1. Building permits shall be obtained prior to any construction. Building permits are not
required for buildings that qualify for and receive a Certificate of Compliance, but an electrical
permit will be required for all buildings if electrical service is provided to the building.
2. A plan review will be required for each building. Two complete sets of plans are required
i-. when applying for the permit.
3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999
NEC and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.

We have reviewed the above referenced proposal to subdivide a 32.27-acre
parcel into 5 single-family residential lots. The proposed water supply is from the Little
Thompson Water District and a letter of obligation was submitted with the referral
materials. A water supply information summary sheet was not included.
Pursuant to Section 30-28-136(1)(h)(II), the State Engineer's Office offers the
• opinion, that contingent upon water service being provided by the Little Thompson Water
District, the proposed water supply will not cause material injury to existing water rights,
the supply is expected to be adequate.

The To'I vn of Berthoud has received a county referral for the Schultz Minor Subdivision. The
proposed development is located within the Town's Community Influence Area and is also in the
area oflthe Town's Land Use Plan identified as a "cropland support area". The Town's Land Use
Plan sates that in the Community Influence Area, "properties should not be upzoned in the
Countyp.unless associated with clustering and effective conservation measures". The intent of
the cropland support area is to maintain the viability of cropland east of the Town through the
"purchasing of conservation easements, considering very limited clustered development and
other effective conservation measures".
The proposed development does not appear to meet the intent of the Community Influence Area
or the Cropland Support Area. As currently planned, the site is to be divided into individual lots
with no clustering or open space other than what is on individual lots. As currently proposed,
the Schultz Minor Subdivision is not in conformance with the Town of Berthoud's Land Use
Plan and therefore, not supported by the Town. Also, the project narrative identifies the Town of
Berthoud as providing police and fire protection, which is incorrect, since the property is not
within jfown limits.

Thompson School District R2-J Development Impact Report
Schultz First SD(S-6111,dated 10/31/01 with 5 dwelling units, is located within the current attendance boundaries of
Berthoud Elementary School, Turner Middle School, and Berthoud High School. Construction is estimated to
start in 18 months and build at an annual rate of 3 dwelling units per year resulting in an expected growth in
enrollment of 2 elementary, 1 middle school and 1 high school students by 2003.
According to Master Plan 2001's five-year projection, the estimated student population from this development,
and others that have received final plat approval, will not cause district enrollment to exceed service level C.
Five years is the longest projection time frame considered reliable.

SUBJECT: Schultz First Subdivision Weld County Referral (7-4-68)
Project Description/Background:
This is a request to subdivide 32+/- acres located northeast of Berthoud,Colorado into 5 lots. The property lies at
the northeast corner of the intersection of Larimer County Road 904 and Latimer County Road 10.
Review Criteria:
The intent of the Referral is to provide all of the information that is needed to ensure that the development
complies with all of the requirements of the Larimer County Land Use Code(LCLIJC). The materials submitted
need to provide adequate information to accurately assess the drainage and transportation aspects for the site and
how these aspects may impact the surrounding area. Development review staff from this office have reviewed the
materials that were submitted to our office per the criteria found in the LCLUC,Road Manual, Access Code,
Storm-Water Management Manual (LCSWMM), and pertinent Intergovernmental Agreements.
Transportation/Access issues:
1. This project will access off of I.CR 904. 'The Larimer County Transportation Plan, adopted in September of
2000, functionally classifies I,CR 904 as a minor collector that requires a 100-foot right-of-way(50 feet half
right-of-way).Latimer County requests that the ROW be shown as dedicated along the west boundary of the
proposed development to match the current classification of the County Road.
2, We will require that the applicant provide detailed location and site distance information for the proposed
access with the preliminary submittal. Any access construction on LCR 904,or work in the County right-of-
way,will require an Access or Utility Permit from this office, Access information and permits can be
obtained by contacting Marc Lyons at(970)498-5709.
3. Please change the trip distribution(Figure 5) of the traffic report so that 100% of the traffic is depicted.
4. For infonnational purposes only, the most recent traffic counts recorded by this office arc referenced below
(taken on CR 904 north of CR 10):

Fees:
1. Per Section 9.5 of the LCLUC, Engineering Staff would like to request that the applicant pay the Larimer
County Transportation Capital Expansion Fees. These fees were established to offset the costs of repairing or

upgrading roads due to new development. These fees will be required at the time of building permit issuance

Staff Recommendation:
The Larimer County Engineering Department does not have any major concerns or issues with the preliminary
submittal of this proposal. It appears from the preliminary information that the final design is feasible. As part of
the final submittal,please address the items listed above.

