INC Respondent: WELD COUNTY BOARD OF COMMISSIONERS Motion to Hold Case in Abeyance Petitioner,Kitayama Bros. Inc,through their appointed representative,moves the Board of Assessment Appeals to hold this case in abeyance for the reasons set forth herein: 1. This case is set for a hearing before the Board of Assessment Appeals on October 22,2002 At 10:00 AM. 2. The property that is the subject of this case is greenhouse property. 3. A principal issue at the hearing will be the proper classification and valuation of greenhouse property. 4. A notice of Appeal of a recent Board of Assessment Appeals decision affecting the classification of greenhouse property for valuation purposes has been filed. That case is Adams County Board of Equalization v. Welbv Gardens,et al., Case No. 01 CA 307. This case has been further appealed to the Supreme Court. 5. To avoid duplicative appeals and for purposes of judicial economy,the petitioner requests that the present case be held in abeyance pending the final outcome of the Welbv Gardens appeal. ASO(E.;d al"; 09, AS 2002-2338 6. Neither party should be prejudiced by an abeyance. WHEREFORE,the Petitioner respectfully requests that the Board of Assessment Appeals order that this case be held in abeyance pending the final resolution of the Welby Gardens appeal, and that the hearing scheduled for October 21, 2002 be continued.
