HomeMy WebLinkAbout20021424.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST LOU ANN CATENCAMP, OWNER, AND NEIL MADSEN, TENANT, FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Lou Ann Catencamp, owner, and Neil Madsen, tenant, VI #0100258, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 4th day of June, 2002, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Neil Madsen, tenant, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until August 4, 2002, to allow adequate time for Mr. Madsen to clean up the property before moving to another residence in Nebraska. To bring the property into compliance the property owner shall completely remove or screen the Noncommercial Junkyard from all adjacent properties from all public rights-of-way. Additionally, the maintenance of commercial vehicles, constitutes a commercial operation. The commercial vehicles shall be removed or a Use by Special Review application shall be completed and submitted for review. The potential noncompliance with the Weld County Code is the operation of a commercial business without the necessary permits. Specifically, the operation of a trucking (hauling)business without any permits violates the Weld County Code. According to our records, I can not find any evidence of such permits being obtained for this site. Semi trucks are considered as commercial equipment unless used solely on a property for"agricultural"purposes(i.e.to cut hay,feed large amounts of animals,etc...). Additionally,there is a"Noncommercial Junkyard"consisting of derelict vehicles and miscellaneous debris. Per your request, I am also including copies of pictures that were taken on August 29, 2001. Please be advised that I have forwarded this case to the Weld County Sheriff's Office and the Weld County Department of Public Health and Environment.
