RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST LOU ANN CATENCAMP, OWNER, AND NEIL MADSEN,
TENANT, FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Lou Ann Catencamp, owner, and Neil Madsen, tenant, VI #0100258, are
allegedly in violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 4th day of June, 2002, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Neil Madsen, tenant, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until August 4, 2002, to allow adequate time for Mr. Madsen to clean
up the property before moving to another residence in Nebraska.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0100258 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Lou Ann Catencamp, owner, and Neil Madsen, tenant,
to remedy the violation of the Weld County Code, and any other persons occupying the
properties, any persons claiming an interest in the properties, and any persons acting in active
concert with the identified parties, with an instruction for delay of action upon such referral until
August 4, 2002, to allow adequate time for Mr. Madsen to clean up the property before moving
to another residence in Nebraska.

case was scheduled before the Board of County Commissioners .
Currently, there is a violation of Chapter 23, Article III (3) , Division 1, of
Sections 23-3-20, 23-3-30, 23-3-30 .I, 23-3-40 and 23-3-40 .R of the Weld County
Code. To bring the property into compliance the property owner shall completely
remove or screen the Noncommercial Junkyard from all adjacent properties from all
public rights-of-way. Additionally, the maintenance of commercial vehicles,
constitutes a commercial operation. The commercial vehicles shall be removed or
a Use by Special Review application shall be completed and submitted for review.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties .

Dear Ms. Catencamp and Mr. Madsen:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting with
the Board of County Commissioners on June 4, 2002, at 10:00 a.m., to consider the violations occurring on the
property. The above mentioned property is in violation of the following Section(s)of the Weld County Code:
Chapter 23,Article III, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.I "Noncommercial junkyard."
Section23-3-40 "Uses by special review."
Section 23-3-40.R "Any use permitted as a Use by Right, an Accessory Use or a Use by Special Review in the
Commercial or industrial zone district,provided that the property is not a lot in an approved or recorded subdivision
plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions. PUD
development proposals shall not be permitted to use the special review permit process to develop."
To bring your property into compliance with the Weld County Code:
As we discussed,any remaining items constituting a"Noncommercial Junkyard"be removed or screened from all
adjacent property owners and public rights-of-way. Additionally,the semi cabs shall be removed from the site. Semi
cabs are considered commercial vehicles and thus not an allowed use in a recorded subdivision,such as Aristocrat
Ranchettes. Additionally,all remaining semi trailers shall maintain current license plates or be removed from the
property.
This meeting will take place in the County Commissioners' Hearing Room, First Floor,Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance
to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties the business day before
or as soon as possible to the above mentioned Violation Hearing date.

Dear Ms. Catencamp:
It has come to the attention of the Department of Planning Services'staff that the uses on your property may not
be in compliance with the Weld County Code. The potential noncompliance with the Weld County Code is the
operation of a commercial business without the necessary permits. Specifically, the operation of a trucking
(hauling)business without any permits violates the Weld County Code. According to our records, I can not find
any evidence of such permits being obtained for this site. Semi trucks are considered as commercial equipment
unless used solely on a property for"agricultural"purposes(i.e.to cut hay,feed large amounts of animals,etc...).
Additionally,there is a"Noncommercial Junkyard"consisting of derelict vehicles and miscellaneous debris. Per
your request, I am also including copies of pictures that were taken on August 29, 2001. Please be advised that
I have forwarded this case to the Weld County Sheriff's Office and the Weld County Department of Public Health
and Environment.
Please contact me within five working days of the date of this letter to review these concerns with me. Failure
to show progress or close the case will result in a thirty-day violation notice will be issued. Feel free to contact
