The following explanations refer to the questions listed on the USR Questionnaire:
1. The property at 5264 WCR 16 3/4, Longmont, CO is to be used as a helicopter
landing facility. The helicopter is used for pipeline/power line patrol in 12
states including Colorado. Local power and gas companies utilize the
helicopter services for emergency locates which are often necessary after
blinards, high winds, and violent storms. Security of these lines has also
become an issue. Several local law enforcement agencies utilize the
helicopter for emergencies as well(i.e. air support back up, fires, surveys).
The close proximity of this FAA designated private (not public) use heliport
to the companies and agencies supported by this helicopter service along the
Front Range of Colorado increases response time during emergencies.
Therefore, a special use permit is requested. (See attached letters of
recommendation.)
2. This proposal is consistent with the intent of the Weld County Code, Chapter
22. Please refer to Section 22-3-170, E. The Federal Aviation Administration
conducted an airspace analysis of the proposed heliport and has no objection
to it based on its determination with respect to the safe and efficient use of
airspace by aircraft and with respect to the safety of persons and property on
the ground. The Rhoads Private Use Heliport has been given the FAA
Designator—CO 57.
3. This proposal is consistent with the intent of the Weld County Code, Chapter
23 and the zone district in which it is located. Please refer to Article III Zone
Districts, Section 23-3-40, Uses By Special Review, F (Airports & Airstrips)
4. The site is set off to the back eastern edge of the property. This backs up to a
strip of right of way and vacant land which is zoned industrial. The property
to the south is zoned agricultural and the lone residence for that property is
located %] mile on the west end. The property to the north is residential and a
canal edges the northeast corner of the property.
5. a. The site will be used by the property owners. On occasion, a single
individual will park in the drive near the farm building. Usually, the
observers for the utility companies are picked up at previously designated
sites. However, the observer may be driving in from out-of-state and is
permitted to park in our driveway.
b. No other employees besides the owners will be employed at this site.
c. We operate on a 24 hour emergency on-call basis.
d. Not applicable.
e. Not applicable. Animals near the site are for personal use only.
f. The vehicles that will access the site on rare occasions could include
standard cars and/or pickup trucks.
g. Fire protection is provided by the Mountain View Fire Station located on
WCR 13 and WCR 20.
h. The water source on the property is Central Weld County Water District.
A restroom will be available in the home located on the same property.
i. The sewage disposal system on the property is a septic system. Permit
#920234
j. Storage or warehousing is not proposed.
6. Current landscaping consists of pasture grass, which is kept mowed during the
growing season.
7. Not applicable.
8. Storm water drainage is handled by gravel slopes.
9. Not applicable. No changes requiring construction and landscaping are
necessary.

I am the owner of Falcon Helicopters, Inc., a corporation for 18 years and in good
standing with the state of Colorado. We are a small company with three employees. Our
service has been to provide professional helicopter service to Colorado and the
surrounding states. Over the years we have become more specialized and have focused
on providing aerial support to the utility companies. Our customers include AT&T, KN
Energy, Inc., Tri State Generation and Transmission, Phillips Pipeline Co., HS Gas
Gathering,North American Resources, and Kinder Morgan, Inc. We also provide law
enforcement aerial support to the Denver Police Department, Boulder County Sheriff's
Department and helicopter service to the Rocky Mountain News and The Denver Post.
In 1992 my wife, Gina Rhoads, and I bought the 15.6-acre parcel of land at 5264
Weld County Road 16%, with the intention of building our home and having a small
farm. This has been quite an undertaking as we have done all the work ourselves and has
taken longer than expected. Due to the changing nature of our helicopter service,
providing immediate response capabilities has become a priority. With the winter
weather in this area and the effects it has on power lines, I get called out to help locate
problems, which in turn helps restore power sooner. We have been providing this service
for many years, but many times it has taken hours, during heavy snowstorms, to just get
to the Longmont airport where we keep a helicopter. Our goal in establishing a private
use heliport on our land is to have a helicopter ready to go on a minute's notice. This
also helps our law enforcement customers like the Denver Police for whom we have
provided backup and additional helicopter support for many years.
When considering this application for a special use permit, please keep in mind
that we have applied and received approval from the FAA. This is an airspace approval
and covers all operations regarding flight, from the surface up, including approaches and
departures to and from the proposed heliport area. The application for a special use
permit is a land use issue. We ask that you address the land use issue separately because
airspace usage is federally controlled and therefore, not applicable in this circumstance.

It has come to the attention of the Department of Planning Services'staff that the uses on your property may not
be in compliance with the Weld County Zoning Ordinance. The potential noncompliance with the Zoning
Ordinance is a"Commercial"business operation consisting of a"helicopter training facility." I do not show any
permits issued by the County allowing a helicopter to be operated from your property. This type of use would
require a Use by Special Review "USR" permit. Since you are in the "Urban Growth Boundary" of Frederick,
the County will not even accept a USR application until the enclosed form has been completed by the City of
Frederick. Therefore, please take the enclosed form to the City of Frederick so that it can be completed.

Additionally, several other isysues have arisen. First,the temporary permit allowing the mobile home(originally
permitted as a "temporary during construction" ZPMH-1943) expired in 1996. The mobile home is now
considered a direct violation of the Weld County Zoning Ordinance. Secondly,the building permit(BP-41695)
for the residence has been expired. Since the house has not yet received its final, no one should be residing in
the structure. This aspect is being considered as a direct violation of the Weld County Building Ordinance.
Lastly, the Department of Environmental Health will be in contact with you regarding your septic permit.
Please contact me within five working days of the date of this letter to review these concerns with me or a thirty-
day violation notice will be issued. Feel free to contact me at the above address, telephone number or e-mail

Thank you for contacting us about your concerns regarding the operation of a commercial
business on our property. We have operated Falcon Helicopters, Inc. out of the
Longmont Executive Hangar#5, Vance Brand Airport, Longmont, CO, since July, 1984.
We also have a home office and conduct a lot of accounting and telephone business from
that office. We are in good standing with the Weld County Assessor's Office concerning
Personal Property Tax on any business items located in our home.

We have considered moving our operation to our Weld County property in the distant
future and thank you for the USR application. We may start the application process with
the City of Frederick soon; however, our spring contract work starts next month, then
most personnel and aircraft will be operating out of state for the next 6 months.
The small sign on our entrance fence is for the necessary benefit of lost UPS, Federal
Express, and other delivery people.

Since the reestablishment of the Denver Police Department Air Support Unit in 1998, Falcon
Helicopter has been called on to provide backup helicopter service Falcon Helicopter is
equipped with searchlights and radio support equipment used by law enforcement.
In the event of an emergency, immediate reponse is critical to all law enforcement agencies along
the Front Range. The capability to respond promptly with a helicopter in the air just minutes from
north of Denver would be a benefit to any agency. Another benefit of having a heliport closer to
the metro area would be a saving of time if the mission required a refueling or a change of crew.

When the heliport becomes operational, please complete and return the enclosed FAA Form
5010-5, Airport Master Record. If the heliport does not become operational within 12 months of
the date of this letter, this airspace determination will expire unless you request a time extension.
If in the future you wish to open the heliport to public use, a new airspace determination will be
required. In addition, if the airport changes names, changes ownership, if there is a change in the
owner's address or other substantial changes, please notify the FAA, NFDC on Form 5O1O-5. If
the FAA solicits information on the heliport without response, it may be considered inactive.

Hello
