Dear Mr. Duckworth:
The Hazardous Materials and Waste Management Division of the Colorado Department
of Health (the Division) has completed a review of ground water monitoring data for the
above referenced facility. This data includes monitoring of the shallow ground water at the
site from August 13, 1990 to September 14, 1992. Pursuant to Subsection 6.1.4 of the
Regulations Pertaining to Solid Waste Disposal Sites and Facilities (the Regulations) the
data was reviewed to make a determination if the ground water in the vicinity has been
impacted by disposal operations at Weld County Waste Disposal (WCWD).
A statistical analyses of selected wells and parameters was carried out using the
GRITS/STAT Version 4.14 Ground Water Information Tracking Information System
software, which has been developed by the EPA for storing and analyzing ground water
monitoring data. The data was analyzed using the Cochran Approximation of the Behrens-
Fisher Student's T-test, as described in the GRITS/STAT manual and as specified in
Subsection 2.23 (c) of the Regulations.
The Division has determined, based on its review, that WCWD has impacted the shallow
ground water in the vicinity of this facility, and therefore must come into compliance with
the Regulations. Representatives of the Division are available to discuss the implications
of compliance with WCWD, if necessary.

Dear Mr. Judd:
The Department of Health, Hazardous Materials and Waste Manage-
ment Division requested that I address an issue which I believe
you have raised with the Solid Waste Section concerning whether
Weld County Waste Disposal must comply with the requirements of
Section 9 "Waste Impoundments" of the Regulations Pertaining to
Solid Waste Disposal Sites and Facilities, 6 CCR 1007-2. Section
9 sets forth solid waste disposal requirements for liquid waste
impoundments, including, but not limited to, design, operation
and monitoring requirements. Prior to October 9, 1993 these
requirements were found in Section 6 of the solid waste regula-
tions.
Weld County Waste Disposal must comply with the requirements of
Section 9. Weld County Waste Disposal was apparently in oper-
ation prior to the adoption of the solid waste disposal require-
ments for liquid waste impoundments and therefore not immediately
required to come into compliance with those specific require-
ments. However, Section 9 presently provides, as did the earlier
versions of the solid waste regulations, that "sites and facili-
ties in operation prior to the adoption of these regulations may
be required to come into compliance with these regulations upon a
determination by the department that such sites and facilities
are causing impairment of existing or future use of surface water
or groundwater. " See Section 9. 1.4 of 6 CCR 1007-2 and Section
6. 1.4 of the version of the solid waste regulations in effect
until October 9, 1993 , copies of which are attached for your
review.
In a letter dated August 26, 1993 from the Department to Weld

County Waste Disposal, the Department clearly and unequivocally
stated its basis for and its determination that Weld County Waste
Disposal had impacted the groundwater in the vicinity of its fa-
cility and that pursuant to Section 6.1.4 was required to come
into compliance with the applicable regulatory requirements. A
copy of the letter is attached for your review. This determina-
tion was effective immediately and represented final agency ac-
tion which was at that time subject to review by the district
court. Section 24-4-106(4) , C.R.S. Weld County Waste Disposal
did not contest the determination by the Department nor the
requirement that it comply with the regulations within the thirty
days provided in § 24-4-106(4) , C.R.S. and therefore relin-
quished any review rights it might have had. Weld County Waste
Disposal, must comply with the solid waste requirements applicable
to waste impoundments. That issue has been finally determined.

station. Unco pacted wastes will not be allowed to remain on
the tipping floor overnight. Removal of all putrescible
solid waste from the transfer station whenever transfer
containers are full, or weekly, whichever comes first, is
also required. Uncleaned transfer vehicles containing
putrescible material shall not be parked on public streets or
roads except under emergency conditions. Adequate off-street
parking for facility vehicles shall be provided.
(L) All solid waste received at a transfer station shall be
transferred as soon as practicable. All solid wastes
arriving at the transfer station that are not transferred
within twenty-four (24) hours of receipt shall be placed in
closed containers or in totally enclosed buildings,
structures, or other means of cover acceptable to the
Department, that deter water, birds, insects, rodents and
other vectors from reaching wastes.
(M) Final disposal All solid waste passing through the
transfer station shall be ultimately treated or disposed of
in an approved solid waste disposal site and facility .
(N) Water supply The amounts and source of water for use on
site for the control of nuisance conditions, fire protection,
construction purposes and personnel use shall be presented.
7.2.4 Closure plans for final closure of the transfer station
shall include a plan for the removal of all stored solid
wastes and washdown liquids. The Department and the local
governing authority shall be notified, in writing, of
temporary or permanent closure of the transfer station.

