O. BOX 840 , DENVER, COLORADO 80201 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 17th day of September, 1980 at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Public Service Company of Colorado, P. O. Box 840 , Denver, Colorado 80201, for a Special Use Permit for transmission line and substation, and WHEREAS, Public Service Company of Colorado has present five alternate routes which are identified as Alternate Route #1; Alternate Route #2 ; Alternate Route #3 ; Alternate Route #3 A; and Alternate Route #3 B. The description of land within which the possible routes could pass is described as follows : Sections 1 through 20 , Township 2 North, Range 64 West Sections 25 , 26 and 31 through 36 , Town- ship 3 North, Range 64 West Sections 1, 2 , 11 through 15 and 22 through 27, Township 2 North, Range 65 West Sections 35 and 36 , Township 3 North, Range 65 West WHEREAS, the petitioner was present and recommended that the Board of County Commissioners approve Alternate Route #3 , and WHEREAS , evidence was presented in support of the granting of the Special Use Permit for transmission line and substation and opposition was presented concerning said Special Use Permit, and WHEREAS, Section 3 . 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon appro- val by the Board of County Commissioners, and 3337:J' r WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a transmission line and substation using Alternate Route #3 conforms to the purposes of Section 3 . 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Pub- lic Service Company of Colorado for a Special Use Permit for a transmission line and substation using Alternate Route #3 be, and hereby is, granted subject to the following: 1. The Development Standards contained in the Special Use Permit 2 . The route location will be submitted on a 24" x 36" mylar. The document shall also include certification to be completed by the Chairman of the Board of County Commissioners and a Certificate of Responsibility to be completed by the applicant. The standards and limitations approved by the Board of County Commissioners shall be affixed to the document. Upon completion of the document and signatures, the document shall be filed with the Weld County Clerk and Recorder. 3. The applicant shall locate substations and control ponds beyond the 500-year floodplain, which is estimated to be approximately 1,200 feet each side of the channel at section line 24-25, Township 2 North, Range 65 West. 4 . A deflection pole may be placed by the appli- cant in front of any tower poles near the channel. These poles will protect the towers from debris and flood forces in times during flooding. The deflection pole should be approxi- mately 10 feet in front of the town and 8 feet in height. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Weld County Planning Commission recommendations dated September 2, 1980 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. Mr. Von Feldt questioned item #4 of the Planning Commission' s recommendation, regarding the deflection pole in front of the towers for flood protection. In Mr. Von Feldt' s opinion this would only cause addition dammage to the land, inconvenience and problems for the landowners. There were several area residents present, some of whom testifyed against this request or asked questions regarding same. Following the testimony and discussion Commissioner Steinmark made a motion to accept the Planning Commission' s recommendation, conditions and development standards for alternate #3. Commissioner Dunbar seconded the motion. Discussion was held regarding item #4, deflection poles. Mr. Honn suggested the word "shall" be changed to "may" . This would allow Public Service Company and the individual landowner to determine whether the deflection poles would be installed in the floodplain area. . Commissioner Steinmark amended her motion to include this change. Commissioner Dunbar concured with the amendment. This route is the corridor preferred by the applicant. The Planning Commission concurs with the conclusions reached by the applicant as identified in the report entitled, Hudson Substation to Coors Coal Mine Transmission Line and Substation Site Selection Study, July 1980. This report examines the five different alternative routes in detail setting forth the reasons why Alternative route ,',`3 is preferred by the applicant. It is the opinion of the Planning Commission that this route corridor will : a. Have the least impact on agricultural operations ; b. Keep visual impacts to a minimum; and c. Meet the intent of the proposed Weld County Utility Plan. The applicant has indicated that the construction of the transmission system will be accomplished in the most economical manner which will be consistent with the Company' s responsibilities to keep energy costs to a minimum, while at the same time considering the overall environmental effects of its transmission systems . In this area it would defer to the experience of the Utility Company to use a method that will control erosion as the area is highly susceptible to all types of erosion. 3. The Brighton Soil Conservation District has set forth no objections to the request provided the recommendations contained in its letter of August 25, 1980 are followed. 4. The Weld County Engineering Department has set forth no objections to the request provided the applicant complies with the conditions as outlined in its memorandum dated August 20, 1980. These items are addressed in the attached Development Standards. The Planning Commission' s recommendation for approval is conditional upon: 1. The attached Devleopment Standards being approved for the request. 