HomeMy WebLinkAbout20020565.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST TIMOTHY EHRLICH FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Timothy Ehrlich, VI #0100327, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of March, 2002, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Timothy Ehrlich, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until July 12, 2002, to allow adequate time for the property owner to obtain a Building Permit for the garage and fence. He wanted to know what his options were. I explained that our main issue was the debris and derelict vehicles. He went on to say that as soon as the house was finished he would be starting a shed,which is what he wants to keep his vehicles in. I told him that we needed to go before the Board and he would need to request an extension. I asked how long he thought before all of the violations were done. He said by May(90 days). I told him that we would support that request, but explained the consequences if it was not completed by that day. He said he understood. I told him that I would see him on the 12th. He asked for directions, which I provided. JUNK:Scrap brass, iron, lead,tin,zinc;all other scrap metals and alloys;bones; rags; used cloth, rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools, used appliances; used lumber or crates; building materials; fabrication of any material;used pipe or pipe fittings;used conduit or conduit fittings;used automobile parts;derelict vehicles;used tires and other manufactured goods that are so worn,deteriorated,or obsolete as to make them unusable in their existing condition. RECREATIONAL VEHICLE:A transportation structure or self-propelled vehicle with or without flexible,removable or collapsible walls and partitions designed to be used as a dwelling for travel,recreation or vacation uses. The term RECREATIONAL VEHICLE shall include: motor home, camper bus and travel trailer, but shall not include pickup trucks with camper shells that co not extend above the cab of the truck. For the purpose of this Code,a recreational vehicle shall be subject to all requiremens and restrictions for mobile homes as provided in this Chapter when its placement is intended for nontransient residency. A recreational vehicle shall not be used for temporary storage, temporary accessory farm use,temporary accessory use during a medical hardship, temporary accessory use as an office, or as a principle dwelling unit. TOGETHER WITH Well At March 6,2002 RE: VIOLATIONS Dear Bethany Salzman, There are several code violations that exist in our neighborhood. They are: 1. Ehrlich property located on 62' ' mile east of highway 37 on the north side of the road.. Ehrlick has junk equipment on the property along with 2 semi-trailers parked. He has lived in his RV since he started building his new house and there has been no authorization for him to live in his RV. The last inspection was at the end of January and no CO has been issued but he is living in his new house without it. The planners where out to inspect the house but no action has been taken to have the property be in compliance with the codes. 2. The Veltai property parcel number 0801-34-0-00-53 which is the old farmstead on the Howard property that was broken off in a 11.59 acre parcel in May 01. The old farm house is occupied by the owners and the shop has a tenant living in it and there also is a mobile home on the property with another family living in it. The planning department is aware of these violations but have done nothing about it. • 3. The Landwehr/Collins property parcel number 0801-34-0-00-054 located on 62% 'h mile east of highway 37 on the north side of the road. The owner lives in an RV while his house is being built, however the 6 months for temporary authorization to live in the RV is up. Little progress is being done on the new house. The foundation was out of the ground in November and nothing else has been done on the structure. The planners have done nothing to bring this property in compliance. 4. The Briggs property at 26622 62 '/2 has a barn built with a bathroom in the building. The owner lives in Wyoming. There is someone living in the barn in an RV. There are also several cars parked in the area along with a semi-tralier. This is not within the compliance of Weld county codes. What is frustrating with the above mentioned properties is that the ordinary citizen has to make a formal complaint to get the county commission to take action. We have invested in a planning department to ensure that property is within the codes set out by the Commissioners, yet these same planners overlook and do not take the necessary action to get these property owners in compliance. Why are we supporting this department with our tax dollars. Another important question is why are we supporting the commissioners who oversee this department. There are at least a dozen other properties that have been built in this area and these property owners have complied and have very nice properties. It is imperative that the commissioners instruct the planning department to take the necessary action to get the above mentioned property owners in compliance. This has been going on for almost a year now. Please uphold our property values by taking the appropriate action. EXHIBIT A 7 March 2002 Dear Ms. Salzman, This letter is a request that Weld County enforce its own laws/ordinances concerning the uses of real property located in areas zoned for agricultural use. This request specifically refers to two properties described below, both of which are located on WCR 62 %. The Ehrlich, parcel located east of and adjacent to the Blaine lateral, is the site of an automotive junkyard and has been for several months. In addition, there are two semi trailers which have been parked on this land for months. I also understand that people have been living for months in a camper trailer on this property. The Veltas property is located southeast of Gill (north of the Landwehr property which is adjacent to WCR 62 ' ) and has an occupied house trailer situated on the property. I also understand that there is an occupied camper trailer on this property. The planning and zoning office has been aware of these violations for months. Evidently they lack the authority to enforce county laws, which makes a mockery of our county.
