EVERETT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Mobile Home Permit No. 776 was granted to James E. Everett on September 7 , 1983 , subject to three conditions , and WHEREAS, one of the conditions was that said permit is to be reviewed annually, for a period of three years, by the Board to review the progress of the construction of the permanent dwelling unit to determine if construction is being diligently pursued, and WHEREAS, said review was conducted on October 24 , 1984 , and it was determined by the Board of County Commissioners that the applicant is in fact diligently pursuing the construction of the permanent dwelling, and WHEREAS , the Board further finds that Mobile Home Permit No. 776 , granted to James E. Everett, shall have its second annual review in 1985 . NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, finds that on the first annual review of Mobile Home Permit No. 776 , James E. Everett is complying with the conditions set forth in the Resolution granting said Permit. COLORADO Board of County Commissioners Weld County Centennial Center 915 Tenth Street Greeley, Colorado 80631 Re: Annual review of ZPMH-776 Dear Commissioners: On August 26, 1982, Mr. and Mrs. Everett applied for a Zoning Permit for a Mobile Home to be used temporarily during the construction of their permanent residence. At that time they applied for the building permit for their main residence as per Weld County Zoning Regulations (Weld County Zoning Ordinance 43.2.1.1) . The applicants submitted a letter in February of 1983, indicating that they were continuing to build their home and another letter in July of 1983, asking for an extension of time in order to comply with county regulations. Shortly after July of 1983, the Department of Planning Services staff determined that the applicants were not diligently pursuing the construc- tion of the permanent dwelling unit as per County Zoning Regulations (Weld County Zoning Ordinance 43.2.1.4) . At that tie, the taff dwelling frmed the applicants of their options as follows: apply for a principal zoning permit for a mobile or remove the mobile home from the subject site. On August 8, 1983, Mr. and Mrs. Everett applied for a Zoning Permit for a Mobile Home. As indicated in their letter submitted with the application and dated August 16, 1983, the applicants intended to build their permanent dwelling unit and remove their mobile l home when to the house was completed. Several surrounding property owners objected a zoning permit for a mobile home as a permanent dwelling on the subject site. One letter was submitted supporting the Everetts request for a zoning permit for a mobile home (ZPMH) as a permanent dwelling. k 2 / 27+ �� P i fi Board of County Commissioners Annual Review of ZPMH-776 October 23, 1984 Page 2 Based upon the submitted information, policies of the County and with neighborhood opposition in mind, the Department of Planning Services staff recommended approval of the request subject to several conditions. Condition Number One (1) stated ". . .The Board of County Commissioners setting a reasonable period of time that will allow the Everetts to construct their permanent dwelling unit. . ." The staff recommended this time period not exceed three (3) years. Condition Number Three (3) stated: "This permit shall be subject to review annually on the anniversary of the permit's issuance. The Board shall review the progress of the construction of the permanent dwelling unit to determine if construction is being diligently pursued. Failure to construct a permanent dwelling unit may be cause for revocation of the zoning permit for the mobile home." It was the opinion of the staff that the Everetts met the criteria for review of a Zoning Permit for a Mobile Home as a principal dwelling only because their intent was to construct a permanent dwelling unit. The staff recommendations for conditions set a reasonable time period in which to construct a permanent dwelling unit and a reasonable method in which to review the construction of the permanent dwelling unit to ensure that its construction was being diligently pursued. On September 7, 1983, the Board of County Commissioners approved a Zoning Permit for a Mobile Home to be used as a principal dwelling subject to the conditions set forth by the staff (please see the attached resolution) . In September of 1984, the Department of Planning Services staff informed the applicant that the anniversary of the permits issuance had come due and would be reviewed by the Board of County Commissioners to review the progress of the construction of the permanent dwelling unit and determine its construction was being diligently pursued. Since that time, the staff has received several requests from surrounding property owners that the remaining two (2) year extension for ZPMH-776 be withdrawn. On September 10, 1984, the Department of Planning Services staff inspected the subject site. The staff could find no visible evidence of construction of the permanent dwelling unit. Based upon the above conditions and the applicants failure to comply with those conditions, the Department of Planning Services recommends revocation of Mobile Home Zoning Permit #776 for James E. Everett. Board of County Commissioners Annual Review of ZPMR-776 October 23, 1984 Page 3 The Department of Planning Services staff would recommend that the Everetts be allowed until November 26, 1984, to remove the mobile home from the site. Further, that the Board of County Commissioners authorize the County Attorney to proceed with legal action against the Everetts, any other persons occupying the property, any persons claiming an interest to the property, or any persons acting in active concert with them if the mobile home is not removed on or before the foregoing date. Everett was previously granted a Zoning Permit for a Mobile Home to be used as a temporary dwelling during construction of a permanent residence, and WHEREAS , due to financial reasons the applicant has not been able to construct a permanent residence, and WHEREAS , James E. Everett has now submitted a request for a Zoning Permit for a Mobile Home to be used as a principal dwelling, and WHEREAS, the Board of County Commissioners of Weld County, Colorado did, on the 7th day of September, 1983 , consider the request of James E. Everett to place a mobile home to be used as a principal dwelling, and to be occupied in an A-Agricultural Zone District, on a parcel of land more particularly described as follows: Lot 5 , Block 2 , JoAnn Subdivision, Weld County, Colorado WHEREAS, the Board of County Commissioners , having heard the testimony, finds that said request should be granted sub- ject to the following conditions: 1. The applicant be allowed a period of three (3) years to construct the permanent dwelling unit; 2. This Mobile Home Zoning Permit shall not be transferable to any successors and interests to the Zoning Permit as a principal dwelling shall expire automatically upon conveyance or lease of the property; 3 . This permit shall be reviewed annually on the anniversary of the permit' s issuance. The Board shall review the progress of the construction of the permanent dwelling unit to determine if construction is being diligently pursued. That since the passing of the Resolution by the County Commissioners in September of 1983 , and for the fourteen month period prior to March of 1984, I have been unemployed, and have had no source of income . My unemployment was involuntary, and I was actively engaged on a full-time basis during the period between September of 1983 and March of 1984, in trying to seek employment. 3 . That due to my unemployment I was unable to secure any financing whatsoever to commence construction of a permanent resid- ence on the property . That as soon as was practical after my obtaining a job, in June of 1984, I made application to F .G.H. Federal Credit Union in Aurora, Colorado for a $35,000.00 Construction Loan, the proceeds to be used to construct a residence on the property. A copy of my application and of the "Statement of Refusal to Grant Loan" are attached to this Affidavit. My application was denied because of my having insufficient income to satisfy the debt ratio required by the lender. 5 . Since being denied for the loan , I have secured the commitment from my mother for $ 15,000 .00 to be used to start con- struction on our home . A true and correct copy of the letter evidencing that commitment is attached to this Affidavit. 6 . My wife and I still intend to construct the residence, and have done all things that we could to diligently pursue construct- ion.