2. Subsequent to the Board of County Commissioners route approval , the route location will be submitted on a 24" x 36" mylar. The document shall also include certification to be completed by the Chairman of the Board of County Commissioners and a Certicate of Responsibility to be completed by the applicant. The standards and limitations approved by the Board of County Commissioners shall be affixed to the document. Upon completion of the document and signatures, the document shall be filed with the Weld County Clerk and Recorder. 3. The applicant shall locate substations and control ponds beyond the 500-year floodplain, which is estimated to be approximately 1,200' each side of the channel at section line 24-25, (T2N, R65W) . 4. A deflection pole shall be placed by the applicant in front of any tower poles near the channel . These poles will protect the towers from debris and flood forces in times during flooding. The deflection pole should be approximately 10 feet in front of the tower and 8 feet in height. The Public Service Company' s proposed transmission line does cross the Boxelder Creek floodplain. However, the flood hazards to, and created by, the transmission line will be minimal provided: 1. Sub-stations and control ponds are located beyond the 500-year floodplain, which we estimated to be approximately 1200 ' each side of the channel at section line 24-25 . 2. A deflection pole is placed in front of any tower poles near the channel. These poles will protect the towers from debris and flood force in times of flood. Our concern with Public Service Company's first choice of alternate Route 3 is that the transmission line section is located in the Box Elder Creek floodplain. The factors that should be addressed by PS Company are: the possibility of bank erosion at the base of the towers and the build up of debris behind the transmission structure. Extensive erosion may cause water quality problems downstream as well as damage to the transmission line. Debris buildup may cause ponding of water and consequently, upstream flooding. We recommend that these potential constraints be investigated by qualified personnel and the necessary mitigating measures adopted. The alternate #3 or preferred route is also recommended, primarily because it follows an already established easement and therefore will require only a small amount of land to be dedicated for utilities. They have requested that Public Service Company pro- vide them with the necessary electric energy to serve this coal mining project. The electric motors and the overall electric energy requirements needed to operate the draglines and other equipment used in the open-pit operation, are too large for Public Service to serve from its existing 13,000 volt system. It is, therefore, necessary and beneficial that Public Service improve its present facilities and construct a new electric transmission line and related substation to provide the necessary service to Coors and to maintain reliable service to the overall area. PROJECT DESCRIPTION Public Service Company of Colorado proposes to locate, construct, operate and maintain a 115,000 volt, overhead electric transmission line from its Hudson Substation, located approximately three miles north of the town of Hudson, to a new 115,000-13,000 volt substation to be located in Section 36, Township 3 North, Range 64 West, approximately four and one-half miles north of the town of Keenesburg. The entire line route and the new substation are to be located in Weld County, Colorado. The project involves the identification of a preferred transmission line route, acquisition of the necessary rights-of-way and land rights, and the con- - struction of the electric transmission line and substation. Exhibit 1 identi- fies the location of the project area and its geographic relationship to surrounding communities. PROPOSED ACTION Transmission Line: The proposed facility will be constructed on 60 to 80 foot wood H-frame structures using fiberglass to support the conductors. Span lengths will range from 600 to 775 feet and a minimum ground clearance of 30 feet will be maintained along the entire line. The corner structures will be single pole, vertical-type configuration. There will be three distinct structure types used on this project as shown on Exhibits 2, 3, and 4. The capacity of this line will be 115,000 volts capable of carrying 145 MVA of — power. The conductor size will be 477 kcmil ACSR, and is 0.858 inches in diameter and the overhead ground wire will be 3/8 inches in diameter and is a 7-strand steel conductor. 1 Coors Coal Mine Substation: This will be a 115,000-13,000 volt sub- station with a transfirmer, associated switchgear, supporting structures, conductors, and necessary protective equipment. The substation will be fenced and is to be located on state-owned lands. Exhibit 5 is a general arrangement drawing of the substation. Right-of-Way Acquisition: The right-of-way to be acquired will vary from 45 to 75 feet in width. Wherever the line parallels existing roads, the narrower widths will be acquired. The National Electric Safety Code requires that minimum side clearance be maintained and by paralleling roads, this re- _ quirement is met for one side of the line. Right-of-way markers will not be used and new gates that are required will be locked in series with the land- owners locks. Negotiations are scheduled to commence on October 1, 1980. Each land- owner will be contacted in person whenever possible and out-of-state owners