Dear Mr. Kiernes:
A staff review of your proposal to build aprivate access road from
Colorado State Highway 7 to the Erie Landfill indicates that such a
change is not considered a material deviation from what was originally
approved in SUP-400:79:22 and more recently USR-534:82:49 such that an
amendment to the Special Use Permit, Use by Special Review Permit, or
the Certificate of Designation would be required. This is based; however,
on the following assumptions:
1. That the road will be privately owned and maintained and
will service only your facility. This road will run from
Colorado State Highway 7 due north to the facility on the
half (4) section line of Sections 29 and 32, T1N, R68W of
the 6th P.M. , Weld County, Colorado;
2. That the new access road will have a paved surface and that
the current access, for customers of the landfill, from Weld
County Road 6 will be closed;
3. That the only changes in your existing operation will be
to accomodate the new point of access;
4. That arrangements will be made to patrol the private access
road to pick up trash and prevent unauthorized dumping along
the road;
5. Any improvements required by the Colorado Department of
Highways for the access to Colorado State Highway 7 will
be constructed at Colorado Landfill, Inc's., expense.
If the above assumptions are correct, our office has no objection to
Colorado Landfill, Inc., proceeding with its plan to construct the
private road.
