Our client, the "Weld County Road One Coalition", has an application filed with Weld County for inclusion within the I-25 MUD. The Weld County Road One Coalition is a group of Weld County Landowners that believe their needs are best served by the sanitation district and Weld County. The Coalition believes they are best served by the sanitation district for two reasons: 1) Coalition members are not planning to annex their individual or collective properties to Longmont at this time, and; 2) Coalition members have been told that Longmont cannot provide services with out a Longmont annexation. The Coalition has requested we submit the attached information to begin the formal discussions about inclusion within the sanitation district's service boundary. Future submittals will include: a) Preliminary design of interceptor sewer servicing the proposed parcels; b) Section 208 documents and application. Presently, the land for which the request is being made is not currently in the District's service area or the City of Longmont service area (please see Exhibit One). The Coalition is currently in the Weld County administrative process for amending the I-25 MUD. Individual landowners (members of the Coalition) are not planning to annex to the City of Longmont. Additionally, it is understood that Longmont is (legally) incapable of providing services to non-annexed land(s), particularly for the potentially large number of homes and businesses that could be constructed on the subject land. Information, herein, is presented to lay a foundation for further discussions regarding additional information the District needs to make an affirmative decision for including the request. Future information we will be providing the District includes a preliminary (schematic) design for a feasible way to service the area and "Section 208" documents. INCLUSION AREA Exhibit One highlights the requested area for inclusion. Generally, the area is in the northwest quarter section of section 6 and the western half of section 31. A sizable portion of the western half of section 3 I is already included in the District's services boundary. The area requested for inclusion is approximately 240 acres. Contiguity with the existing service boundary will be achieved along the eastern edge and the northeastern edge of the requested area. Exhibit Two shows the proposed land use as submitted to Weld County for amending the I-25 MUD. The proposed sanitary sewer improvements will service an estimated 539 single family homes, 15 acres of commercial development on about 366 acres (please see the "Property Owners and Land Use Table", in the appendix). DISTRICT FEES Development of the single family dwellings and commercial uses will provide the district with a large revenue stream. The revenue stream is broken-down into to parts: a) "front-end" development fees and charges; and, b) recurring revenue from monthly service charges. The fees and charges as outlined in the District's Rules and Regulations, November 2001, were used as a basis for developing the following summary tables. Please note that the 15 acre commercial development was converted to single family equivalents for compiling the figures presented. Also, is assumed that each commercial property will pay a monthly charge equivalent to the SFEs times the residential monthly charge because it is not known if commercial taps pay a higher rate. I 4 4 2 I I SUMMARY OF ANNUAL SERVICE CHARGES (2002 DOLLARS) ITEM FEE per SFE NUMBER of SFE's ESTIMATE of ANNUAL REVENUE Monthly Charge $22 743 $196,152 FLOW REQUIREMENTS The proposed 539 residential SFE's and Additional 15 acre commercial development (204 SFE's) have an estimated Average Daily Flow of 200,600 gpd (or 140 gpm). The Peak Hour Flow is 800,000 gpd (or 33,450 gph or 560 gpm). The stated figures use the District's flow figures as stated in the "Definitions" of the "Rules and Regulations". It is assumed that the District's 270 gpd and 1,080 gpd figures include an infiltration and illegal connection volume. PLANNED IMPROVEMENTS A new interceptor sewer from 12" to 8" will connect to the existing collection system at the intersection of County Road One and Highway 119. The interceptor will go north on County Road 3 and turn west along County Road 26 within the road right-of-way. Several options for crossing the Union Reservoir outfall ditch are being considered, including: a) an aerial crossing (either stand alone or hanging on the bridge); b) an inverted siphon; a straight gravity pipeline. The chosen option will be shown in the forthcoming preliminary design drawing. The interceptor termination point will be within the requested land for inclusion. The interceptor sewer line will be feed by a local 8" collection system. A small lift station may be needed to carry flow from the southern portion of the requested area to the interceptor. The lift station will be owned, operated and maintained by a Homeowners or Business owners Association, as needed. A preliminary design will be submitted in the near future. However, please see Exhibit Three for a schematic, plan view of the location of proposed improvements. The proposed interceptor will service an area greater than the requested inclusion area. Therefore, it should be noted that: 1) The fee and charges figures presented earlier in this document are only for the requested inclusion area, not the area services by the proposed interceptor. The fees and charges collected by the District would be much greater if a more comprehensive evaluation of one-time revenue and annual charges were evaluated. I 3 I 2) The Coalition is requesting that when the interceptor project moves forward that negotiations take place to discuss how the construction and engineering costs will be shared with the District and other tributary landowners. Concerns A letter from the St. Vrain Sanitation District to the Weld County Planning Department staff discussed a capacity