will be contacted by mail and telephone. The necessary rights-of-way will be acquired under the terms and conditions of the Company's standard form easement. See Exhibit 6. Construction: The construction of the facilities will commence as soon as the land and land rights are acquired, which will be approximately February 1, 1981. Winter construction in this area is preferred to help reduce the potential for property damage. If the Company can take advantage of frozen ground, it has been experienced that field damages can be kept to a minimum. If winter conditions are too severe, or right-of-way negotiations are delayed, then con- - struction will commence as soon as possible. The work force will consist of approximately 35 to 40 people . Because of the proximity of the project area to Denver, the workers will probably live in the Denver area and commute to the site. Construction is expected to take approximately four months. After construction and clean up are completed, the right-of-way will be inspected for any property damages, and repairs will be made or payment made to property owners, whichever is appropriate. A Public Service Company right- _ of-way agent will be identified so that landowners can contact this person should any problems arise during construction or after the line is placed in service. The right-of-way will be reseeded, if necessary, and other soil erosion control measures will be implemented. The Company has utilized outside services for recommendations on proper soil erosion control techniques on most of its projects. Exhibit 7 is a sample of the mitigation measures used on the power- line built in 1979 to serve the Hudson Substation. The results of this program have been excellent and similar techniques will be used on this project. Maintenance Activities: The powerline will be patrolled on a routine basis approximately once every six weeks. The line requires very little main- tenance, with insulator replacement being the most common problem as shooters use them for targets. Lupton - Hudson power transmission line facility was made on March 8 , 1979 , to make observations from which recommendations could be made concerning considerations that should be given in developing and implementing an erosion control and soil stabilization plan following construction of the above described facility. Mr. Sam Dunham of Public Service Co . of Colorado accompanied me on the site evaluation visit . Based on the field investigation, the following situations were found to exist which should be considered in formulating an erosion control and soil stabilization plan. 1 . Several steep, windward facing . knolls that occur between structures 52 and 56, and which had been traversed by vehicles parallel to the slope pose potential for "blowouts" . 2 . It appears that except for location of several poles the remaining traffic areas and/or fixture locations are located on landscape positions and/or in areas where vegetative cover is sufficient that wind erosion potential is minimal . A portion of the facility occurs on cultivated areas where the erosion potential will be a function of farming activities and cannot be assessed adequately with- - out knowing future farm activities . There are several pole fixtures located on windward knoll landscape positions around which wind erosion poten- tial is high. 3 . Ruts caused by heavy equipment were noted to be rather deep (8-10" ) in some places . 4. Potential for water erosion was observed in one area . This area being on a steep slope to the north of fixture 11 . At this location, the road runs parallel , (up and down) a steep slope where it appears the soil conditions are such that the wheel tracks are highly compacted . This situation could give rise to rapid runoff with the result that gullies could form. It appears unlikely that this will happen , however, this area should be kept under observation and if a problem arises, it is recommended that the wheel track be chiseled at a depth of 6 to 8 " to improve water infiltration. Recommendations: 1 . For areas between Fixtures 52 and ,56: As stated previously, there are several windward knoll landscape positions loco ' ' between these fixtures which have been traversed by v :.lcles and the amount of disturbance is sufficient to cause serious potential wind erosion problems . I recommend that these areas be _ mulched either with manure , straw or hay at a rate of 30 tons/acre . The area should not be disturbed further as this will destroy any existing vegetative cover. If straw and/or hay is used as a mulch it should be anchored by jabbing the material into the soil using a dull edged shovel or Spade. The size of the affected areas are small and the stabilization effort could be carried out by hand. In addition, I would recommend seeding the area with _ the following seed mixture : . Prairie sandreed at 10 pls (pure live seed/sq . ft . ) Sand bluestem " 4 Blue grama " 4 " Western wheat grass 4 " (Thickspike or Sodar wheat- grass could be used) Sand dropseed " 1 Indian rice grass 1 Sideoats grama " 1 Little Bluestem " 1 The seed should be broadcast prior to mulching. Although it would be desireable to incorporate the seed into the ground , I would not recommend drilling or using normal seeding equipment because of the amount of addi- tional disturbance that would occur. I feel that broad- - casting the seed and then mulching and then allow for natural succession of growth would be most adviseable . _ This same seeding and mulching procedure could be considered at the "fence-gate" location where a high knoll like bare soil situation occurs . Seeding activities should be carried out before mid-May. 2. Stabilization around Pole areas located on high wind erosion potential areas . Since it is not desireable to have extensive vegeta- tive growth immediately around the pole because of fire hazard and also because livestock which mill around poles would tend to destroy any vegetation that might be established , it is recommended that either these areas be mulched with gravel , straw, manure or sod remnants . Straw , hay or sod remnant mulches should be applied at a rate of 30 to 40 tons/acre . If straw and/or hay are used , the mulch should be anchored in the soil . The gravel mulch should be comprised of course gravels and small cobbles ( 1-2 inches in size) and a cover of 2 to 3 inches in thickness should provide the lci.