WASTE IMPOUNDMENTS
9.1 REGULATED FACILITIES These regulations apply to waste
impoundments that store, treat or dispose of liquid,
semisolid or solid wastes, except as provided in 9. 1.4 for
facilities in operation prior to adoption of these
regulations.
9.1.1 These regulations do not apply to wastes which:
(A) Are subject to a permit issued pursuant to the
"Colorado Mined Land Reclamation Act", CRS 1973 ,
34-32-101, et seq. , as amended; or
(B) Are subject to license issued pursuant to the

"Radiation Control Act", CRS 1973, 25-11-101, et sea. , as
amended; or
(C) Are subject to a certificate of designation or
permit issued pursuant to the "Hazardous Waste Act",
C.R.S 1973, 25-15-191, et seq. , as amended; or
(D) Are industrial discharges which are point sources
subject to permits under the provisions of the "Colorado
Water Quality Control Act", CRS 1973, 25-8-101, et seq. ,
as amended; or
(E) Are subject to a consent order, decree or agreement
or a written cooperative agreement issued pursuant to the
"Solid Waste Disposal Sites and Facilities Act", CRS
1973, 30-20-101, et seq. , as amended, to the extent that
the treatment, storage or disposal of such wastes in a
waste impoundment is approved by the Department pursuant
to such consent order, decree, agreement, or written
cooperative agreement;
(F) Are subject to an uncontested order, a consent
order, decree or agreement; or a written cooperative
agreement issued pursuant to the federal "Comprehensive
Environmental Response Compensation and Liability Act of
1980", as amended, to which the Department is a signatory
party, to the extent that the treatment, storage or
disposal of such wastes in a waste impoundment is
approved by the Department pursuant to such uncontested
order, consent order, decree, agreement, or written
cooperative agreement;
(G) Will be beneficially reused; or
(H) Are agricultural wastes.
9.1.2 The Department will consider on-site oil and gas liquid
waste impoundments to be in compliance with these
regulations if:
(A) The disposal facilities are regulated by the Oil and
Gas Conservation Commission;
(B) There is no imminent or substantial endangerment to
public health or the environment from the disposal
facilities; and
(C) Compliance with the certificate of designation
requirement is not required by the county within which the
site is located (for central disposal facilities only) .
9. 1.3 The following listed parts of Section 9 of these
regulations do not apply to the noted classes of waste
impoundments.

9.1.5 Surface and ground water monitoring may be required by the
Department at existing sites where seepage from an
impoundment and impairment of existing or future use of
surface or ground water are determined to be probable.
9.2 IMPOUNDMENT CLASSIFICATIONS In addition to applicable
requirements in the preceding sections of these regulations,
Sections 9.1 through 9. 10 shall apply to waste impoundments
which are regulated under the "Solid Waste Disposal Sites and
Facilities Act".
9.2.1 To determine whether an impoundment is in Class I, II or
III as described in Sections 9.2.2, 9.2.3 and 9.2.4 ,
herein, the following criteria shall be utilized:
(A) The potential of the site as an aquifer recharge area;
(B) The quality of the water in the highest aquifer
according to the following parameters:
(1) Total Dissolved Solids;
(2) Total Organic Carbon;
(3) Total Organic Halogen;
(4) Ph;
(5) Phenolic Compounds;
(6) Chloride;
(7) Iron;
(8) Lead;
(9) Potassium;
(10) Sodium;
(11) Calcium;
(12) Sulfate and all other known or probable constituents
of the wastes which will be contained in the impoundment.