issue. Presently, it is not know what is meant by this comment. After meeting with the District Staff and developing an understanding of the concern, a solution will be presented in the preliminary design. The Coalition understands the concern and is willing to contribute to a feasible solution. A second point is that the Coalition has been told that Longmont will not allow their interceptor line to be crossed with District collection system lines. The Coalition's view is that this is a strong stance taken by Longmont. Two potential solutions are the relocation of Longmont's interceptor or addressing the issue in a legal agreement that their line may only be crossed at a specific location(s). ESTIMATED COST OF PLANNED IMPROVEMENTS A reconnaissance level estimate of construction costs is presented below for the planned improvements. A more formal cost estimate will be prepared and presented with the preliminary design report. If the proposed inclusion property is provided service by the District then the District will benefit from an estimated $4.2 Million in onetime fees and charges. The estimated annual revenue, to the district after complete build out will be an estimated $200K. Reconnaissance level estimate shows $1.2 Million in planned sewer improvements. The figures presented in this report do not include fees, charges, or annual revenue for tributary land that will be "opened-up" along the proposed interceptor route. The amendment would extend the City's wastewater service area to include the properties north of Highway 119 and west of Union Reservoir. Recently, several development proposals west of Union Reservoir have been submitted to Weld County for review. Some of the properties are shown as being served by the St. Vrain Sanitation District, but most are not designated as being in any service area. Both the City of Longmont and the St. Vrain Sanitation District are possible service a.yencies for wastewater collection and treatment. Various water providers could serve portions of the area. However, there are compelling reasons for water and sewer to be provided by the City of Longmont. These include: 1. The geography around Union Reservoir allows the City to provide gravity sewer service to the entire area except for the extreme northeast corner. This portion of the area could be conveyed to the gravity system with a small lift station, if necessary. 2. The City's water and sewer infrastructure is readily available to the properties and has the capacity to serve them. The City constructed a large interceptor (Interceptor G) in the area several years ago. The location of the interceptor is shown on the enclosed map of the proposed service area. Gravity sewer service to this interceptor is possible for the properties to the west and north of Union Reservoir, as shown on the map. There is also a 12-inch water line in Weld County Line Road adjacent to the properties, and extensions of the City's existing water system are planned for the near future, as shown on the enclosed map. 3. Adequate treatment capacities are available in Longmont's water and wastewater systems to serve any development in the area. The City is constructing a wastewater plant expansion, scheduled to be complete in December 2002, which will increase the plant capacity to 17 MGD. The City is also planning to construct a new 30 MGD water treatment plant by 2006. Clearly, the expanded facilities will provide capacity for any projected development in the amended service area. 4. The City has majority ownership of Union Reservoir and has purchased land around the reservoir for a planned expansion. The limits of the expansion are shown on the enclosed map. The City is also purchasing open space around the reservoir. 5. Longmont already has a presence in the area, having annexed Sandstone Ranch to the south and the McLane Western and Concepts Direct parcels along the north side of Highway 119. 6. Amending the service area to include the properties to the north of the McClane- Western site would clear up the uncertainties regarding service providers. These properties are not currently shown as being in any service area. A modification of the service area in the Areawide Water Quality Management Plan would reduce conflicts between potential service providers and help the City plan for water and sewer service around Union Reservoir. Please note that the City is also in the process of completing an Intergovernmental Agreement with Weld County that addresses development review in the portions of Weld County that border the City. The requested service area amendment is in alignment with tic provisions of the IGA Longmont City Council passed a resolution supporting a request to amend the Water Quality Management Plan on April 28, 2002. A copy of the resolution is enclosed. A map of the requested service area amendment is also enclosed that shows the proposed service area boundaries, existing and planned utility lines and the expansion of Union Reservoir. This map and a letter explaining the City's intentions were sent to all property owners around Union Reservoir in May. The St. Vrain Sanitation District and Weld County were also sent copies of the letter. We request the NFRWQPA to begin the process of incorporating the revised service area into the Water Quality Management Plan. I believe we have the opportunity to come to agreement on the key issues as I understand them. I have prepared this letter as I noted I would in our meetings. We are prepared to provide you with a purchase contract with the following provisions. )- The City will need to acquire approximately 40 to 45 acres from your property for the enlargement of the reservoir. The amount of land to be acquired includes the area needed to construct a berm along the entire length of your property, as well as a 50-foot buffer and drainage channel. As a condition of negotiation, the City will agree to extend the berm north to and across