RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JOHN AND MARGARET MELIN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, John and Margaret Melin, VI #0200080, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of August, 2002, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, John Melin, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until September 13, 2002, to allow adequate time for the property owners to complete all final inspections. As requested, I visited the referenced project under construction on July 5, 1999, to make visual observations of the structure. Specifically, I was asked to observe the existing foundation to verify the size and depth of the "caissons", where the poles are buried in concrete filled holes. Observation holes were dug along the sides of the existing "caissons" and their depth measured. The distance from the pole to the edge of the 'caissons' was also measured to estimate the diameter of the "caissons". Based on my observations and measurements, it appears that the 'caissons" are a minimum of 48 inches deep from finished grade, 54 inches deep from finished floor, and a minimum of 16' diameter. I understand from our conversation that the poles are embedded in the concrete approximately 4 feet below finished floor. My observations were limited to the foundation as noted. No liability is accepted for the design of any portion of the structure nor any soil, grading, electrical or any architectural features.