WASTE IMPOUNDMENTS - -
6.1 Regulated Facilities These regulations apply to waste impoundments that

at existing sites where seepage from an impoundment and impairment of
existing or future use of surface or groundwater are determined to be
probable.
6.2 Impoundment Classifications In addition to applicable requirements in the
preceding sections of these regulations, sections 6.1 through 6.10 shall
apply to waste impoundments which are regulated under the "Solid Waste
Disposal Sites and Facilities Act".
6.2.1 To determine whether an impoundment is in Class I, II or III as
described in sections 6.2.2, 6.2.3 and 6.2.4, herein, the following
criteria shall be utilized:
(a) The potential of the site as an aquifer recharge area;
(b) The quality of the water in the highest aquifer according to the
following parameters (1) Total Dissolved Solids, (2) Total Organic
Carbon, (3-) Total Organic Halogen, (4) Ph, (5) Phenolic Compounds,
(6) Chloride, (7) Iron, (8) Lead, (9) Potassium, (10) Sodium,
(11) Calcium, (12) Sulfate and all other known or probable constituents
of the wastes which will be contained in the impoundment;
(c) Existing or future uses of any surface or groundwater which could
be impaired by seepage from the impoundment;
(d) The constituents of the waste, their toxicity, mobility and
persistence; and
(e) The geologic and hydrologic characteristics of the site.
6.2.2 An impoundment shall be in Class I (no seepage allowed beyond liner)
if it:
(a) Is located in a recharge area for an underground source of
drinking water or over any unconfined aquifer; and
(b) Seepage of waste or constituents from the impoundment would impair
existing or future use of groundwater if allowed to reach that
groundwater.
6.2.3 An impoundment shall be in Class II (Controlled seepage) if it:
(a) Is located in a recharge area for an underground source of

Two issues were raised in your letter of November 23 , 1994 to the

which I believe require a response by myself on behalf of the
Department.
First, neither the due process clauses of the United States or
the Colorado Constitutions require that a hearing be held prior
to a determination pursuant to Section 9 .1.4 of the Solid Waste
Regulations, 6 CCR 1007-3 , regarding application of the Section 9
requirements to Weld County Waste Disposal' s waste impoundment .
Nor does § 24-4-105 (2) , C.R.S. , of the State Administrative
Procedures Act, or any other state statute, require a hearing
prior to such a determination.
Constitutional due process requirements are satisfied by notice
and an opportunity to be heard. Weld County Waste Disposal was
given notice of, and the basis for, the Department' s
determination by the Department' s August 26, 1993 letter. At
that time, Weld County Waste Disposal could have challenged that
determination as final. agency action under § 24-4-106, C.R.S . , of
the State Administrative Procedures Act, but chose not to do so.
This post-decision hearing was Weld County Waste Disposal' s
opportunity to be heard and satisfies that due process
requirement .
Post-decision hearings have long been recognized as satisfying
the due process requirement of an opportunity to be heard. See
Mathews v. Eldridae, 424 U.S. 319 (1976) (as long as an appellate
hearing is available, the government may, without a prior
hearing, cut off social security benefits and not violate due
process clause) ; State Personnel Board v. District Court, 637

