Dear Commissioner Vaad:
Colorado Revised Statutes 30-11-104 (b)requires new jail construction after August 30, 1999 to
comply with standards adopted by the Colorado Department of Public Health and Environment. The
statute, however, allows a county to establish local standards in lieu of complying with state standards.
The standards relate to jail space requirements, special use areas or special management housing,
and environmental condition requirements including,but not limited to, standards pertaining to light,
ventilation, temperature, and noise level. I believe county control of these standards would be more
responsive to local needs and local standards should be adopted prior to new construction at the North
Jail Complex.
My staff has consulted standards from the American Correctional Association,National Institute
of Corrections, and the National Commission for Correctional Health Care to prepare a draft of Sanitary
Standards for Jail Facilities Operated by Weld County. The draft was reviewed by representatives of the
Weld County Health Department and the Weld County Attorney. As a result of that review process, a
final draft has been prepared and accompanies this letter.
I am recommending the Board of Weld County Commissioners adopt the final draft of Sanitary
Standards for Jail Facilities Operated by Weld County. My staff and I are available to discuss the
recommended standards. Your time and consideration are appreciated.
