HomeMy WebLinkAbout20021822.tiff HEARING CERTIFICATION DOCKET NO. 2002-50 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1391 FOR A USE BY RIGHT,AN ACCESSORY USE, OR A USE BY SPECIAL REVIEW IN THE COMMERCIAL ZONE DISTRICT (RETAIL SHOP SELLING TREES, SHRUBS, GRAIN, GARDEN DECOR, AND JEWELRY) IN THE A (AGRICULTURAL) ZONE DISTRICT - HOWARD AND VERONICA CANTRELL A public hearing was conducted on July 17, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair Commissioner David D. Long, Pro-Tern Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden - EXCUSED Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated June 28, 2002, and duly published July 3, 2002, in the Tri-Town Farmer and Miner and the Greeley Tribune, a public hearing was conducted to consider the request of Howard and Veronica Cantrell for a Site Specific Development Plan and Use by Special Review Permit#1391 fora Use by Right, an Accessory Use, or a Use by Special Review in the Commercial Zone District(retail shop selling trees,shrubs,grain,garden decor,and jewelry)in the A (Agricultural)Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chair Vaad advised Veronica Cantrell, applicant, that she has the option of continuing this matter to a date when the full board will be present. However, if she decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Masden will listen to the record and make the determining vote. Ms. Cantrell indicated she would like to proceed today. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman gave a brief description of the location of the 29.4-acre site and the surrounding uses. He stated the property is designated as"Not Prime"and "Other,"and it is not located in the flood plain. He further stated the applicant proposes to use an existing building located in the southwest portion of the site for the retail shop, with parking to the north and west. Mr. Gathman stated other improvements on the site include a single family dwelling,garage,machine shop,and corals. He stated there are two accesses, the residence does have a septic system, and patrons of the business will be allowed to use the restrooms in single family dwelling. He further stated the plat will also indicate an area designated for future restrooms if the operation is expanded in the future. 2002-1822 ft , Pt ,JLCfl) FCJ PL1613 HEARING CERTIFICATION - HOWARD AND VERONICA CANTRELL (USR #1391) PAGE 2 Mr.Gathman stated four referral agencies responded with comments,which have been addressed by the Conditions of Approval and Development Standards, and he also received two phone calls and a letter from a surrounding property owner supporting this request. He stated the site will be serviced with domestic water from the Central Weld County Water District. Don Carroll, Department of Public Works, stated the applicant has met all requirements of the Department of Public Works. In response to Commissioner Jerke, Mr. Carroll stated the site is accessed from Weld County Road 23, north of the"T" intersection at Weld County Road 24. He clarified that Weld County Road 24 does not extend to the east past Weld County Road 23, and the site is located several miles west of Highway 85. No public testimony was offered concerning this matter. In response to Chair Vaad, Ms. Cantrell stated she has reviewed and agrees with the Conditions of Approval and Development Standards. Commissioner Geile moved to approve the request of Howard and Veronica Cantrell for a Site Specific Development Plan and Use by Special Review Permit #1391 for a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial Zone District (retail shop selling trees, shrubs, grain, garden decor, and jewelry)in the A (Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Jerke, and it carried unanimously. There being no further discussion, the hearing was completed at 10:20 a.m. This Certification was approved on the 22nd day of July 2002.
