THIS AGREEMENT, made this 18 day of July , 2002, by and between THE
BOARD OF WELD COUNTY COMMISSIONERS, and
Flat Coat Asphalt Specialists, L.L.C.
doing business as
Flat Coat Asphalt Specialists, L.L.C.
hereinafter called "Contractor" .
WITNESSETH: That for and in consideration of the payments and agreements
hereinafter mentioned:
1. The Contractor will commence and complete the phased construction of
2002 SEAL COAT PROJECT
2 . The Contractor shall furnish all material, supplies, tools,
equipment, labor and other services necessary for the construction and
completion of the project described herein.
3 . The Contractor shall commence the work required by the Contract
Documents in accordance with the date stated in the Special Conditions
and shall complete the work within the time stated in the Special
Conditions unless the period for completion is extended otherwise by
the Contract Documents.
4. The Contractor agrees to perform all of the work described in the
Contract Documents and comply with the terms of herein for the sum of :
Thirty-three thousand three hundred ninety-four dollars.
($ 33, 394 .00 ) for the project:

5 . The term "Contract Documents" means and includes the following:

(B) Information for Bidders
(C) Non-Collusion Statement
(D) Bid
(E) Bid Schedule

(I) Acceptance of Notice
(J) Agreement
(K) Performance Bond
(L) Payment Bond
(M) Insurance Requirements
(N) Notice to Proceed
(0) Change Order
(P) Notice of Contractor' s Settlement
(Q) Final Receipt and Guarantee
(R) Drawings prepared by Weld County Engineering

On June 25, 2002, the bids for the 2002 Sand Seal Project were received.
Attached is the sole bid which includes unit prices and bid amounts.
Alternate #1: Diamond Coat Blend/Master Seal or equivalent
Alternate#2: Ultra Seal /Master Seal or equivalent

Engineering Estimate $ 45,580.00 $45,580.00
The unit prices bid for the 2002 Sand Seal Project are less than the accepted low bid for year 2001.
The low bid was given by Flat Coat Asphalt Specialists, L.L.C. for Alternate #2.
The Public Works Department has previously worked with the low bidder on numerous projects with
satisfactory results. I recommend the bid be awarded to Flat Coat Asphalt Specialists,L.L.C.
for Alternate #2 in the amount of$33,394.00.