„;est protection. The other mulches would probably provide protection of only 2 to 3 years or less . Another alternative would be to apply dry cement to the disturbed area, then rake into the soil to 'a depth of 2 to 3 inches , and then sprinkle with water to wet to _ this depth. Although I have no data or experience to indicate that this would be an effective practice , I feel that the ultimate result would be the formation of rela- tively stable aggregates . This procedure may be less costly than obtaining or transporting other types of mulch materials . Also , I feel it wouldprovide protect- ion for a relatively long period of time . Another approach to minimizing livestock activity around the pole would be to provide "oil rubbing" facili- _ ties and salt blocks at various locations in a pasture . This would encourage animals to stay away from the poles . In addition to potentially decreasing wind erosion from around the poles themselves , it would serve as a good range management practice if the "rubbers" and salt sources were strategically located . Perhaps this pro- cedure could be pursued with the respective ranchers and carried out cooperatively. 3. Treatment of Roads Although ruts caused by vehicles are deep ( 8-10" ) in places, it would not be adviseable to level or grade these areas following construction. A basic principle in wind erosion control is to minimize the size of any smooth, bare or unprotected areas , particularly if these areas are on a windward knoll and/or are in the direction of prevailing winds . I would recommend that these areas not be disturbed further. 4. Seed Sources Suggested seed sources for the species identified are: Northrup King Seed Longmont , Colorado or Sharp Brothers Healy, Kansas • SECTION II PROJECT ALTERNATIVES No-Action The most obvious alternative to the proposed action would be to not do it at all. The advantage of a no-action alternative is that there would he no further effects to the agricultural environment and the visual quality of the area would not change. This advantage, however, must be measured against the electrical needs of the consumers in this area and the resulting impacts on the human environment which will occur if no action is taken. A no-action alternative was considered to be detrimental to the health, _ safety and welfare of the Weld County citizens in this area and was not con- sidered appropriate. The legal obligation and responsibility of the Company in providing service to its customers further rules out this alternative. Construct a New 230,000 - 13,000 Volt System Consideration was given to installing a new substation in Section 11, Township 2 North, Range 64 West, under the existing Public Service Company 230,000 volt transmission line and then constructing a 13,000 volt distribution line approximately one and one-quarter miles north to the coal mine project. The major advantage of this alternative is the close proximity of the facility to the proposed Coors Coal Mine Substation. This alternative was determined to be unacceptable for the following reasons: 1. 230,000-13,000 volt transformers and associated equipment are not common items in the Company's electric system. The more _ common transformation is 115,000-13,000 volts. The Company, therefore, has a large inventory of 115,000 volt equipment including a portable 115,000-13,000 volt transformer but has no 230,000-13,000 volt portable transformers. In the event of an outage due to a transformer failure, it would not be possible to restore service on the 230,000 volt system without a lengthy delay. The delivery of a 230,000-13,000 volt trans- - former could take up to one year. 2. The existing 230,000 volt transmission line is a bulk-power tie line between two of the Company's major generating plants, Pawnee, near Ft. Morgan, and Ft. St. Vrain near Platteville and is a critical link in maintaining the stability and relia- bility of the Company's overall, state-wide, electrical system. It is a fundamental design concept, if at all possible, not to jeopardize the ability to move large quantities of bulk power from one part of a service area to another by tapping these major transmission facilities. 