USE BY SPECIAL REVIEW QUESTIONNAIRE
The following questions are to be answered and submitted as part of the USR application.
If a question does not pertain to your use, please respond with"not applicable", with an
explanation as to why the question is not applicable.
1. Explain, in detail, the proposed use of the property.
I Propose to open a very small retail shop in which I would like to sell trees
and shrubs, grain, garden decor (pots, sculptures, etc.), and one of
a kind pieces of art (jewelry, paintings, pottery).
2. Explain how this proposal is consistent with the intent of the Weld
County Code, Chapter 22.
Because the intent is to have a very small shop (approximately 15 feet X 20 feet) with
a select cliental, I feel that this business will have little to no impact on the current
agricultural status of my property. Due to the structure of my private driveway, I
will be able to provide adequate parking thereby preventing any impact on traffic.
3. Explain how this proposal is consistent with the intent of the Weld
County Code, Chapter 23 and the zone district in which it is located.
The trees, shrubs, and grain which I intend to sell will be grown by local farmers
thereby supporting agriculture. The current agricultural status of my farm would
not change, because this site is not used to grow any type of crop.
4. What type of uses surrounds the site? Explain how the proposed use
is consistent and compatible with surrounding land uses.
The land surrounding the site (within 500 feet) is primarily agricultural and residential.
Three quarters of a mile from this site there is a commercial tree wholesaler who
trucks in trees, which are not grown on site. One mile from the site, the Kiyota
Green houses retail flowers and plants. Currently there is construction
underway 5 miles to the west of this site for a strip mall with many retail stores.
5. Describe in detail the following:
a. How many people will use this site?
I would estimate 0 - 10 people per day(the cliental would be very select)
b. How many employees are proposed to be employed at this site?
None - My husband and myself will run the shop.
c. What are the hours of operation?
10:00 am to 6:00 pm 7 days a week
d. What type and how many structures will be erected (built) on this
site?
None - the building is an existing structure. No new structures will be
erected.
e. What type and how many animals, if any will be on this site?
There are currently 5 horses, and 16 cows on the property. These animals are on the
opposite ends of the property and will not affect this site.
f. What kind (type, size, weight) of vehicles will access this site and
how often?
The largest vehicle that will access this site is a pick up truck with a flat bed to
deliver trees, shrubs, and grain. Private vehicles will deliver all artwork
g. Who will provide fire protection to the site?
Fort Lupton Fire Department
h. What is the water source on the property? (both domestic and
irrigation).
Central Weld Water district - domestic water
Irrigation water - Meadow Island Ditch#1 (Hewlutt Slugh), and private
laterals from the Lupton Bottom/Lupton Meadows Ditch.
i. What is the sewage disposal system on the property? (Existing and
proposed).
The restroom on site is on a septic system. Please see attached permit.
j. If storage or warehousing is proposed, what type of items will be
stored?
This will not be a warehouse. There may be 20 - 30 carks of grain at one time which
are pre packaged. The art pieces inside the shop (small number of paintings and
jewelry).
6. Explain the proposed landscaping for the site. The landscaping shall
be separately submitted as a landscape plan map as part of the
application submittal.
The landscaping is existing. The only additions would be to plant more flowers.
7. Explain any proposed reclamation procedures when termination of
the Use by Special Review activity occurs.
Non applicable - no reclamation will occur.
8. Explain how the storm water drainage will be handled on site.
Drainage flows to the Meadow Island Ditch and surrounding private lateral ditches.
9. Explain how long it will take to construct this site and when
construction and landscaping is scheduled to begin.
No construction or landscaping will take place, everything is existing.
10. Explain where storage and/or stockpile of wastes will occur on this
site.
Non applicable - no storage or stockpile of waste will occur.