your property at the City's cost in order to reduce the amount of your property needed for the enlargement of the reservoir. Final acreage will be set at the time the formal survey is completed and prior to closing on the acquisition. As we discussed, and at your request, City staff have completed the cross section survey of your property. The survey provides additional information in determining both the location and view of the berm. As we stated in the meetings in July, the City is not aware of any land use restriction relating to development adjacent to the future berm. We recommended contacting the State Engineers office and Weld County to inquire whether either of those entities has or is aware of any use restrictions. The City will offer to enter into a purchase contract for the property based upon the current fair market appraised value of the property. We have, as you agreed in our meeting, initiated an appraisal of your property. The City will pay the costs of the appraisal. We anticipate the appraisal will be completed in the next 60 to 90 days based on the workload of the appraiser. As it is understood that if you accept the offer outlined in this letter you may incur additional planning costs on the balance of your property, the City is willing to offer as additional compensation payment one half of these additional costs, up to a maximum of$2,000.00. Your development consultant will need to submit certified costs for our review before the City would pay this additional compensation. We understand at this point that you wish to receive service from the Longs Peak Water District. > While the City will continue to review and comment on your development application, we will agree to not aggressively oppose development on the balance of your property so long as the development plan is for large estate lots in the range of 40 to 45 single family homes that also provides for sewer service from the City and coordinated trail and transportation plans that allow for integration with the City and County efforts in these areas. Barker DATE: September 27, 2002 COLORADO SUBJECT: "Grandfathering" Concept for Development Applications Filed Prior to Effective Date of Weld County Code Ordinance 2002-7 On August 12, 2002, during the second reading of Weld County Code Ordinance 2002-7, the Board of County Commissioners asked if development applications filed prior to the effective date would be "grandfathered," meaning that such applicants would not be required to comply with the terms of Code Ordinance 2002-7. The answer generally is "yes;" however, the real questions are what constitutes an application for development that would be "grandfathered" and the date when the "grandfathering" occurs. One of Colorado's vested rights statutes addresses this issue. C.R.S. § 24-68-102.5(1) states the following: ". . . an application for approval of a site specific development plan as well as the approval, conditional approval, or denial of approval of the plan shall be governed only by the duly adopted laws and regulations in effect at the time the application is submitted to a local government. For purposes of this section, 'laws and regulations' includes any zoning law of general applicability adopted by a local government as well as any zoning or development regulations that have previously been adopted for the particular parcel described in the plan and that remain in effect at the time of the application for approval of the plan." (Emphasis added.) Weld County has defined a "site specific development plan" as a use by special review, planned unit development final plan, subdivision final plat, resubdivision or minor subdivision application that has been submitted and received final approval or conditional approval from the Board of County Commissioners. Code Section 23-8-20. All of these applications, except the P.U.D. final plan, are "submitted" for purpose of C.R.S. § 24-68-102.5(1) on the day they are officially filed with the Department of Planning Services. But Code Section 27-3-20 defines the P.U.D. process as starting with the application for "sketch plan." The sketch plan is reviewed administratively by Department staff and may be approved or, as with most such applications, sent back to the applicant with suggestions and requirements for resubmittal. So, the date the application for P.U.D. final plan is "submitted" dates all the way back to the date the application for the sketch plan is filed. The exception occurs when the applicant for the sketch plan resubmits the sketch plan with major changes, or resubmits more than a year after he or she receives the comments from Department staff about the sketch plan. Code Section 27-4-50. The applicant is responsible for providing evidence to the Department of Planning Services that a diligent effort is being made to meet standards and conditions outlined in sketch plan comments. The Department of Planning Services is responsible for determining whether a maior change exists, except that when more than a year has elapsed since the sketch plan comments, a resubmittal of a new sketch plan for the site may be required prior to submittal of an application for a Planned Unit Development zone change, and the "application," for purposes of compliance with Section 24-68-102.5, C.R.S., shall be the application for the amended sketch plan. I believe we have the opportunity to come to agreement on the key issues as I understand them. I have prepared this Letter as I noted I would in our meetings. We are prepared to provide you with an option to purchase contract with the following provisions. > The City will need to acquire approximately 20 to 25 acres from your property for the enlargement of the reservoir. The amount of land to be acquired includes the area needed to construct a berm along the entire length of your property, as well as a 50-foot buffer and drainage channel. The berm location has been shifted closer to