COLORADO Weld County Public Works has reviewed this proposal;this project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 28 is designated on the Southwest Study Area Capacity Improvement Needs as a local gravel road, which requires 60-feet of right-of-way at full build out. There is presently 60-feet of right-of-way. This road is maintained by Weld County. Pursuant to the definition of set-back in the Weld County Code,Chapter 23,Article III,Section 23-3-50,the required set-back is measured from the future right-of-way line. WCR 19 is designated on the Southwest Study Area Capacity Improvement Needs as a collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: Traffic Counts: The average daily traffic (ADT) count for WCR 28 is 157 vehicles, taken in a 24 hour period on March 30,1999. WCR 19 has an ADT count of 1711 vehicles, taken October 7, 1999. The ADT for State Highway (SH) 66 at WCR 19 reflects 4850 vehicles, taken in 1995. ,/Future Right-of-way: The applicant should reserve an additional ten feet of property parallel to WCR 19 right-of-way for future build out. Setbacks: Setbacks to a mining operation are measured from future right-of-way lines plus the standard setback of 20 feet in an agricultural zone to the edge of the gravel pit berms, which is considered a structure. Traffic Impact Study: All new residential developments with expected ADT > 200 and all new commercial developments will be required to submit a traffic study as part of the review process. This study shall include a description of the project, vehicle trip generation and distribution, verification of adequate acceleration, deceleration, and storage facilities at all impacted intersections, review of bridge capacity, intersection level-of-service analysis for existing and proposed conditions,and recommendation for needed upgrades to transportation infrastructure to support the development. Page 2 USR-1343 Weld County Public Works Department will review your submitted traffic study. The traffic study needs to be submitted no later than 2 weeks prior to scheduling with the Planning Commission to allow our traffic engineer time to review and comment. Improvements Agreement: The applicant shall enter into a Road Maintenance and Improvements Agreement with the Weld County Public Works Department for the upgrading and paving or maintenance of Weld County roads which are associated with the pit and any additional intersection improvements associated with heavy hauling that may be identified in the traffic study. Intersection Study: The applicant is indicating on the plat that the access from the mining operation will be on to WCR 28, which is a local gravel road. Approximately 500-600 feet south of the intersection of WCR 28 and WCR 19 is a hill, creating a sight distance problem. The applicant shall include in the traffic study that the line of sight to the south is adequate to utilize this intersection for heavy hauling. Utilize the AASHTO (Green Book)"Sight Distance at Intersections" to verify that this is a safe condition. If this intersection is not verified to be a safe turning condition through the traffic study, Weld County Public Works would recommend relocating the main access to the gravel operation on to WCR 19 or SH 66. Storm Water Drainage: The applicant is indicating that the storm water drainage will be contained on site by routing into natural drainage points. Any discharge points shall be identified on the plat. This portion of the permit falls under the jurisdiction of the State of Colorado/DMG. At WCR 28,south of the intersection on WCR 19, is a hill which appears to be a site distance problem. Measuring the distance from the intersection to the crest of the hill, the distance is between 500'-600'. WCR 19 is designated as a collector status road, with a posted speed limit of 55 MPH. The Owens Bros. are requesting that WCR 28 be designated as the haul route from the pit entrance to this intersection. I feel that this is a safety issue and needs to be resolved. I've requested additional information through the traffic impact analysis study that shall be supplied by the applicant. I am requesting additional in-house investigation and determination for the safety issue of allowing Owen Bros. to utilize WCR 28 and access on to WCR 19 at this intersection. If this intersection becomes an issue, I would recommend that access be granted at a different location on to WCR 19 or on to State Highway 66. pc: Frank B. DATE: June 11, 2001 COLORADO FROM: Charlotte Davis, Environmental Health Services SUBJECT: USR-1343 Owens Brothers Concrete Company Environmental Health Services has reviewed this proposal for a Sand and Gravel Mining/Aggregate Processing/Concrete Batch Plant. We have no objections to the proposal, however, in reviewing the application we observed that the applicant is proposing bottled water as the facility's source of water. We do not believe that bottled water is an "adequate"source of water for this type of operation. The facility plans to operate at this location for at least 18 years, thus we believe a permanent water supply i.e. community system, well, etc. is more appropriate to serve the sanitary needs of the staff and visitors to the facility. We do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 4. In the event the proposed maintenance shop is equipped with a floor drain, the applicant must apply for an Underground Injection Control (UIC) Class V Injection Well permit through the Environmental Protection Agency (EPA), or provide evidence that the applicant is not subject to the EPA Class V requirements. 12. Submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to the Air Pollution Control Division, Colorado Department of Health and Environment for emissions of criteria, hazardous or odorous air pollutants. 13. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health& Environment, for approval prior to operation. 4. An individual sewage disposal system is required for the proposed aggregate processing plant, maintenance and office facilities and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. The installation of the septic system shall comply with the Weld County I.S.D.S. flood plain policy. r-� J5. If applicable, a NPDES Permit shall be obtained from the Water Quality Control Division EXHIBIT USR-1343 Owens Brothers Concrete Company Page 2 of the Colorado Department of Health for any proposed discharge into State Waterways. 