RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 726 - BRUCE A. JOHNSON AND SONS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 726 , does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 726 was submitted by Bruce A. Johnson and Sons for property which is located in the SEa, Section 33 , Township 7 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , this request is to divide the property into parcels estimated to be approximately 73 acres and 1 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definitions of "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. Johnson and Sons for a recorded exemption. The parcel of land on which this request is being made is described as part of the SE`, Section 33, T7N, R65W of the 6th P.M. , Weld County, Colorado. The property is located 1.75 miles east of Eaton on Weld County Road 74. The property contains approximately 73.7 acres of Class I (prime) , and IIs (prime) , irrigated soils. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 72.7 acres and 1 acres, more or less. The applicants would like to separate a single family residence from a family farm. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request he approved for the following reasons: 1. The request complies with Section 9-2C. of the Weld County Subdivision Regulations submission requirements; and 2. The proposal is also consistent with the intent of the "A" Agricultural Zone District on which it is located. - The proposal was reviewed by the city of Eaton and was found to comply with their long-range Comprehensive Plan. - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan. Therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. The proposed lots meet minimum lot size requirements for land division. - The North Weld County Water District has indicated adequate water service is available for this proposal. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from Weld County Road 74. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. This lot is currently a 73. 7 acre family farm with a single family residence on a 1 acre parcel of it. The residents of the dwelling want to stop farming, but still want to live in the house. Therefore, the purpose of dividing the land into two lots is to enable the residents/owners of the dwelling to remain on the property, and to enable the rest of the family to continue farming the rest of the land. 5. This proposal is consistant with the policies of the Weld County Comprehensive Plan. The farm will still be an active farm, nothing will change there. The lot with the house and buildings is not part of the agricultural production now, nor will it be after the recorded exemption is in place. The lot will remain a single family dwelling. 6. The proposal is consistant with the intent of the agricultural zone district in which these land parcels lie. The number of acres farmed will not change. The homeowners will be able to remain on the un-farmed residential portion of the land. 7. The uses of these parcels of land will not change. The large parcel of land is currently a family farm, and it will continue to be a family farm. The small parcel of land is currently a single family residence, and it will remain so. These uses are compatible with several neighboring farms and residential lots. 8. The uses of the parcels, single family dwelling, and farming, are compatible with the future development of the area. The house could be sold to the owner of the farm in the future, or the house could be sold to another party after the first right of refusal was given to the farm owner. A recorded exemption will allow the house and farm to be independant of each other, yet they will still be in harmony with each 841055 other because no rights of way will be disturbed by creating a lot for the house. Agricultural land and a single family dwelling lot are both compatible with the future of this rural area. 9. This proposal for a recorded exemption is consistant with efficient and orderly development because it provides the house at 20555 Weld County Road 74 with a lot, which is a progressive step. It is efficient because it does not take any valuable agricultural acres out of the farm production. 10. The existing water sources for the large parcel of land are two irrigation wells at the North end of the property. A North Weld Water District tap could be provided in the future, if it were necessary. Now sewage disposal methods exist or are anticipated for the large parcel of land, however it could be served by a septic system and leech field if it were necessary in the future. The existing source of water for the small parcel of land is a North Weld Water District tap. The existing method of sewage disposal for the small parcel is a septic tank and leech field. 11. The property in consideration for recorded exemption is located two and one-half miles East of Highway 85 in Eaton, on Weld County Road 74.
