HomeMy WebLinkAbout20023199.tiff 720 RESOLUTION RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR AVERY ACRES PLANNED UNIT DEVELOPMENT FINAL PLAN #496 -JOHN AND JAMES SUTTER, DBA AVERY FARMS, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated December 8, 1999, the Board did approve the application of John and James Sutter, 800 Hawkstone Drive, #27, Eaton, Colorado 80615, for a Planned Unit Development (PUD) Final Plan, S #496, for five (5) Estate lots and one A (Agricultural) outlot, on the following described real estate, to wit: Lot B of Recorded Exemption #1683; being part of the W1/2W1/2 and NE1/4SW1/4 of Section 10, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on May 1, 2000, the Board of County Commissioner of Weld County, Colorado, did approve an Improvements Agreement According to Policy Regarding Collateral for Improvements (Publicly Maintained Roads) for Avery Acres Planned Unit Development, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and John and James Sutter, with terms and conditions being as stated in said agreement, and accept Irrevocable Letter of Credit Number 587, drawn on the Union Colony Bank, in the amount of$55,000.00, and WHEREAS, staff from the Weld County Department of Public Works has conducted a visual inspection and recommends release of said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Irrevocable Letter of Credit Number 587, drawn on the Union Colony Bank, in the amount of$55,000.00 be, and hereby is, canceled and released. I have verified all the transportation items identified on Exhibit A on the Improvements Agreement. All items are complete to my satisfaction. Non-transportation items such as landscaping, trees, telephone, electric, and water taps appear to be in place.