3 3. The 115,000-13,000 volt system is the normal service provided to large customers by Public Service Company. This alternative was rejected because it would reduce reliability of service to customers, create system stability problems and would result in long outages in the event of a transformer failure. Tap Western Area Power Administration's Prospect Valley 115,000 Volt Line The Prospect Valley 115,000 volt line, owned and operated by Western Area Power Administration, is located approximately five miles east of the proposed Coors Coal Mine Substation. This line taps Western's Rosedale-Beaver Creek line which extends from Greeley, Colorado to Brush, Colorado. Tho major disadvantage of this alternative is that the line has inadequate capacity and it would be necessary to upgrade this system and to install necessary protective equipment to maintain reliable service. This alternative was rejected because the upgrading of the existing facilities would be more costly due to the length of the lines and the need for installing protective equipment at various substations. Construct a New 115,000 Volt System - Preferred Action At the present time, the Company owns, operates and maintains an elec- tric substation (Hudson Substation) located in the SE1/4 of Section 22, _ Township 2 North, Range 65 West. This substation is served power by way of a 115,000 volt overhead transmission line that is a tap line from the Company's Ft. Lupton-Greeley 115,000 volt transmission line. The Company proposes to install the necessary electrical equipment at its present Hudson Substation and construct a new overhead 115,000 volt line to the proposed Coors Coal Mine Substation where the voltage will be reduced from 115,000 to 13,000 volts to serve the customers' power requirements. The advantages of this alternative include the following: 1. The point of origin for the line would use an existing sub- - station facility. 2. The facilities can be constructed and in operation within the project's time requirements. 3. The Company maintains an inventory of most of the equipment to be used, including a portable transformer, which will — prevent long outages due to equipment failures. 4. The integrity of the 230,000 volt bulk power transmission system will not be impaired. 5. This system will provide the most effective reliability of service to all consumers while maintaining system stability. The disadvantages of this alternative include the following: 1. It is the longest line route when compared with constructing a new 230,000 volt system or tapping the Prospect Valley Line as discussed above. 4 2. Associated with the longer line route is the potential for increasing the effects on the visual environment and agri- cultural operations. 3. This alternative involves the most landowners. Upon careful consideration of the advantages and disadvantages of each of the alternative actions, it has been determined that the last suggested alternative, construct a new 115,000 volt system, is the most viable alterna- tive that will satisfy the needs and objectives of the proposed project in an economical manner while maintaining the highest degree of reliability. It is the Company's conclusion that this alternative can be accomplished in a manner that complies with all applicable land use regulations, and particularly with the intent and purpose of the proposed Weld County Public Utility Plan. 5 SECTION III PROJECT AREA DESCRIPTION The project area is located north of Interstate 76, extending from Hudson, Colorado to Keenesburg, Colorado, and contains approximately 43 square miles, all situated in Weld County, Colorado. The major towns are Hudson, population 518, and Keenesburg, population 427, both agricultural communities. Major irrigated crop production in this area includes corn, sugar beets, alfalfa, and onions. Lawn turf is also grown. Winter wheat is the major _ dryland crop, while grasslands are used for cattle and horse grazing. Pork, beef, milk, chickens and egg production round out the major agricultural activities. Farmlands are irrigated primarily from deep wells and associated ditches or rotary sprinkler systems. Box Elder Creek, also known as Running Creek, is the major drainage basin and forms a part of the South Platte River system. The Creek is mostly dry in the area, although in some locations there is running water which is mainly return flow from irrigation activities. The Box Elder Creek floodplain is used extensively for a variety of agricultural purposes. The Soil Conservation Service reports that the soils consist mostly of Valent sand, Vona loamy sand, Loup-Boel loamy sand, Osgood sand and Olney loamy sand, all of which are associated with the Box Elder drainage and the sandhills. The semi-arid nature and frequent high velocity winds of the region result in land forms being developed from blowing sands . Topographic variety is lacking because the elevation ranges from 4830 to 5030 feet, with the lower elevations being found in the north one-half of the area. The variety in topography is best expressed along the Box Elder Creek drainage. Coal, oil and gas all occur naturally within the area. The coal deposits are part of the Denver Basin Region which has been described briefly by the Colorado Geological Survey in its Special Publication No. 3, 1972 Summary of Coal Resources in Colorado. There are also a number of underground pipelines — throughout the area extending, in part, from the Panhandle Eastern Compressor Station located in the Southwest corner of Section 23, Township 2 North, Range 65 West. Natural vegetation is limited to grassland and sandhill species of grasses, forbs and shrubs. Some of these include blue grama, buffalograss, sagebrush, and soapweed. Deciduous trees are found along the Box Elder drainage. The Colorado Division of Wildlife confirmed that there are no known critical habitats, endangered species or wildlife refuges in the project area. 6 Wildlife includes a variety of birds, waterfowl, rodents and antelope. The antelope, lark bunting, meadow lark, other small birds and some raptors were spotted during field trips. Public Service Company has been instrumental in assisting the Edison Electric