6. The applicant shall provide evidence that any vehicle washing area will be designed and constructed to capture all effluent and prevent any discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality LL Control Commission and the Environmental Protection Agency. 14. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health& Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). ✓8. The applicant shall provide evidence that the facility has an adequate water supply. We recommend that the following requirements be incorporated into the permit as "development standards": 1. The facility shall operate in accordance with the approved dust control plan. The facility shall have sufficient equipment available to implement appropriate dust control. Additional control measures shall be implemented as required by the Weld County Health Officer. 2. In the event the facility utilizes the residence on the property for commercial purposes, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. If the system is found to be inadequately sized or constructed, the system must be brought into compliance with current Regulations. A. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. In accordance with the Above Ground Storage Tank Regulations (7 CCR 1101-14) a spillage retention berm shall be constructed around the tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. Alternative protective measures may be allowed provided they comply with the Above USR-1343 Owens Brothers Concrete Company Page 3 Ground Storage Tank Regulations. J5. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 16. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. L'7. Fugitive dust shall be controlled on this site. 4. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. �. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 10. The facility shall utilize the existing public water supply. (Central Weld County Water District) 11. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 12. The operation shall comply with all applicable rules and regulations of the Colorado Division of Minerals and Geology. 13. All fuel tanks, septic tanks, temporary buildings, and any other hazardous items that might wash away during flooding shall be securely anchored and adequately flood proofed to avoid creation of a health hazard. 14. Adequate handwashing and toilet facilities shall be provided for employees and the public. 15. The operation shall comply with the Occupational Safety and Health Act(OSHA). 16. The operation shall comply with the Mine Safety and Health Act (MSHA). 17. Portable toilets may be utilized on sites that are temporary locations of the working face and portable processing equipment, etc. for up to six months at each location. 18. Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum washing and the washing of vehicles in accordance with the Weld County Code, the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. The 'The would be one mile from the projected boundary of the town of Firestone. The future of the area surely Includes a large number of homes in that area. Weld County School District RE-1 serves the area included and surrounded by the project. The district will continue to serve the residents for public education purposes and school vehicles will travel many of the roads that will be impacted by the project. Many of the roads are impacted in a negative manner with the current amounts and type of traffic. The safety of students loading,unloading, moving to and from bus stops, and waiting for buses is a great concern to us as the project(phase one)would last a minimum of 18 years and possibly run 24 hours a day. This would be true of the current patterns of transporting students to the towns of Platteville(elementary and middle levels)and Gilcrest(high school)as well as traffic moving to and from schools in the Firestone area. An additional concern is that of limiting the district in sites to place a school building on that would cause traffic to be heavier during the school day. As a member of the Platteville Chamber of Commerce, we are writing to express our concerns regarding the sand and gravel mine referenced above. While the Chamber welcomes new businesses to the area, we do not feel that existing businesses and homeowners should be jeopardized in the process. As the above permit is currently written, I have serious misgivings that the surrounding farm businesses and rural residents will be impacted in a negative way by this gravel mining enterprise. Furthermore, we think this gravel mine will have a negative impact on the agricultural buffer zone which contributes to the quality of life in the Town of Platteville. In order to maintain the rural character of the land surrounding the mining operation,we propose that the gravel processing plant be located in the northwest corner of the Nix property (in the current Phase II area), as near as possible to the existing Varra plant. Since this area around the Varra plant is already industrial the two plants could be grouped together, thus protecting the rural nature of the surrounding properties as much as possible. All truck traffic to and from the gravel pit should be restricted to State Highway 66 or County Road 19, both of which are paved roads which carry lots of commercial traffic. No gravel pit traffic should be routed over County Road 28 or 17,both of which are dirt roads mostly used by slow-moving farm equipment and by local residents. The Commission is also concerned about the increase in traffic that would be imposed on the residents of the Town of Platteville. Nearby farms have irrigation wells, domestic wells, wetlands and springs,all of which are highly dependent on stable groundwater levels. A mining Application for Use by Special Review prepared by Banks and Gesso (May 2001)was included in the referral. The property is currently used as farmland and includes some petroleum wells and tanks. The proposed operation will mine