the reservoir as we discussed in the meeting. Final acreage will be set at the time the formal survey is completed and prior to closing on the acquisition. As we discussed, and at your request. City staff have completed the cross section survey of your property. The survey will provide additional information in determining the location of the berm. As we stated in the meetings in July. the City is not aware of any land use restriction relating to development adjacent to the future berm. We recommended contacting the State Engineers office and Weld County to inquire whether either of those entities has or is aware of any use restrictions. > The City will agree. as you requested. to enter into an option to purchase contract for the property necessary for the construction of the enlarged reservoir. based upon the current fair market appraised value of the property. We have provided you with the appraisal completed in 2000 by McCarty and Associates and offered to update the appraisal to reflect current values. PARTIES. The parties to this Intergovernmental Agreement Regarding Sanitary Sewer Service ("Agreement") are the CITY OF LONGMONT, a Colorado municipal corporation ("City"); and the ST. VRAIN SANITATION DISTRICT, a Title 32 special district ("District"). 2. RECITALS AND PURPOSES. District is a sanitary sewer district which serves users in southwestern Weld County, including users in the vicinity of' Colorado Highway 119 extending west from the Del Camino area. City owns and operates its own sanitary sewer system, and has annexed certain properties lying east of Weld County Road 1. The parties desire to execute this Agreement, under the authority of Section 29-1-201, et seq., C.R.S., to address issues of mutual concern and to provide planning and sanitary sewer service to the area in a practical and economical manner. Accordingly, the parties agree to the following terms and conditions. 3. APPLICABILITY; SUBJECT AREA, The Agreement shall be applicable to that territory bounded by the following: on the north by Colorado Highway 66; on the east by a line marked by the existing tributary ditch (commonly referred to as the Docheff slough) which flows into Union Reservoir (also known as Calkins Lake) and by the outlet ditch from said reservoir which outlet flows into Spring Gulch, and continuing downstream along Spring Gulch to the St. Vrain Creek; on the south by St. Vrain Creek; and on the west by Weld County Road 1 (also known as County Line Road). For purposes of this Agreement, this territory shall be referred to as "Subject Area." The Subject Area is marked on the map which is attached as Exhibit A. 4. CITY AS SANITARY SEWER SERVICE PROVIDER WITHIN SUBJECT AREA. Regardless of annexation into the City of lands lying within the Subject Area, sanitary sewer service to users within such Subject Area shall be provided solely by the City. City shall be solely responsible for construction, installation and maintenance of all sewer lines and facilities within the area pursuant to its then current rules and regulations and policies. City may, at its sole discretion, service such properties with or without establishing annexation as a requirement to service. 5. DISTRICT AS SANITARY SEWER SERVICE PROVIDER TO EAST OF SUBJECT AREA. Regardless of future annexation into the City of any lands lying to the east of the Subject Area, sanitary sewer service to users to the east of the Subject Area shall be provided solely by the District. District shall be solely responsible for construction, installation and maintenance of all sewer lines and facilities within the area lying east of the Subject Area, pursuant to its then current rules and regulations and policies. In the event of annexation into the City of properties to the east of the Subject Area, the District shall remain the service provider for all purposes,including billing and maintenance. The parties agree to mutually cooperate and to take all official acts and resolutions necessary to request any amendments to their existing and approved regional 208 Clean Water Service Areas which amendments may be required as a result of the terms and conditions of this Agreement 7. MASTER PLANS. The parties mutually agree to exchange their respective sanitary sewer master plans for both the Subject Area and for the area lying generally along Colorado Highway 119 between I-25 and Weld County Road 1. The purpose of this exchange is to encourage cooperation and dialogue regarding possible issues of mutual concern, including the sizing and location of lines. 8. EXCLUSIONS. The City now owns, and may own in the future, certain properties lying within the District's current boundaries, and outside of the Subject Area, that may not require sanitary sewer service. City may,but is not required to, submit one or more petitions for exclusion of such properties and District agrees to timely process and grant such petitions for exclusions pursuant to Section 32-1-501, C.R.S. 9. ALTERNATIVE DISPUTE RESOLUTION. In the event of any dispute or claim arising under or related to this Agreement, the parties shall use their best efforts to settle such dispute or claim through good faith negotiations with each other. If such dispute or claim is not settled through negotiations within 30 days after the earliest date on which one party notifies the other party in writing of its desire to attempt to resolve such dispute or claim through negotiations, then the parties agree to attempt in good faith to settle such dispute or claim by mediation conducted under the auspices of the Judicial Arbiter Group (JAG) of Denver, Colorado or, if JAG is no longer in existence, or if the parties agree otherwise, then under the auspices of a recognized established mediation service within the State of Colorado. Such mediation shall be conducted within 60 days following either party's written request therefore, If such dispute or claim is not settled through mediation, then either party may initiate a civil action in the District Court for Weld County. 