Institute in developing powerline designs that protect raptors from possible electrocution. As a result of this work, an EEI report was published in 1975 entitled Suggested Practices for Raptor Protection. LINE ROUTE SELECTION CRITERIA The area was studied for possible line routes by making aerial and ground surveys, using recent aerial photographs, U.S.G.S. maps and input from a public meeting which was held in Keenesburg on July 15, 1980. The study area has a high degree of similarity when agricultural uses, vegetation types and topographic relief are analyzed. Consequently, since the transmission line is relatively short, a wide variety of alternative routes and sub-alternative routes are available. To reduce the analysis to a reason- able number of alternatives, most weight was given to public input, the pro- posed Weld County Utility Plan, and to selecting routes across those lands where agricultural uses are less intensive, while at the same time considering the visual affects on the surrounding area. The following land use concerns, defined in the proposed Weld County Public Utility Plan, are common to each of the alternative routes which were analyzed. Mineral Resources: The proposed action will not have an effect on the mineral resource areas and, as this project points out, powerlines are required to utilize mineral resources. Where conflicts might occur in the future, the powerline could be relocated to accommodate the extraction of these resources. The cost for such relocation is borne by the developer. Wildlife Habitats: There are no critical habitats in the study area; however, disturbances to the grasslands and sandhills in the areas that support wildlife will be kept to a minimum and all disturbed areas will be reseeded. Tree clearing, if any, will be limited to topping as opposed to clear-cutting. Historical and Archaeological Resources: The proposed action will not of?t any known historical sites. Archaeological sites, if any, will not be disturbed. There is a remote pos- - sibility of sites being identified during the digging of holes at the pole locations. If this occurs, appropriate action will be taken to evaluate the significance of the sites and appropri- ate mitigation measures will be undertaken. Qualified archae- ologists will be used to make these determinations and to recommend mitigation measures. The Company, in the past, has used the University of Northern Colorado for this type of work. Geologic Hazards: There are no known geologic hazards in the study area that would prohibit the construction of the powerline or substation. 7 Landowner Input: A notice of the information meeting was pub- lished in the Keene Valley Sun in July. See Exhibit 8. In addition to the public notice, an invitation was extended to the seventy landowners in the study area. Of these, twenty-five invitations were mailed, and forty-five invitations were handed out personally by a Public Service Company right-of-way agent. Exhibit 9 is a copy of the invitiation presented to the land- owners. The following is a summary of the results of the information meeting. The meeting was held on Tuesday evening, July 15, 1980, at the American Legion Hall in Keenesburg, Colorado. Those in attendance included five representatives from Public Service, two representatives froth Coors and twenty-five landowers. The Company described the scope of the project, the need for upgrading its facilities, construction techniques to be used and right-of-way acquisition procedures. The Company then invited comments from the public. No route was presented since none had been preselected. The pur- pose of the meeting was to identify landowner concerns before analyzing alternative alignments and selecting a preferred route. The following is a summary of the con- cerns and issues which were expressed by the landowners. _ 1. Where would the line be located in relationship to land lines? 2. Safety of the line and its effects on health? 3. How would easement values be determined? 4. The most frequently expressed concern related to the method used for handling payments for damages that occur during construction and maintenance. 5. Would reliability of electric service be im- paired by the Coors operation? The following is a summary of the responses to the above concerns: la. The line will be located parallel with land lines and adjacent to existing roadways whenever possible. Diagonal alignments will generally be avoided because of strong landowner objections to such routes. Specific landowners, however, may request such a location across their lands to meet their particular needs. This request may come about during negotiations for the right-of-way. 2a. The line will be constructed to meet or exceed the standards established by the National Electric Safety Code. There are no known health hazards associated with electric transmission systems at this voltage level. Even at higher voltages there is no substantive evidence available that indicates or proves that powerlines have adverse health 8 effects upon the human environment. 3a. Easement values are determined on the basis of a percentage of the fair market value of the land taken plus payments for any damages to the re- _ mainder. Negotiations are conducted with each landowner and each parcel is evaluated on its own merits. Payment is made on the day negoti- - ations are completed. 