The Board asked us to prepare a response to your request. We researched the matter and came up with the following information. Our records show that Habitat for Humanity of Windsor Inc acquired the property in two pieces.The Great Western Railway donated one on May 21, 1998 and the other was deeded from the Town of Severance on July 10, 1998.The new parcel (070535400014)was created and valued as vacant land.The valuation and taxes were prorated for 1998 to reflect the change in status from exempt to taxable.Taxes for 1998 were paid. For the 1999 assessment year,the property was again appraised and taxed as vacant land.As of the assessment date of January 1, 1999,the land had not been granted exemption and no residential structures had yet been built.To be classified and assessed as residential property,there must be actual residential dwellings on the property or they must be actually under construction. Under state law,all property is taxable unless a specific exemption is granted.Habitat for Humanity,as a non-profit organization,must specifically request exemption for parcels that are used for building the Habitat homes.The Colorado Division of Property Taxation is responsible,under the law,to examine each exemption application and make a determination as to whether the property is exempt.The decision to grant or deny exemption rests solely with this State agency.Until the Division makes a determination,the County Assessor must list and value property as taxable. In this case,the State granted the exemption on the property as of March 1, 2000.The decision allowed the exemption on the land for one year prior to the actual building of the homes,to allow for the installation of site improvements and infrastructure.The valuation for assessment year 2000 was prorated,to reflect the change of status from taxable to exempt. The taxes for 2000 have also been paid. The law is very clear in cases like this.The county has no decision-making authority in the determination of this kind of exemption.Our research does not show that any errors were made in the valuation or levying of the property tax for this parcel for the 1999 assessment year.Unfortunately,we have no legal means by which to adjust or nullify the assessment or the taxes still due on the parcel. The successor accounts,R1383202 and R1383302,are currently listed as exempt and so no new taxes are being levied on the property.We regret that we can find no remedy for you regarding the 1999 assessment. Box 758 Greeley, CO 80632 Dear Commissioners: We are writing to ask your consideration in waiving the tax assessed on the vacant land now owned by Habitat for Humanity of Windsor. The land is located in Severance, CO. We have filled out the necessary paper work in the past showing that we are a tax exempt organization who's purpose is to build homes for God's people who would not otherwise have the opportunity to own a home of their own, and to help eliminate sub-standard housing. Our resources come from donations, and a few grants, and materials that we try to obtain at a reduced price if possible. The homes are built by volunteers and the families chosen to occupy the homes. In order to continue our work, we must rely on the generosity of individuals and organizations. The vacant land is being taxed because infrastructure was not started on the land until 1999. Tax bill 7412998. We were unable to start infrastructure until we had the means to do so. Per conversations with the assessors office, vacant land is assessed higher than when it has a building on it, which also puts a great strain on our limited resources. There is also a late charge on this tax bill, which we would like to have waived, as we were going back and forth with paper work and did not receive the actual tax bill until July 17th. We are enclosing a copy of the tax bill in question, and would appreciate an answer as soon as possible on your decision.