10. NOTICES. Any notice required or permitted by this Agreement shall be in writing and shall be deemed to have been sufficiently given for all purposes if sent by certified or registered mail, postage and fees prepaid, addressed to the party to whom such notice is intended to be given at the address set forth on the signature page below, or at such other address as has been previously furnished in writing to the other party or parties. Such notice shall be deemed to have been given when deposited in the U.S. Mail. 11. DELAYS. Any delays in,or failure of,performance by any party of his or its obligations under this Agreement shall be excused if such delays or failure are a result of acts of God, fires, floods, strikes, labor disputes, accidents, regulations or orders of civil or military authorities, shortages of labor or materials, or other causes, similar or dissimilar, which are beyond the control of such party. 12. PARAGRAPH CAPTIONS. This Agreement may be amended only by an instrument in writing signed by the parties. 15. WAIVER OF BREACH. The waiver by any party to this Agreement of a breach of any term or provision of this Agreement shall not operate or be construed as a waiver of any subsequent breach by any party. 16. BINDING EFFECT; NO THIRD PARTY BENEFICIARY. This Agreement shall inure to the benefit ofy and be binding upon,the parties,and their respective legal representatives, successors, and assigns. Except as expressly provided for in this Agreement, the parties, by entering into this Agreement, do not intend to grant or confer any rights or benefits to or upon any third patty. Applicants for service by either party must comply with all of the then current rules, regulations, ordinances, or other conditions of service which may be established by the parties. 17. COOPERATION. The City and the District agree to continue the cooperative exchange of information, operational assistance and emergency aid. 18. TERM. In recognition of the cost of capital construction for collection system, trunk line, conveyance, and treatment facilities and the critical importance of routing for a gravity sewer system, the term of this Agreement shall remain in full force for a period of fifteen (15) years from the date set forth above, at which time it shall be reviewed. City and the District agree that not less than one hundred twenty(120) days prior to the expiration of this Agreement, both parties shall jointly review the Agreement for the purpose of considering the advisability of extending, altering, or modifying this Agreement. 19. ENFORCEABILITY. The parties to this Agreement recognize that there are legal constraints imposed upon the City and the District by the Constitution, statutes and laws of the State of Colorado and the United States and that, subject to such restraints, the parties intend to carry out the terms and conditions of this Agreement. Notwithstanding any other provision of this Agreement to the contrary, in no event shall any of the parties exercise an powers or undertake any actions which shall be prohibited by applicable law. The property owners located on the east side of Weld County Road # 1, known as the WCR #1 Coalition, are in the process of negotiations with the City of Longmont in an attempt to work with the city in resolving outstanding issues. It is the concerns of the WCR#1 Coalition that by giving the City of Longmont governmental powers with the approval of the IGA over the land owners property is premature at this time, since the property owners are in negotiations with the City of Longmont pertaining to the purchase of there property. This will allow the City of Longmont the governing powers to dictate and facilitate there own agenda without the opportunity for the owners to further pursue the processing of the proposed subdivisions that are currently in progress within the Land Planning process for Weld County if agreements cannot be obtained. The additional fact is that since our last meeting with the City of Longmont Staff on August 30th, 2002, several issues are still unanswered and we feel that it is necessary to have resolution to those specific issues prior to accepting the terms and additional controlling layers of government that the IGA proposes. Some of our property owners have been present at public hearings at the City of Longmont council meetings and have been approached by some of the Longmont City Council members who have made the point to the property owners their desire to meet sanak with the owners to work on a common resolution. In addition to the above request we have requested that if the City was in fact working in good faith with the owners, that the city of Longmont work in a timely fashion to resolve the outstanding issues of sewer, annexation, support for the proposed projects in place, coordination with city staff to address concerns of regional master planning, sanitary sewer services (208 application) and the ability to reach a common agreement as neighbors to the community. The city of Longmont has presented the desire to purchase properties for increasing the size of Union Reservoir. However, the price to purchase of this real-estate and the reimbursement for redesign of the existing plans for each development already in the Weld county land use process, have not been addressed. An IGA agreement approval at this time allows governing powers to the City of Longmont over this region. For example, the city of Longmont may require the properties located in Weld County make application for annexation, if accepted by the City of Longmont, then the property owners will have to comply with the city of Longmont or forever be stuck in the land use processing for the City of Longmont until such time as they choose to comply with the standards. It is not uncommon for city governments to require development of