RE: DISCONTINUANCE OF PROCEEDINGS CONCERNING SHOW CAUSE HEARING
FOR SPECIAL USE PERMIT #443, AIRPORT HANGER AND SKYDIVING
SCHOOL - JAMES McDONALD
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a show cause hearing concerning Special Use Per-
mit #443, was held in the Chambers of the Board of County Com-
missioners on the 13th day of December, 1982, for the purpose
of considering revocation of said permit due to violations of
the Development Standards, and
WHEREAS, said violations are occurring on the following
described property, to-wit:
E1/2W1/2 SWa Section 25, Township 2 North,
Range 68 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, James McDonald, owner of said property, and Pete
Terry, lessee, were both present at said hearing, and
WHEREAS, amendments to the Deveolpment Standards were pre-
sented at the hearing by Mr. Terry, and
WHEREAS, after review of the amendments, the Board deems
it advisable to discontinue the proceedings of this show cause
hearing and have said amendments processed by the Department of
Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners that the proceedings of this show cause hearing shall
be discontinued and that the amendments to the Development
Standards be processed by the Department of Planning Services .

DEVELOPMENT STANDARDS

I . The permitted uses on the hereon described parcel shall be an airport and
parachuting operation and shall be limited to the facilities shown hereon
which are designed to handle a total of 12 planes and a maximum of 25
takeoffs and 25 landings per day and all other uses permitted by right in
the Agricultural Zone District of the Weld County Zoning Resolution.
2. The Special Use Permit area shall be maintained in such a manner so as
to prevent soil erosion, fugitive dust, and the growth of noxious weeds.
3. Separate toilets shall be installed for each sex at the rate of two for
the first 100 persons and one for each additional 100 persons or fraction
thereof. (6 CCR 1010-10) . Applicant shall be responsible for adhering to
the provisions of CRS 25-12-103 regarding noise emissions. All phases of
the operation shall comply with all County and State Health Standards re—
garding regulations pertaining to air quality, water quality, sanitary
disposal systems and building.
4. Two accesses for the airport shall be permitted. Said accesses shall be
clearly labeled on the property. All accesses shall have the approval of
the Weld County Engineering Department. All accesses shall be constructed
in accordance with the recommendations and/or requirements of the Weld
County Engineering Department.
5. The hangar shall be used strictly for the storage, maintenance, and repair
of aircraft. Maintenance and repair of aircraft shall be permitted only
between the hours of 8:00 a.m. and 8:00 p.m. for uses which create noise
and/or vibration noticeable at or beyond the property line. Commercial
repair of aircraft on the property is prohibited.
6. Hours of operation for the airport and the taking off and landing of planes
shall be from 8:00 a.m. until 8:00 p.m. or sunset, whichever occurs first.
7. Trash and refuse shall be removed from the property regularly. All trash
not removed shall be stored inside a building or an enclosed container to
prevent blowing of refuse onto surrounding properties.
8. A four foot high chain link fence shall be constructed along the entire
west side of the property. Except for two access points along the south
side of the property, the owner/operator shall maintain a ditch for traffic
control . The property owner(s) and/or operator(s) of the airstrip shall
be responsible for maintaining the fence in good repair and free from debris.
The fence shall be constructed within sixty (60) days of the date of approval
by the Weld County Board of County Commissioners.
9. A sign shall be posted on the property containing the limitations as to use,
including hours of operation, and number of takeoffs and landings permitted.
10. A gravelparki.ng area of sufficient size to park 100 vehicles shall be
located on the property. Other parking areas may be allocated for the
use of the operators of the planes in storage in the hangers. The parking
areas shall conform to the requirements of Section 5.2 of the Weld County Zoning
Development Standards

Resolution. No parking is allowed on Weld County Road 16. All traffic
shall be controlled within the confines of the property.
II . The building and fuel storage plans shall be reviewed by the Longmont Fire
Protection District for conformance with fire protection requirements.
12. A storage tank of sufficient size to hold 3500 gallons of water shall be
placed on the property to aid in fire protection of the property.
13. The Special Use Permit shall be limited to the plans shown hereon and
governed by the Development Standards stated above and all applicable
Weld County Regulations. Any material deviations from the plans and/or
Development Standards as shown or stated above shall require the approval
of an amendment to the Special Use Permit by the Planning Commission and
the Board of County Commissioners before such changes from the plans
and/or Development Standards shall be permitted. Any other changes from
the plans and/or Development Standards shall be filed in the office of
the Department of Planning Services.
14. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Development Standards. Non-
compliance with any of the above stated Development Standards may be
reason for revocation of the Special Use Permit the Board of County Com-
missioners.

It appears that wooden fence posts have been erected in preparation of a fence on the

A telephone conversation with Pete Terry on September 29, 1982, indicated making progress
in complying with the Development Standards.
Referenced Douglas Noe's letter regarding the fence. I explained the problem of the
original Special Use Permit boundaries. A possible amendment to the Special Use Permit
to include Noe's property is a solution.
I also discussed gravel requirements for the parking area. Trobule with packing chutes
on a gravel surface. Possible solution. Amend Development Standards.
Mr. Terry will submit a letter asking for a time extension so that an amendment to the
Special Use Permit can be applied for. (Thirty (30) days extension discussed.)
Mr. Terry also indicated two (2) toilets are on the property. Signs are being made.
The motorized hang gliders are all gone except for one. 0. \ de

INSPECTION REPORT

Date October 29. 1982 Time a.m.
Inspection of the property since I last visited the site indicated that fence posts
had been put in, but no fence had been erected. Two (2) portable toilets are
present on the property. Accesses to the property were not identified. No signs
were located on the property concerning the operation. No storage tank for water
was observed. Some construction was taking place on the existing 20' x 30' building
on the south end of the property. A blue trailer that had been attached to the north
side of the building had been moved away from the building to allow for the remodeling.
An adjacent property owner, Ed Herson, stopped me as I was leaving the property. He
indicated he objected to the fence being erected because it would prevent him from

Dear Mr. McDonald:
This is to inform you that the Weld County Board of County Commissioners
has scheduled a hearing to show cause why Special Use Permit #433:80:33
should not be revoked for noncompliance with the approved Development
Standards on Monday, November 22, 1982, at 9:00 a.m. This Special Use
Permit was approved by the Board on November 19, 1980, on property
described as the E' W1 SW4, Section 25, T2N, R68W of the 6th P.M. , Weld
County, Colorado. The staff will recommend that the Board revoke your
Special Use Permit.
This meeting will be held in the Board of County Commissioners' Hearing
Room located on the First Floor of the Weld County Centennial Center,
915 10th Street, Greeley, Colorado.
Your presence, or a representative, would be helpful to the Board should
they have any questions in considering the revocation of this permit.
This office is ready to be of any assistance in clarifying or answering
questions concerning this matter.

ISSUES WHICH STILL REMAIN TO BE RESOLVED
November 22, 1982
Development Standard #6 - Hours of Operation - 8:00 a.m. to 8:00 p.m. or
sunset. The applicant has exempted parachute activities from this require-
ment. It is the staff's opinion that parachute activities are not permitted
to occur after 8:00 p.m. or sunset.
Development Standard #8 - A Chainlink fence has not been constructed on
the west side of the property as required.
Development Standard #10 - Gravel parking area has not been constructed
as required. The applicant has addressed this in a letter dated October
4, 1982. An amendment to the Special Use Permit may be required.
Taxiing of aircraft to and from the runway is originating from property
or properties that are located on the west side of the airport propertyX
These parcels were not included in the original Special Use Permit area.
If this activity continues, the Special Use Permit should be amended.
