopted by the following vote on the 11th day of December, A.D., 2002.