terrace deposits of the St Vrain River. Flooding. Although the property is more than 1/2 mile from St Vrain Creek,parts of the property are labeled as zone A by FEMA,probably relating to flooding from nearby ditches. Gravel extraction in this area may not have an effect on flooding in the area,but could affect water flow in ditches that are not concrete-lined. Groundwater.The application shows that there are five water wells within the 600-ft permit boundary of the project. These wells are discussed as being alluvial wells. Baseline data on depth to water level and water quality should be collected from these wells to provide important documentation in the event that the mining operation disturbs the subsurface hydrologic conditions. Ground stability. It appears that the pits will be excavated on a 1:1 grade before backfill to 3:1. Detailed geotechnical investigations should be performed before development begins to ensure that slopes on these soils will not fail,which could have an impact on the petroleum facilities. We would like to take this time to respond to the concerns raised by the CGS in that correspondence. Flooding. The Applicant has prepared a Flood Hazard Development Permit for the subject site and has submitted this application to the County for approval. Groundwater. The Applicant is aware of the possibility of disturbing subsurface hydrologic conditions as a result of mining activities. As such, Owens Brothers has prepared a Substitute Supply Plan and submitted this plan to the Office of the State Engineer, Division of Water Resources, for approval. This plan addresses augmentation possibilities concerning potential losses in subsurface groundwater supplies and other changes in the hydrologic conditions surround the subject property. Proof of approval of this plan will be forwarded to your office upon receipt. Ground Stability. The pit slopes will be excavated to a 1:1 slope and backfilled to a 3:1 slope to approximately 10 feet below water line. From 10 feet below water line to the pit floor, the pit wall will be backfilled to a 2:1 slope. As required by the Division of Minerals and Geology, it has become common practice to enter into agreements with owners of permanent manmade structures within 200' of the mining limits. The petroleum facilities of concern to the CGS are considered permanent manmade structures. As such, the Applicant is actively pursuing surface- use-agreements with the appropriate oil and gas companies to allow for mining in the vicinity of their facilities. The Applicant will not perform any geotechnical investigations as to the stability of the proposed slopes unless it is a required condition of a mutually agreed upon surface use agreement with the appropriate oil and gas companies. The purpose of this letter is to inform the Weld County Planning Commission of HSR and HSG's property rights that may be affected by the proposed gravel mining operations on the subject property. You should be aware that HSR owns certain oil and gas leasehold rights and contractual rights affecting the property. In the S/2SW/4 of Section 28, HSR owns 100 percent interest in the Codell and Niobrara formations. HSR operates the Nix 13-28 well located in the SWSW and the Nix 14-28 located in the SESW of Section 28. Both of these wells are producing from the Codell and Niobrara formations and are located on the subject property. HSR believes that the oil and gas resources underlying the property have significant value and is, therefore, concerned about any surface use or plan of use that would restrict or preclude the use and enjoyment of the those rights by 1-ISR. You should also be aware that HSG owns certain Easements and Rights-of-Way for gas gathering lines that traverse the subject property. For safety and operational reasons, HSG must at all times have reasonable access to these Easements and Rights-of- way. We have met with the applicants and have begun discussions. In the absence of any such agreement, HSR requests that the Weld County Planning Commission condition the approval of the application such that a surface use agreement between the mineral leasehold estate and surface estate is required. For the benefit of those individuals and the County,I would like to offer the following comments: • State Highway(SH)66 is categorized as an R-A Highway. This means that no direct access to the highway shall be allowed if"reasonable"alternate access exists,such as a city or county road. CDOT works with the local municipality to determine the reasonableness of an existing road. • This property is bordered by both Weld County Road(WCR)28 and WCR 19. WCR 19 intersects with SH 66. • Improvements to the intersection of SH 66 and WCR 19 are warranted with existing traffic. The current proposal indicates that traffic generated by this site would have little impact to this intersection. • It is not known if the existing right-of-way is sufficient to allow improvements. • CDOT does not initiate traffic studies to determine the feasibility of a proposed development. The developer is responsible for conducting a traffic study. CDOT reviews the study. • CDOT does not have the authority to address land use issues,haul routes or dust control. It is our responsibility to promote safety on our state highways. I hope that I have addressed the County's and the public's concerns. Comments made during this phase of the USR process may not be all-inclusive,as other concerns or issues may arise during the remaining application processes. COMMENTS: This study has only 25%of the material going north to SH 66,while 75%goes south through Firestone. It is understood that the client provided this distribution;please elaborate on the reasoning for this distribution. With 75%of the traffic going through the intersection of WCR 19/WCR 24,it would be appropriate to include this intersection in the analysis. It is important to designate the approved haul routes in the traffic study. Over 8 miles of County roadways are indicated as haul routes. The pit operator should be made aware that the USR permit will require a maintenance agreement for the entire haul route. Please resubmit the traffic study addressing the above concerns. P.C.