Subject: Review of Schultz Minor Subdivision Final Plan Vicki Cowan

Dear Ms. Ogle:
Colorado Geological Survey has completed its site visit and review of the above-referenced project. I
visited the site on November 2, 2001. I understand the applicant proposes to subdivide this 32.3-acre
parcel into four residential lots of approximately 5 acres each,plus one residential lot of 10.3 acres.
Individual sewage disposal systems (ISDS) are planned for each of the five new lots, and the applicant
states that domestic water service will be provided by Little Thompson Water District. I have several
comments regarding the proposed development.
1. Soils and bedrock. With this referral, I received a Project Narrative dated October 2,2001. The
narrative contains a three-paragraph section entitled "Geologic Hazards and Soils," describing the
results of a limited geologic and soils investigation conducted by Landmark Engineering. According
to the Soil Conservation Service's Southern Weld County Soil Survey, the site is underlain by Nunn
clay loam, consisting of compressible eolian and alluvial clays, silts and clayey sands. The Soil
Survey describes this soil as presenting severe limitations for dwellings due to moderate to high
shrink-swell potential and low strength characteristics. The underlying bedrock consists of Upper
Pierre Shale, and is expected to exhibit high swell potential.
2. Foundation design. The project narrative contains an appropriate recommendation for additional
geotechnical soils investigations. Site-specific investigations including sampling, lab testing and
analysis will be needed to evaluate groundwater levels, characterize soil and rock engineering
properties to determine maximum bearing and minimum dead-load pressures, and to develop final
design criteria for individual foundations, drains, floor systems, sewage disposal systems and
pavements. This will help minimize the risk of foundation damage due to differential settlement and
heave. Additional foundation damage due to compaction and differential settlement can occur if
water infiltrates the soils adjacent to and beneath the foundation as a result of, for example,
residential irrigation. Proper grading, compaction and drainage must be incorporated into the
development plans.
3. ISDS. The Southern Weld County Soil Survey describes the soil unit present on this property as
having severe limitations for septic system absorption fields due to slow percolation rates. For all
lots, individual percolation tests will be needed to design ISDSs, and the project narrative states that
designed septic leach fields may be needed. Since engineered systems of all types generally require

The Weld County Health Department has reviewed this proposal. It appears that all
recommendations for approval have been included in the application for final plan with one
exception: The language for the protection of the secondary absorption field envelope in the draft
covenants is vague and not what was requested to be included in the covenants.
The following conditions are recommended to be part of any approval:
1. A Weld County Septic Permit is required for each proposed septic system and shall be installed
according to the Weld County Individual Sewage Disposal System Regulations. Each septic system
shall be designed for site-specific conditions, including but not limited to maximum seasonal high
groundwater, poor soils, and shallow bedrock.
2. This minor subdivision shall utilize Little Thompson Water District.
3. The applicant shall delineate on the plat an area for septic system replacement envelopes.
Primary and secondary septic system envelopes shall be designated on each lot. Each envelope must
meet minimum current setbacks as specified in the Weld County Individual Sewage Disposal System
Regulations.
4. Language for the preservation and/or protection of the second absorption field envelope shall be placed in
the development covenants. The covenants should state that activities such as landscaping (i.e. planting
of trees and shrubs)and construction (i.e. auxiliary structures, dirt mounds, etc.) are expressly prohibited
in the designated absorption field site.
5. The Right to Farm covenant shall be recorded on the plat.
6. In the event that 5 or more acres are disturbed during the construction and development of this site, the
applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and the Environment.

The Public Works Department has reviewed the Final Plan application and has the following
comments:
External Roads:
Weld and Larimer Counties have worked closely with the applicant to develop a plan for
improvements to WCR I that addresses impacts and provide the best solution given the existing
roadway conditions. A letter dated June 11, 2001, detailing the agreement between the two
Counties, the applicant and the McIntyre Ditch Company is attached. The relocation of the
McIntyre Ditch as outlined in the agreement adequately addresses improvements to WCR 1. The
plans submitted by Landmark Engineering for the ditch relocation are acceptable to Public Works.
The agreement calls for the McIntyre Ditch Company to approve the construction plans.
Documentation to that effect is still required.
An additional 20' right-of-way reservation is provided on the final plat as requested.
Internal Roads:
Landmark Engineering has submitted road plans for Schultz Lane that are acceptable to Public
Works. Weld County will not accept an unpaved subdivision road for maintenance. Provisions for
road maintenance should be outlined in covenants as a responsibility of the homeowners.
Record Plat:
The Certificate of Dedication correctly calls out dedication of rights-of-way to the public;however,
under the name Schultz Lane on the drawing Private Drive is indicated in parentheses. The
reference to Private Drive should be removed.
A right-of-way with of 60' should be called out under Schultz Lane on the drawing.
No curve information is called out at the intersection of Schultz Lane and WCR 1.
The curves are numbered around the cul-de-sac but there is no curve information table on the plat.

Drainage:
Landmark has submitted a drainage plan that is acceptable to the Public Works Department. The
drainage plan states storm water will flow into the McIntyre Ditch as it has historically. The
acceptance of this storm water by the McIntyre Ditch should be included in acceptance of the
construction plans as indicated above.
Recommendation:
Approval
Requirements Prior to Recording:
1. Onsite and Offsite improvements agreements and surety.
2. McIntyre Ditch acceptance of storm water and construction plan approval.
3. Remove Private Drive designation on the drawing for Schultz Lane.
4. Call out 60' right-of-way for Schultz Lane.
5. Provide curve information and curve data table for Schultz Lane.