properties during annexations to require such items as additional right of way, easements and in this situation dedication to the city of Longmont the lands they require for the increased size of Union Reservoir with complete disregard for the current land and improved development as proposed in the Weld county planning application that are pending in process. Without an agreement between the property owners and the City of Longmont for the above listed items, there is concern that the potential for legal action may be taken against Weld County, the City of Longmont and Union Reservoir for the taking of properties with additional governmental actions that will impede the ability to currently improve upon there land within the standards and guidelines of the Weld County Land Use Code. The property owners are adamant about this IGA being premature until such items are resolved. The owners have held off the final negotiations with the Saint Vrain Sewer District, it's 208 application, and tabled the planning process for the approvals of the current MUD & PUD applications currently in place to work with the City of Longmont in a neighborly effort to come to a resolution. The Coalition requests that the NFRWQPA member entities take a neutral position, regarding the service boundary modification until such time that the following points are resolved or otherwise addressed. Points to be ljesolved or Addressed 1) Individual Coalition landowners do not presently know their future plan for each of their respective parcels. Presently, several of the Coalition's landowners are negotiating with Longmont about providing services. Other landowners are considering non-development or development within Weld County. 2) Of the 'landowners that are negotiating with l.ongtrlont and those discussions are on going. Specifically, the City of Longmont wants land ownership for the proposed expansion of Union Reservoir and the landowners are asking for utility services are part of the agreement. However, it appears that Longmont has taken a"go-slow" approach to negotiating with landowners to see if the landowners will acquiesce and give in to all of Longmont's demands. Longmont has not been forthright in their negotiations with the landowners. The Coalition believes that Longmont's ploy of requesting a service boundary expansion is a property taking by not allowing each property owner full and free use of their property, and because the property is not within the political boundary of Longmont. Furthermore, it is believed that Longmont is attempting to gerrymander a quasi-political FROM : EDRC FAX NO. : 3030736604 Sep. 26 2002 11:31AM P2 • boundary in an attempt to force Coalition landowners into a decision making process that would not otherwise happen if'Longmont would openly negotiate agreement terms. 3) For many months individual landowners have asked Longmont for a proposal for utility services. That proposal has not been forthcoming. Therefore,these landowners too might he forced to develop in the county. 'Therefore,it is the Coalition's belief that it is premature for Longmont to assume they will he providing services to the requested expansion. 4) Presently, Longmont has no annexation agreement settled with Weld County. It is our understanding that annexation is to be addressed in a future inter-government agreement. The inter-governmental agreement between Longmont and Weld County is at a standstill, Also, Longmont has no codified policy to provide services to lands outside the city boundary. Since it appears that annexation is not possible(due to non-movement on the 1GA) and Longmont cannot presently provide services,it is premature to request a service boundary modification. 5) If some Coalition landowners chose to develop in the county it appears that they will either be proposing densities low enough for on-site treatment(leach fields) or will be requesting services from St Vrain Sanitation District. Either of these options will provide a more cumbersome service boundary between the city and the sanitation district. Therefore, it is unclear where the boundary will bo and how each entity will be servicing their respective parcels. More to the point, it is unclear how Longmont will construct a collection system and service it when it passes through non-annexed county land. 6) The some Coalition landowners are presently working toward u service boundary change with SVSD because individual landowners believe development in the county is in their best interest. With another proposal pending that is expected serve the subject property it is again, premature to decide on the Longmont proposal. 7) As stated earlier,there are other options of providing wastewater treatment to the region of Longmont's proposed service boundary change. It is not clear that Longmont's proposal is the most economical per gallon treated or most economical for each user, considering the cost of plant expansion fees, tap fees, etc. Again,the Coalition believes that members of the NFRWQPA do not have complete information and that it is premature to assess the quality ol'Longmont's proposal. Again,the Coalition requests an opportunity to continue their discussions with Longmont and SVSD and ask the NFRWQPA to take no action at this time. Also, representatives of the Coalition are requesting the opportunity to address the Board and respond to questions raised at the meeting or raised in this letter. PARTIES. The parties to this Intergovernmental Agreement Regarding Sanitary Sewer Service ("_ eement") are the CITY OF LONGIVIONT, a Colorado m»nicipal corporation ("City"); and the ST. STRAIN SANITATION DISTRICT, a Title 32 , special district ("District"). 