Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40.8.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. The Applicant has proposed a well as the source of adequate water for Lots B and C. Property
owners are advised that the quantity of water available for usage may be limited to specific uses, i.e.,
"Domestic Use Only," etc. Because each situation is unique, the Department of Planning Services
encourages property owners to contact the Office of the State Engineer, Division of Water Resources
(1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581),to discuss each
individual situation.

3. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 1311-12-2 RE-3466
B. In accordance with Chapter 8, Article II of the Weld County Code, Lots B and C shall be
granted one residential access. Direct access from a public road shall be limited to one
access per legal parcel for residential use, no circle drives or additional accesses shall be
granted.The road shall be graded and drained to provide all weather access. Accesses shall
be placed in such a location as to have adequate sight distance in both directions, shall not
be placed below the crest of a hill or where physical obstructions are present and shall be a
minimum distance of 75 feet from any intersecting County or State roadway.
C. Lot A shall use the existing residential access point as no additional accesses shall be
granted.
D. Lots B and C shall use the existing residential / agricultural / oil and gas / ditch road access
points necessary for agricultural operations as no additional accesses shall be granted.
E. All approved accesses shall be clearly shown on the plat.The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved
road access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe (CMP)
is Weld County's minimum size. If the applicant chooses to place a larger culvert please
contact the Weld County Department of Public Works to adequately size the culvert.
F. Weld County Road 22.5 is designated on the Weld County Transportation Plan Map as a local
gravel road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet
of right-of-way. A total of 30 feet from the centerline of Weld County Road 22.5 shall be
delineated right-of-way on the plat. This road is maintained by Weld County.
G. Weld County Road 23 is designated on the Weld County Transportation Plan Map as a
collector status road,which requires 80 feet of right-of-way at full build out.There is presently
60 feet of right-of-way.A total of 40 feet from the centerline of Weld County Road 23 shall be
delineated on the plat as right-of-way reservation for future expansion of Weld County Road
23. This road is maintained by Weld County.
H. The applicant shall address the requirements of Weld County School District RE-8 as stated
in the referral response received November 12, 2002. Evidence of such shall be submitted
in writing to the Weld County Department of Planning Services.
I. The applicant shall provide the Weld County Department of Planning Services with a
Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the
original parcel.
J. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups
A, B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be
constructed within a 200-foot radius of any tank battery or within a 150-foot radius of
any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot
radius of any wellhead shall require a variance from the terms of the Section 23-6-10
of the Weld County Code.
2) All construction or improvements occurring in the flood plain as delineated on Federal
Emergency Management Agency FIRM Community Panel Map 080266 0866 C dated
September28, 1982, shall comply with the Flood Hazard Overlay District requirements
of Chapter 23, Article V, Division 3 of the Weld County Code.
3) The installation of any septic system within the 100-year flood plain shall comply with
the Weld County I.S.D.S. flood plain policy. In accordance with the State of Colorado
I.S.D.S. Regulations, no septic system shall be installed with in the floodway.
4) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
5) The existing septic system on Lot A(permit#SE-0000095),will require evaluation prior
to use for a new home. In the event the system is found to be inadequate, the system
must be brought into compliance with current I.S.D.S. regulations.
6) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lots B and C have an adequate water supply of
sufficient quality, quantity and dependability.
7) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
8) Recorded Exemptions on adjacent properties may raise the issue of compliance with
the intent of the Recorded Exemption Process. Approval of this Recorded Exemption
does not guarantee approval of future applications on adjacent properties.
9) Potential purchasers should be aware that Lot B may not be eligible for a domestic well
permit which allows for outside irrigation and/or the watering of stock animals. The
State Division of Water Resources issues all well permits.
10) Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
11) Potential purchasers should be aware that approval of this Recorded Exemption does
not guarantee that well permits will be issued for the lots. Any lot may be deemed non-
buildable if the lot owner is unable to obtain a well permit. The State Division of Water
Resources issues all well permits.
12) Any disturbance of wetlands shall require the applicant to contact the Army Corps of
Engineers for permits pursuant to Section 404 of the Clean Water Act.
13) Potential Purchasers are hereby notified that a confined animal feeding operation is
located directly north and west of the intersection of Weld County Roads 22 and 23
(Special Use Permit 209). Off-site impacts that may be encountered include noise from
trucks, tractors and equipment; dust from animal pens and odors from animal
confinement, silage, and manure.
14) Effective January 1,2003, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the County Wide Road Impact Program, Area 3.
(Chapter 20, Article II of the Weld County Code)
15) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest, and gravel roads;odor from animal confinement, silage,and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
• provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
4. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. Upon approval of the paper copies the applicant shall
submit a Mylar plat along with all other documentation required as conditions of approval.The Mylar
plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning
Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70
of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty
(60) days from the date the Administrative Review was signed. The applicant shall be responsible
for paying the recording fee.
5. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles,Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to maps5co.weld.co.us.
6. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to meet
any one of these conditions within 60 days of approval, then this case will be forwarded to the Weld
CountyBoard of County Commissioners with a staff recommendation for denial.

