HomeMy WebLinkAbout841216.tiff RESOLUTION RE : APPROVE AMENDMENT TO RECORDED EXEMPTION NO. 233 - NICK SEKICH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on December 6, 1976 , the Board did, by Resolution, approve Recorded Exemption No. 233 , and WHEREAS , Nick Sekich is requesting an amendment to said Recorded Exemption No. 233, and WHEREAS , said amendment would change the size of Lot A from 189. 393 acres to 76 acres, more or less, with the remainder of the 113 . 382 acres being considered a separate legal lot meeting the minimum lot size requirement of 80 acres irrigated land, and WHEREAS , the parcel of land for which this request is being made is described as the East 1/2 , Section 14 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and, WHEREAS , the Board deems it appropriate to approve the amendment to Recorded Exemption No. 233 for Nick Sekich on the above described parcel. NOW, THEREFORE , BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the above mentioned amendment to Recorded Exemption No. 233 requested by Nick Sekich on the hereinabove described parcel of land be, and hereby is approved, subject to the following condition: the applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Sec- tion 9-2C. (4) of the Weld County Subdivision Regulations. The parcel of land on which this request is being made is described as East 1, Section 14, T3N, R68W of the 6th P.M. , Weld County, Colorado. The request is to amend Lot A Recorded Exemption 233 from 189.393 acres to 76 acres more or less. The remainder 113.382 would be considered a separate legal lot because it meets the minimum lot size requirements (80 acres irrigated land) . Lot B of the original recorded exemption would not be affected by the proposed amended recorded exemption. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: oni 1. We are requesting that parcel A be amended to 76+ acres. Parcel B of RE: 233 will remain as a 5+ acre tract. Part of parcel a (113.382+) acres was sold to Herbert Miller on March 14, 1977. This parcel was greater than thirty-five acres and the seller did not realize it was necessary to amend the origional recorded exemption. The 113,382+ acres is irrigated and presently used for crop production. There are no improvements on the 113.382+ acres. The remainder of parcel A is 76.01x- acres. This acreage is owned by Nick Sekich and is presently in crop production. There are no improvements on the 76.01+ acres. If the amended recorded exemption is approved, it is the intent of the Sekiches to split the remainder of parcel A by utilizing the recorded exemption procedure. Parcel A was orginally 2 farms the 113.383 was bought by Mike Sehich and sold off to Herbert Miller, which was a farm by itself. Thank You.
