A public hearing was conducted on October 30, 2002, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 10, 2002, and duly published October 16,
2002, in the Tri-Town Farmer and Miner,a public hearing was conducted to consider a Community
Development Block Grant application for a water and sewer system connection for the Chambers
Subdivision in Weld County. Mr. Warden stated the Board is required to hold two public hearings
before and after a project using CDBG funds. He stated this allows for public input regarding any
concerns, proposed modifications, and a follow-up review. Mr. Warden stated a $300,000 grant
has been received from the Colorado Department of Local Affairs, and the funds will be used to
connect Chambers Subdivision to the Brighton water and sewer system. He stated 51 percent of
the residences in this area have a low to moderate income. No public testimony was offered
concerning this matter. There being no further discussion, the hearing was completed at 10:05
a.m.

PROJECT SUMMARY:
The project consists of the installation of water and sewer lines, so the Chambers
Subdivision in Weld County can be connected to the City of Brighton's water and sewer
system.
FINDING OF NO SIGNIFICANT IMPACT
An environmental review for the project has been made by Weld County and is available for public
examination and copying at the offices noted below. Based on this review,the County of Weld has
determined that a request for release of project funds will not significantly affect the quality of the
human environment and hence, an environmental impact statement will not be undertaken under
the National Environmental Policy Act of 1969 (P.L. 91-190).
The reasons for the decision not to prepare an environmental impact statement are as follows:
An environmental review for the project has been made by Weld County and, based
on this review, the County of Weld has determined that a request for release of
project funds will not significantly affect the quality of the human environment and
hence, an environmental impact statement will not be undertaken under the
National Environmental Act of 1969 (P.L. 91-910).
PUBLIC COMMENTS ON FINDING
All interested agencies, groups or persons disagreeing with these decisions are invited to submit
written comments for consideration by the County of Weld by November 23, 2002. All comments
must clearly specify which decision they object to -- the Finding of No Significant Impact or the
Request for Release of Funds. All comments so received will be considered by the County of Weld
prior to its taking any administrative action or requesting release of funds on the date listed
immediately above.
RELEASE OF GRANT FUNDS
The County of Weld will undertake the project described above with CDBG/HOME Grant funds
from the Department of Local Affairs, under Title 1 of the Housing and Community
Development Act of 1974 or Title 11 of the Cranston-Gonzalez National Affordable Housing
Act. The County of Weld is certifying to the state that the County of Weld and Donald D. Warden
in his/her official capacity, consent to accept the jurisdiction of the Federal courts if an action is
brought to enforce responsibilities in relation to environmental reviews, decision-making, and
action; and that these responsibilities have been satisfied. The legal effect of the certification is
that upon its approval, the County of Weld may use the CDBG/HOME Act of 1969 and other
environmental responsibilities listed in 24 CFR Part 58. The state will accept an objection to its
approval of the release of funds and acceptance of the certification only if it is on one of the
following bases: (a)that the certification was not in fact executed by the Chief Executive Officer or
other officer of the County of Weld and approved by the state (b) that the County of Weld's
environmental review record for the project indicated omission of a required decision finding, or
step applicable to the project in the environmental review process, or(c)another Federal agency
has submitted written comments pursuant to section 309 of the Clean Air Act or Section 102(c)of
NEPA. Objections must be prepared and submitted in accordance with the required procedure(24
CFR Part 558), and may be addressed to Department of Local Affairs, CDBG/HOME Program
Staff, 1313 Sherman Street, Room 521, Denver, CO 80203. Objections to the release of funds on
bases other than these stated above will not be considered by the state. No objection received
after 15 days from the date of request for funds listed above will be considered by the state.

The County of Weld plans to submit a Community Development Block Grant (CDBG) application
to the State of Colorado, Department of Local Affairs. CDBG funds are intended to provide decent
housing,suitable living environments and economic opportunities, principally for low and moderate
income persons through rehabilitation and preservation, economic/job development and public
facilities improvements. It is estimated that $8,265,000 will be available statewide for the "Small
Cities" CDBG program projects.
The application being considered would request $300,000 for a water and sewer system
connection for the Chambers Subdivision in Weld County. It is estimated that over 51% of the
funds would benefit low and moderate income persons. Permanent involuntary displacement of
neighborhood persons or businesses is not anticipated. Should it later become necessary to
consider such displacement, alternatives will be examined to minimize the displacement. If no
feasible alternatives exist, required/reasonable benefits will be provided to those displaced to
mitigate adverse effects and hardships. Any low and moderate income housing which is
demolished or converted will be replaced.
A public hearing will be held at 9:00 a.m. on Wednesday, October 30, 2002, in the first floor
hearing room, at 915 10th Street, Greeley, Colorado, to obtain citizen views and to respond to
proposals and questions related to:
• the proposed CDBG application for a water and sewer system.
• community development and housing needs, including the needs of low and moderate
income persons, as well as other needs in the community that might be addressed
through the CDBG program.
• the performance of the County of Weld in carrying out its community development
responsibilities.
Written comments are also welcome and must be received by 9:00 a.m. on October 30, 2002, at
915 10th Street, Greeley, Colorado 80631. Oral and written comments will be considered in
deciding whether to submit an application for the proposed project. Written summary information
will be available in the Office of the Clerk to the Board, Third Floor, 915 10th Street, Greeley,
Colorado on October 10, 2002, until October 30, 2002, on any CDBG application(s) the County
intends to submit to the State. A copy of the application(s) as submitted to the State will be
available for public review in the Office of the Clerk to the Board, Third Floor, 915 10th Street,