Response to the questionairre is as follows:
l.Domestic Water Presently a well has been authorized and used for years at the site
known as Lot A(est. 16 acres)where I had my family house, which was burned down and was
destroyed completely three years ago. It is still usable and legal. For Lot B(23 acres est.),a well
will be needed and properly applied for. I checked with the Water District in Greeley and was told
that a well could be authorized for another home on the Lot B, as well as another well for the last
home on Lot C( 120 acres).
Irrigation Water Presently,I have 3 ponds and 1 1/2 share of Lupton Bottom Ditch
company plus 20 shares of Lupton Meadow Ditch company on this 160 acre parcel as well as the
additional 120 parcels connected to this land. I am a Senior Member of these Ditch companies,as
I and my family have had this irrigation water for quite a long time.
2.An approved existing septic system has been used for the home on Lot A,where my family home
was destroyed by fire. I do not anticipate any problems in securing two more septic systems for
the homes on Lots B and C. Papers attached for the existing septic system.
3.Presently, I live in my Daughters'Modular home on the adjacent lot to Lot A. I could rebuild a
home on Lot A, where all water/septic currently exists. I have other friends/family who will be
living on Lots B and C, once this request is approved. I have alfalfa and hay as crops on parts
of this 160 acre site and will continue these operations similarly my Horse/Cattle operations
will continue to be on this land. I will keep control of most of the Irrigation Water, and utilize it
as necessary for the Alfalfa/Hay operations throughout my entire Ranching land.
4,The main reason for this request is to divide the existing 160 acres into 3 building sites----with
Parcel A being 16 acres,Parcel B being 23 acres and remainder being Parcel C(121 acres). I will
build a house on spot that the Old House burned....as the utilities and Propane lines are intact.
This will be Parcel A( 16 acres on corner of WCR 23 and WCR 22.5). Another house will be built
on Parcel B(23 acres)which is on the high ridge above the irrigation canal--on western edge of
the property (see Vicinity Map). Similarly,another home will eventually be built on the largest
Parcel C( 121 acres)but not immediately. The Cattle/Horse operations will continue throughout
this request and after approval. My family has had this land for many decades and I believe it is
time to request this type of division, while maintaining my Cattle/Horse operations.
5. The location of Lot A shall be at the corner of WCR 23 and WCR 22 1/2, going slightly North
and east (see Vicinity Map). Lot B shall be on WCR 23 entirely,on the western edge of the 160
acres, lying above the Irrigation Canal on the High Ground. Lot C( 120+acres) will be located
East of Lot B, taking most of the Northern border of the acreage and going East above and away
from the other existing 80 acre lot (see Map).
6.The property's highest elevation is on its Western Edge (WCR 23)and it drops in elevation,not
dramatically but slowly towards the astern edge,which is the So.Platte River,of the property.
Drainage of the property goes from West to East towards the River, and from the South to North
as the FEMA map has shown me. Most of the Irrigation Ditch water and natural drainage enters
a channel onto the property and fills some of the 3 ponds and some Wetlands area on the land.
All of the water drains or goes underground towards the So.Platte River. The 160 acre is fenced
completely and has varied easements for Oil/Gas operations on the land. Unique characteristics
may include some small'wetlands'areas on the northern edge of Lot C (120 acres)and a pond in
central part of Lot C (see map)pluw few Oil/gas wells/burners on Lot C in central part of lot. A
main corral may also be in central part of Lot C,wherein cattle/horse are kept. The building spot
for Lot C will be on the SW section of the land,off WCR 22 1/2 road Fa cement for oil/gas and
for the rear 40 acres which I own does exist,coming off WCR 25 onto WCR 22 1/2 roads(see map)
that flows along the River Road and through the trees.
7. To the best of my knowledge,the present Barns and Flay sheds do meet minimum setbacks and
offsets needs for the Ag Zone District,wherein it is located. Likewise,any new structures will
meet all standards. We have discussed this plan with Weld County Building Dept and Transport-
ation departments,to assure that it is able to be done. They were very positive and helpful.
8.At this time,1 am not willing to place a conservation easement on my property.
9. Once I am able to divide this 160 acre site into 3 building sites, I will build on the same building
envelope that my previous home existed(Lot A)on. Next,I will build a home on Lot B(WCR 23)
on an envelope that will be appropriate to the Building Dept. For my future home on Lot C, it is
to be off WCR 22 1/2 ,far away from the Wetlands and Ponds and basic Drainage pattern that I
discussed with FEMA and persons in your Planning/Zoning department.
10.After checking with Platteville and Frederick/Fireston officials,regarding their long range plans
I was convinced that my property will not be in any of these towns plans. This proposal is within
the Weld County Comprehensive Plan and consistent with it, to best of my understanding.
11.This proposed usage is compatible with the surrounding existing land uses, as it is primarily
Cattle/Hone ranching operations. I do that currently,and will continue to do it in future.
12.Regards the proposal being consistent with the intent of the district it is located within,as
expressed in the Weld County Zoning Ordinance, as amended and the Weld County Comprehensive
Plan, it is to the best of my understanding. It is agricultural and will remain the same. Alfalfa/Hay
will continue to be the crops,as they are now.
13.I and my family have lived here for decades and will continue to do so,for foreseeable future. My
children and their families live here also,as do many of my friends here in Colorado. I believe this
proposal is consistent wtih the efficient and orderly development of my land,as defined in the Weld
County Subdivision Ordinance section 1/3. I sincerely thank you for your assistance in helping me