P.2d 333 (Colo. 1981) (post termination hearing is adequate to
satisfy due process clause) .
Any due process rights held by Weld County Waste Disposal were
satisfied by the notice of the Department' s determination and the
post-determination right to be heard afforded under the State
Administrative Procedures Act. Neither the United States or the
Colorado constitution, the State Administrative Procedures Act or
any other state statute require that the Department' s
determination of the application of Section 9, 6 CCR 1007-2, be
preceded by a hearing.
Weld County Waste Disposal's continued failure to comply with the
requirements of Section 9 of the Solid Waste Regulations, 6 CCR
1007-2, is unwarranted, and is a violation of state law.
Second, your letter implies that the Department has somehow
prevented Weld County Waste Disposal from removing any sediments
which may exist in its surface impoundments thereby exacerbating,
if not causing, some of the problems with Weld County Waste
Disposal' s surface impoundments . I don' t believe that' s the case
at all.
The Department' s position has been throughout the discussions
with Weld County Waste Disposal that those sediments can be
removed, but if sediments are removed, a determination must be
made of whether those sediments are hazardous waste, and if those
sediments are hazardous they must be handled accordingly. The
Department has not in any way ordered Weld County Waste Disposal
to maintain the sediments in the surface impoundments . Weld
County Waste Disposal has itself chosen not to remove any of the
sediments .
Apparently, Weld County Waste Disposal has, at least in part,
chosen not to remove those sediments because the Department will
not agree with Weld County Waste Disposal' s position that, prior
to any testing of the sediments and under all circumstances, that
the sediments will not be considered a hazardous waste . Weld
County Waste Disposal, of its own volition and for its own
purposes, disposed of hazardous wastes into its surface
impoundments . The Department was not responsible for Weld County
Waste Disposal' s actions then and is not responsible for Weld
County Waste Disposal' s actions or the problems caused by its
surface impoundments now. The Department only requires that Weld
County Waste Disposal' s actions comply with state law.
As the Department has indicated in the past, it is willing to try
to address Weld County Waste Disposal' s problems in a global
fashion. A "global fashion" is, however, not synonymous with a
complete disregard for compliance with solid waste and hazardous
waste regulatory requirements.

In that regard, and in response to your recent letters indicating
that you believe that Weld County Waste Disposal has not received
an adequate response to previous requests made of the Department
I would add the following:
1. The Department does not agree with the assumption by Weld
County Waste Disposal' s contractor, Groundwater Technology, Inc. ,
that the liquids and sludges contained in surface impoundments,
or the soils surrounding or underlying them are necessarily
homogeneous in nature, such that a single sample of the liquids
or sludges obtained from the shore or a single sample of the
soils surrounding or underlying the surface impoundments would
constitute a representative sample. Weld County Waste Disposal
needs to submit a grid sampling plan sufficient to adequately
characterize the site and the materials contained in the surface
impoundments and which is developed in accordance with the
methodologies in "Test Methods for Evaluating Solid Waste,
Physicals/Chemical Mehtods, " EPA Publication SW-846 .
2 . The Department cannot approve any treatment of the materials
contained in the surface impoundments, including aeration of the
surface impoundments, in the absence of an adequate
characterization of the materials in the surface impoundments .
. In fact, it is impossible to calculate emissions rates from any
treatment of these materials without such a characterization. In
that regard, Weld County Waste Disposal will also need to contact
the Air Pollution Control Division of the Department of Public
Health and Environment concerning any air emissions relating to
treatment of these materials at the site. The Hazardous
Materials and Waste Management Division will coordinate its
response concerning any proposed treatment of hazardous or solid
waste at the site with the Air Pollution Control Division, but
Weld County Waste Disposal needs to contact the Air Pollution
Control Division for approval of any air emissions from such
treatment .
Lastly, in response to your letter of December 29th, 1994
concerning the monies owed the State of Colorado because of Weld
County Waste Disposal' s failure make the solid waste user fee
payments as required by 5 25-16-104. 5, C.R.S . , the Department
will not link payment of the solid waste user fee by Weld County
Waste Disposal with approval of any remediation plan submitted by
Weld County Waste Disposal. Payment is required by the statute,
it is a completely separate issue, and will not be linked with
any other regulatory problems regarding Weld County Waste
Disposal' s management of the site.
In regards to the issue you raised concerning payments by
certified or cashier' s check, it is the policy of the Department
to always require that late payments, especially when the

payments are long overdue, as is the case with Weld County Waste
Disposal, be made by certified or cashier' s check. Simply put,
this allows the Department to avoid the problems associated with
parties who make payments by personal or corporate checks drawn
on accounts with insufficient funds to further delay or avoid
payment, and is a reasonable administrative requirement given the
low cost of obtaining a certified or cashier' s check and the fact
that the party has already shown some reluctance to make the
required payment. I would suggest that Weld County Waste
Disposal make the required payment now by certified or cashier' s
check and avoid the ten percent penalty provided for in 5 25-15-
104 .5 (5) , C.R.S.