4a. A Public Service Company representative, usually the same person who negotiated for the rights-of- way, is responsible for maintaining contacts with the property owners during construction. If damages occur, such as crop damage, the matter is settled with the property owner. Occasionally, payment is made to the landowner to correct any problems. An example would be the need for plowing a field that has become compacted during the construction of the line. See Exhibit 6 and please note the clause regarding care of property which has been underlined. 5a. The proposed action will assure that reliability of service will be maintained or improved. The landowners were advised of the system design and the fact that the proposed action was selected because it provides the most reliable system of all the alternative actions which were considered. Alternate Structure Designs: Single wood pole construction was con- sidered; however, this type of structure would require shorter span lengths and is not as reliable as the H-frame construction proposed in this action. The photograph of the damaged line illustrates what can happen to single pole lines. See Exhibit 10. This photograph was taken looking east to Kersey Road along the existing line. While H-frames are also susceptible to storm damage, they are capable of withstanding stronger winds and greater ice loadings than single wood poles. Single-shaft steel poles were also considered but the high cost of this structure type made it economically unfeasible. The single wood pole installed, cost is $3300 as compared to $8000 installed cost for each steel pole. Self-supporting steel angle structures cost $32,000 as opposed to $6000 for a vertical corner dead-end, guyed, single wood pole. The installed cost for an H-frame is approxi- mately $2500. Use of County Road Rights-of-Way: The proposed Weld County Utility Plan suggests that road rights-of-way be utilized, whenever possible, along with the single pole construction. As stated previously, the single pole system was found to be less reliable than H-frames. The use of this structure type precludes the use of road rights-of-way. It may, however, be possible to utilize the existing road rights-of-way for guys and anchors at the vertical corner dead-end structures. Consideration was given to the following alternatives which were suggested in the Utility Plan and which arc also standard design procedures for Public Service Company 9 when siting transmission lines. 1) Use of section, half-section and quarter-section lines 2) Use of property lines 3) Use of field fence lines 4) Use of drainage ways 5) Use of wasteland areas 6) Use of field roads 7) Use of ditch banks 8) Use of other areas that reduce conflicts Each of the above alternatives must be carefully analyzed and checked in the field to avoid conflicts . For example, farm dwellings are fre- quently located adjacent to land lines or the use of ditch banks may not be feasible if both sides are required for ditch cleaning. Building the line along Kersey Road provides better access for construction and maintenance, which in turn decreases the potential for property damages. Following the existing 230,000 volt route also utilizes an existing utility corridor and reduces right-of-way requirements. The location of this route is also primarily on grasslands. — Disadvantages This alignment would make the line highly visible to a number of homes along Kersey Road as well as for the general public using this road. There is a possibility that Kersey Road could be widened in the future which would require either rebuilding or relocating the line to avoid conflicts. The next two miles extends north and is approximately one-quarter mile west of Kersey Road which minimizes the visual effects of the line from the main view along Kersey Road. The line _ would be located along the lower terraces of Box Elder Creek to take advantage of some topographic variety. Paralleling the existing 230,000 volt route for the next four miles, the new line would utilize the existing corridor and would thus reduce right-of-way requirements. 15 Alternate Route #3 (cont.) The location of this route is primarily on grasslands and avoids the single family residence in the NE1/4 of Section 24, Township 2 North, Range 65 West. Disadvantages The major disadvantage of this route compared with the other alternatives, is that for the two miles extending north, it would be bisecting an ownership. Additionally, utilizing the lower terraces of Box Elder Creek to maintain the visual quality of the area, places the line in a location that has the potential for causing damage in the event of a major flood in this drainage basin. It then intersects with Alternate 3. Disadvantages This route has at least four more angle corners than any of the other routes with the resultant need for more guys and anchors. In examining alternative routes, it was impossible to avoid agricultural lands, therefore, every effort was made to locate the powerline on non-cropland areas since farming activities are less intensive in these areas. The — proposed action accomplishes this objective. The visual impact is unavoidable because of the overall landscape setting. The grassland and sandhill areas lack both vegetative and topo- - graphic diversity and it is not possible to site the line to keep it from view. To reduce the visibility of the line in this area, it was located along the lower terraces of the Box Elder Creek drainage to avoid paralleling — Kersey Road. This road carries the most traffic in the project area and most of the single family homes are located along this road. Additionally, the decision to rebuild a portion of the existing distribution line and paral- leling the existing 230,000 volt line further helps to reduce the visual — effect. 22