2. RECITALS AN'D PURPOSES- ; District is a sanitary sewer district which serves users in southwestern Weld County, including users in the vicinity of Colorado Highway 119 extending west from the Del Camino area. City owns and operates its own sanitary sewer system, and has annexed certain properties lying east of Weld County Road I. The parties desire to execute this Agreement, under the authority of Section 29-1.201, et seq., C.R.S., to address issues of mutual concern and to provide planning and sanitary sewer service to the area in a practical and economical manner; Accordingly, the parties agree to the following terms and conditions. . 3. APPLICABILITY; SUBJECT AREA. The Agreement shall be applicable to that territory bounded by the following: on the north by Colorado Highway: 66; on the east by the north-south center line of Section 30, T3N, R68W to the existing high water line of Union Reservoir (also known as Calkins Lake) and by the outlet ditch from said resertoir which outlet flows into Spring Gulch, and continuing downstream along Spring Crutch to the St. Vain Creek; on the south by St Vrain Creek; and on the west by Weld County Road I (also known as County Line Road), and including the City owned Sandstone Ranch property, For purposes of this Agreement, this territory shall be referred to as "Subject Area." The Subject Area is marked on the map which is attached as Exhibit A. 4, CITY AS SASIIT RY SEWER SERVICE PROVIDER WITHIN SUBJECT AREA. Only the City may provide sanitary sewer service to users within the Subject Area. regardless of whether or not such lands are annexed into the City. City shall be solely responsible for construction, installation and maintenance of all sewer lines and facilities within the area pursuant to its then current rules and regulations and policies. City may. at its sole discretion, service such properties with or without establishing annexation as a requirement to service. 5. DISTRICT AS SANITARY SEWER SERVICE PROVIDER TO EAST OF SUBJECT AREA. Regardless of future annexation into the City of any landslying to the east of the Subject Area, sanitary sewer service to users to the east of the Subject Area shall be provided solely by the District, District shall be solely responsible for construction, installation and mai tenance of all sewer lines and facilities within the area lying east of the Subject Area, pursuant to its then current rules and regulations and policies. In the event Of annexation into the City of properties to the east of the Subject Area, the District shall remain the service provider for all purposes, including billing and maintenance. 6. AMENDMENT OF 208 CLEAN WATER SERVICE AREAS. The parties agree to mutually cooperate and to take all official acts and resolutions necessary to request any amendments to their existing and approved service areas contained in any areawide water quality management plan ("208 plan"), which amendments may be required as a result of the terms and conditions of this Agreement. 7. MASTER PLANS. The parties mutually agree to exchange their respective sanitary sewer master plans for both the Subject Area and for the area lying generally along Colorado Highway 119 between 1-25 and Weld County Road 1. The purpose of this exchange is to encourage cooperation and dialogue regarding possible issues of mutual concern, including the sizing and location of lines. S. EXCLUSIONS. The City now owns, and may own in the future;..certain properties lying within the District's current boundaries, and outside of the Subject Area, that may or may not require sanitary sewer service. City may,but is not required to, submit one or more petitions. for exclusion of such properties and District agrees.to timely process and grant such petitions for exclusions pursuant to Section 324-501, C.R.S. 9. EXISTLNG CITY OWNW PROPERTY. Notwithstanding any other provision of this Agreement, the city reserves the right to, and in its sole discretion may, provide sanitary sewer service to any property now or hereafter owned by the City that is east of the Subject. Property and not currently served by the District. Sanitary sewer service to all,non-City owned propeny east of the Subject Area shall be governed by paragraph 5 of this Agreement. 10. CITY WATER RIGID. City owns certain water rights that are fully consumable which may be utilized in areas that receive sanitary sewer service,from the District. District agrees and acknowledges the City's dominion and control of said water tights and any reuse thereat 11. ALTERNATIVE DISPUTE RESOLUTION. In the event,of any dispute or claim arising under or related to this Agreement, the parties shall use their best efforts to settle such dispute or claim through good faith negotiations with each other. If such dispute or claim is not settled through negotiations within 30 days after the earliest date on which one party notifies the other party in writing of its desire to attempt to resolve such dispute or claim through negotiations, then the parties agree to attempt in good faith to settle such dispute or claim by mediation conducted under the auspices of the Judicial Arbiter Group (JAG) of Deaver, Colorado or, if JAG is no longer in existence, or if the parties agree otherwise, then under the auspices of recognized established mediation service within the State of Colorado. Such mediation shall be conducted within 60 days following either party's written request therefore. If such dispute or claim is not settled through mediation, then either party may initiate a civil action in the District Court for Weld County.; 12. NOTICES. ADDITIONAL DOCUMENTS OR ACTION. The City and the District agree to continue the cooperative exchange of information, operational assistance:and emergency aid. 20. TERM. In recognition of the cost of capital. construction.for' collection system, trunk Iine, conveyance, and treatment facilities and the critical importance: of routing for a gravity sewer system, the term of this Agreement shall remainin full force for a period of fifteen (1.5) years from the date set forth above, at which time it shall be reviewed. FINANCIAL OBLIGATIONS OF CITY, All City's financial obligations under this Agreement are contingent upon appropriation, budgeting, and availability of specific funds to discharge those obligations. Nothing in this Agreement constitutes a debt, a direct or indirect. multiple fiscal year financial obligation, a pledge of the City's credit, or a payment guarantee by the City to the District. 