RESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH #2309 - JAIME RINCON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 24th day of June, 2002, considered the request of Jaime Rincon, 17650 Weld County Road 74, Eaton, Colorado 80615, fora mobile home to be used as a principal dwelling, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot 9 and part of Lot 10, Block 3, East Side Addition; located in Section 31, Township 7 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 and 2 stated above. 4. All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 5. Derelict manufactured (mobile) home: a manufactured (mobile) home that is partially or totally damaged by fire, earthquake, wind, or other natural causes, or is in a state of general dilapidation, deterioration, or decay resulting from improper lack of maintenance, vandalism, or infestation with vermin or rodents. Any such derelict manufactured (mobile) home shall be returned to and maintained in the condition as originally established on site and as inspected by the Weld County Building Inspection Department, or it shall be removed from the site. 6. Wall Street is designated on the Transportation Plan Map as a paved road in East Eaton, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of setback in the Section 23-3-50 of the Weld County Code, the required setback is measured from the future right-of-way line. 8. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-10 of the Weld County Code. 9. The applicant shall maintain compliance with Section 23-4-200 of the Weld County Code at all times. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Jaime Rincon for permission to place a mobile home to be used as a principal dwelling on the above described parcel of land, which was found to be in compliance with Chapter 23, Article IV, Division 3 of the Weld County Code, be, and hereby is, granted subject to the hereinabove listed conditions. The mobile home will be placed in an Agricultural subdivision to be used as a principal residence and will not interfere with agricultural uses. c. Section 23-4-200.3-There is available water and sewage disposal facilities for the mobile home. The applicant has public water with East Eaton and Water Sanitation. d. Section 23-4-200.4-The general health, safety and welfare of the inhabitants of the area and the county will not be jeopardized or compromised by the location of the mobile home on this site. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. This project falls primarily under the purview of the Zoning Permit for Mobile Home Standards. Our comments and requirements are as follows: COMMENTS: Wall Street is designated on the Transportation Plan Map as a paved road in East Eaton,which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within municipalities or other counties that access Weld County roads are also subject to this policy.
