RESOLUTION RE: APPROVE APPLICATION TO CONSTRUCT CROSSING SIGNALS AND GATES AT THE EXISTING GRADE CROSSING OF WCR 51 AND BURLINGTON NORTHERN AND SANTA FE RAILWAY COMPANY, AND AUTHORIZE CHAIR TO SIGN - COLORADO PUBLIC UTILITIES COMMISSION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Application to Construct Crossing Signals and Gates at the Existing Grade Crossing of Weld County Road 51 and the Burlington Northern and Santa Fe Railway Company from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, to the Colorado Public Utilities Commission, with terms and conditions being as stated in said application, and WHEREAS, after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Application to Construct Crossing Signals and Gates at the Existing Grade Crossing of Weld County Road 51 and the Burlington Northern and Santa Fe Railway Company from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, to the Colorado Public Utilities Commission be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said application. The County presents the following information in support of its application: 1. Weld County is duly established under the laws of the State of Colorado and through its Public Works Department is duly authorized to construct,maintain and operate roadways in Weld County, Colorado. 2. The address of Weld County Public Works Department is 1111 H Street, Greeley, Colorado 80632. The County representative will be Mr. Frank Hempen. 3. The requested Project is necessitated: a. by the construction of a power plant near the existing crossing, which will contribute substantially to increased roadway traffic; and b. by the continuing development of commercial and residential areas in the vicinity of the Project. 4. Average Daily Traffic (ADT) over the crossing during the plant construction period is anticipated to be 525 vehicles, primarily during the AM and PM commute periods. Train volume is between 25 and 30 trains per day. 5. Funds have been allocated for constructing grade crossing warning devices through an agreement between Weld County and CALPINE,who will be constructing the power plant. 6. The scope of the project is to construct flashing light signals and gates, in accordance with the requirements of the Manual of Uniform Traffic Control Devices, at the existing at-grade crossing. Current protection of the existing crossing is by crossbucks and stop signs. The existing crossing surface consists of precast concrete panels and is 32' wide. No change in the crossing surface is included in the project. 7. The cost of construction of the Project will be borne entirely by the County. Maintenance of the signal installation will be by the Railroad. 8. Commencement of construction of the Project is anticipated to occur in July, 2002. Completion of the Project is anticipated to occur within three weeks of commencement. 9. No disruption of Railroad train traffic will occur. The installation will not affect the track speed or usage. All warning devices including advance warning signs will be installed in accordance with the Manual of Uniform Traffic Control Devices. 10. The installation of the signals will be in accordance with the specifications of the Public Utilities Commission and the Burlington Northern and Santa Fe Railway Company. 11. Applicants will be responsible for coordinating with affected utility companies to avoid or resolve any conflicts or concerns they may have. 12. Applicants will be responsible for acquiring all necessary rights of way, licenses or easements. 13.