23. GOVERNING LAW. Any tribunal enforcing this Contract shall apply and construe it according to the laws of the State of Colorado. 24. AUTHORITY. The parties warrant that they have taken all actions necessary or required by their own procedures, bylaws, or applicable law, to authorize their respective signatories to sign this Agreement for them and to bind them to its terms. October 11, 2002 Mr. David Dubois, Manager North Front Range Water Quality Planning Association Civic Center 500 East Third Street Loveland, Colorado 80537 Re: Longmont Application to amend the areawide water quality management plan Dear Dave: This letter is in response to a letter dated September 26, 2002 sent to you by Mr. Craig Houdeshell on behalf of his clients. In his letter Mr. Houdeshell makes several inaccurate statements, that I believe deserve to be corrected. The City of Longmont respectfully submits the following responses. I am not aware of any contact from Mr. Houdeshell with any Longmont staff members concerning the status of the discussions with property owners, or the City's policies and procedures for providing sewer service. It must be made clear that the City has made no "demands" of the property owners, and has in fact provided information as requested as well as having several meetings with the property owners—none of which were attended by Mr. Houdshell. The City provided a written response to the property owners dated August 2, 2002 that detailed the City's proposal concerning the provision of sanitary sewer service, and acquisition of a portion of their property at fair market value for the expansion of Union Reservoir. A copy of that letter is enclosed. Discussions are on going with property owners at this time. Longmont and Weld County have been working for the past several years to develop a cooperative planning agreement. The Longmont City Council approved that agreement in February of this year. Weld County has approved the agreement on its first and second readings, and set the agreement for its third and final reading on October 21, 2002. As noted in our August 2 letter, and at the request of the property owners, the City has agreed to delay the requirement to annex their properties as a condition of receiving sewer service for up to 10 years from the execution of an agreement with the property owners. I have also attached a copy of Section 11.1 of the Longmont Municipal Charter that expressly allows the City to provide municipal services within or without the corporate limits of the City, provided any agreements or contracts arising there from would clearly benefit the inhabitants of the City. The City of Longmont currently provides water service to many of the properties outside of City limits in Weld County. The City also currently provides sewer service to several properties outside the City. The City's ability to extend utility lines is not dependant upon whether or not the properties crossed are annexed to the City. In fact, the City's existing Sewer Interceptor G that will provide service to properties west of Union Reservoir crosses through properties that are not annexed. As an engineer in the State of Colorado working in the land development arena, we are surprised that Mr. Houdshell is not clear on this matter. The City of Longmont is not aware of any pending proposal from the St. Vrain Sanitation District to serve properties in the area. In fact, enclosed is an executed Intergovernmental Agreement between the City of Longmont and the St. Vrain Sanitation District in which the parties agree that the City will be the sanitary sewer service provider to properties located generally west of the Union Reservoir, and detailed as the Subject Property on Exhibit A of the agreement. This cooperative effort with the St. Vrain District has proven to be effective in finalizing the boundary between our respective service areas. In our discussions with St. Vrain staff, we also realized that it will be beneficial to extend the southern boundary of the City's service area to the St. Vrain Creek given the City's existing facilities to provide service, and ownership of land to the south of the St. Vrain Creek. The reason for the boundary amendment is expressed in the IGA as well as the City's requested amendment to the 208 plan; namely that the City has facilities in place with adequate capacity to provide gravity sewer service to the properties located west of the natural Union Reservoir drainage basin. The City also has a significant interest in the area with existing annexed properties, City owned properties, and significant ownership interest in the Union Reservoir Company. The District would need a lift station to cross the Union drainage basin as well as construct several thousand feet of new offsite sewer line. Finally we believe Longmont's system development fees and rates are very competitive with the St. Vrain Sanitation District. Longmont's current system development fee for a standard residential connection is $3,000. Our monthly rates for service include a monthly minimum charge of$6.75 with a monthly volume charge of$2.10 per 1,000 gallons. Rates and fees are the same regardless of whether or not the property is annexed into the City. Clearly, the City of Longmont has the infrastructure and ability to provide excellent sanitary sewer service to the area as expressed in our request to amend the 208 boundaries as well as the IGA with the St. Vrain Sanitation District. We respectively request the approval of the North Front Range Water Quality Planning Association Board of our application to amend the areawide water quality management plan.