On September 14,2000,an evaluation of the existing individual septic disposal system at 11097 Weld
County Road 22 'A, Fort Lupton, Colorado; Section 12,Township 2 North, Range 67 West,was
conducted by Steve Wiatrowski, an environmental specialist of this department.
The existing individual septic disposal system is of sufficient size and capacity to adequately handle the
proposed load. This evaluation is based on a final treatment capacity for a 3 bedroom residence.
Be advised, neither the County of Weld nor any of its agents or employees undertake or assume any
liability to the owner of the above property, to any purchaser of the above property or to any lending
agency making a loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and
for detecting health hazards observable at the time of inspection. This does not constitute a warranty that
the system is without flaw or that it will continue to function in the future. Inspections requested during
periods of snow cover and high soil saturation may be of questionable value to potential buyers due to
adverse conditions. Evaluations based on Statements of Existing(S.O.E.)relies on information the
property owner provides,under oath, indicating current status of the system and representing to the best
of his/her knowledge the system is not failing to function properly.

WCR 22.5 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article Ill, Section 23-3-50, the
required setback is measured from the future right-of-way line.
WCR 23 is designated on the Transportation Plan Map as a collector status road, which requires an 80-foot
right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-
50, the required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present.
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert.
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No
circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall
apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within
municipalities or other counties that access Weld County roads are also subject to this policy.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
No additional accesses shall be granted.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system(s)
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. The existing septic system, on lot A permit# SE-0000095, will require evaluation
prior to use for a new home. All septic systems located on the property shall have
appropriate permits from the Weld County Department of Public Health &
Environment. In the event the system(s) is found to be inadequate, the
system(s) must be brought into compliance with current I.S.D.S. regulations.
3. The installation of any septic system within the 100-year flood plain shall comply
with the Weld County I.S.D.S. flood plain policy (attached). In accordance with
the Colorado I.S.D.S. Regulations, no septic systems shall be installed within the
floodway.
Additionally, please note the following:
1) This application is proposing a well(s) as its source of water. The applicant
should be made aware that while they may be able to obtain a well permit from
the Office of the State Engineer, Division of Water Resources, the quantity of
water available for usage may be limited to specific uses, i.e. domestic use only,
etc. Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.

Thank you for referring the Carole Kuipers Three Lot Recorded Exemption to
the School District. Based upon expected student generation rates from what
appears to be the possibility of three new single-family unit on 160 acres,
the new homes would generate approximately 3 new students to be accommodated
within district. Bus transportation would likely be provided.
It is understood that approval of the proposed new lot does not yet add a
residential unit to enrollment potential. However, certain school issues
should be considered at this important juncture, including school site
planning, transportation access and facility capacity.
The current facilities that would serve this lot are Twombly Primary, Butler
Elementary, Fort Lupton Middle School and Fort Lupton High School.

development could impact all levels of schools. In addition, even without
this project, completion of other previously approved developments would
generate more students than can be accommodated by the existing schools.

As the volume of developments increases with no alleviation of the existing
capacity conditions, the ability to provide the same quality education for
these new students becomes increasingly difficult. Weld County School
District Re-8 requests the cooperation and participation of the developer to
provide cash in-lieu of land dedication fee, (currently $939) , to address the
need for future school sites. Further, the District requests that the County
assist with monitoring residential growth working and consider facility
capacity impacts upon the schools in determining whether a new project should
be approved.
We appreciate your cooperation and the opportunity to comment upon the issues
of interest to both the County and the School District. We ask that the
building permit not be issued until the applicant demonstrates that the cash
in-lieu of land dedication fee has been paid, or that arrangements have been
made with the School District. If you have any questions or need additional

Reference is made to the above-mentioned project located in Section 12, Township 2 North,
Range 67 West, Weld County, Colorado.
If any work associated with this project requires the placement of dredged or fill material, and
any excavation associated with a dredged or fill project, either temporary or permanent, in waters of the
United States at this site, this office should be notified by a proponent of the project for proper
Department of the Army permits or changes in permit requirements pursuant to Section 404 of the Clean
Water Act. Waters of the U.S. includes ephemeral, intermittent and perennial streams, their surface
connected wetlands and adjacent wetlands and certain lakes,ponds, drainage ditches and irrigation
ditches that have a nexus to interstate commerce.
