GUTIERREZ C/O ARIEL 11 cDATE RRE 04/19/2002 COLORADO CC: Environmental Health Services has reviewed this proposal for a commercial rodeo arena. We have no objections to the proposal, however,in reviewing the application we observed that the applicant is proposing portable toilets to be used. The proposed sewage disposal facilities does not comply with the Weld County Code (30-2-10). The Weld County Code states that the owner shall supply an adequate, convenient, sanitary toilet and sewage disposal system where people live or work or congregate. In addition, this application requires the use of a well designated as "commercial" or a !" community water system. The applicant has a well designated as "domestic"only. The applicant has indicated a commercial well is unfeasible due to excessive costs and that bottled water will be utilized as the facility's source of water. We do not believe that bottled water is an adequate source of water for this type of operation. Since handwashing is considered necessary to stopping the spread of disease a permanent water source would be warranted. We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health & Environment, for approval prior to operation. 2. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations.The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 3. The applicant shall submit a manure and stormwater management plan to the Weld County Department of Public Health and Environment for review and approval. The plan should describe how manure generated on site will be :1-71--- 2002-1915 / stored, managed, removed, land applied, etc. The plan should also describe the fate of any stormwater that may come into contact with manure. 4. The applicant shall submit evidence to the Department of Planning Services, from the Colorado Division of Water Resources, demonstrating that the well(s) are/is appropriately permitted for the commercial use or that a community water system is available. We recommend that the following requirements be incorporated into the permit as development standards: 1. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 2. The facility shall maintain compliance with the Confined Animal Feeding Operation Regulations (5 CCR 1002-19). 3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility and disposed by a commercial hauler. 7. Fugitive dust shall be controlled on this site. 8. The facility shall be operated in accordance with the approved dust abatement plan at all times. 2 9. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 10.The applicant shall operate in accordance with the approved "manure and stormwater management plan". 11.Adequate toilet facilities shall be provided for employees and patrons of the arena. 12.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 13.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 14.The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. 15.The facility shall be operated in a manner to control flies. Our comments and requirements are as follows: COMMENTS: WCR 8 is designated on the Transportation Plan a collector status road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. !"Western Drive is a part of the Vantage Acres Subdivision and is designated on the Transportation Plan Map as a local gravel subdivision road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. Traffic Counts: The average daily count (ADT) for WCR 8 at this location is 636 vehicles taken 3/15/1999. REQUIREMENTS: Access: The applicant identified an entrance and an exit from WCR 8. The Weld County Public Works Department is recommending one main access point from WCR 8 which is classified as a collector status road. If a culvert is required, a 15-inch CMP is the minimum standard size for the main access point. A stop sign shall be placed at the appropriate location prior to entering on to WCR 8. Off-Street Parking: The off-street parking including the access drive shall be surfaced with gravel or the equivalent. Adequate parking areas shall be placed on the plat for pickups outfitted with horse trailers and tractor trailers. The public parking areas shall also be shown on the plat identifying separate parking areas. There shall be no staging or parking on WCR 8. Utilize the internal parking lot. Storm Water Drainage: The parking lot shall be graded and drained in such a manner that there will not be an impact on adjacent property owners. Properly size the access culvert to accommodate drainage run-off from the parking lot. The Sheriff's Office would, however, like to be afforded the opportunity to help them design their arena and business so that it would be more safe and secure and less like to be victimized by criminal activity. I have no further comment. as MEMORANDUM WICTO: Sheri Lockman, Planner II COLORADO DATE: April 2, 2002 FROM: Kim Ogle, Planner III SUBJECT: USR 1383, Fernandez/ Gutierrez Landscape / Site Plan Review The Department of Planning Services reviewed the above referenced Use by Special Review Landscape/ Site Plan and offers the following comments: A Landscape Plan was not submitted with the application, however, in the descriptive text, the applicant states that trees may be planted for shade. The Department of planning Services requests the applicant provide a plant material list delineating the proposed species to be used, including a turf species if installed. Given the highly erodible and windblown soils found on site, it is highly recommended that the applicant contact the Weld County Extension office and the Platte Valley Soil Conservation Service office to formulate and implement a plan to control potential on-site and off-site dust problems. Landscaping materials as proposed in the Approved Landscape Plan shall be maintained at all times. Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time. All on site landscape treatment shall comply with Section 23-3-250.A.5.a and A.5.b of the Weld County Code. The arena parking area shall accommodate a minimum of sixty parking spaces as delineated in the application materials. Further, the applicant shall address all requirements of the American for Disabilities Act in future drawings. Typically, one of the two parking spaces shall be van accessible with an eight (8) foot aisle between parking spaces. The area for the non- ambulatory parking spaces shall be paved. In addition, a curb cut or ramped area from the parking area into the arena enclosure has not been delineated on the plat. All parking spaces shall have curb stops. Per Section 23-3-250.A.2, the applicant shall delineated sufficient screened off street paved parking areas unless waived by the Department of Public Works. Further, one off-street loading space is required for a facility of this size. All parking and loading areas shall be screened from adjacent properties and road rights-of-way. The applicant shall delineate an opaque visual screen on all sides of the property to mitigate the potential negative impact and aesthetic concerns on surrounding properties. Section 23-3-250.A.3 provides for adequate street access. The applicant shall demonstrate a safe and approved access. The proposed access gates into the arena area is gated and surrounded by a perimeter fence. n The internal circulation within the arena area is unclear. Future drawings shall delineate the proposed circulation pattern including emergency access. The aisle width and parking spaces shall conform with Chapter 23, Appendix A of the Weld County Code. Section 23-3-250.A.6 addresses the issue of trash collection areas. Areas used for storage or trash collection shall be screened from adjacent public rights-of-way and adjacent properties. These areas shall be designed and used in a manner that will prevent wind or animal scattered trash. Section 23-3-250.B addresses operation standards for Commercial uses. The applicant shall address the issue of on-site lighting, including security lighting in applicable. Subsection F. states "any lighting ... shall be designed, located and operated in such a manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties...." The applicant has not delineated any on-site sign(s). If an on-site sign(s) is desired, the signs shall adhere to Section 23-4-90.A and .B of the Weld County Code. One identification sign per principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet in area per face. Further, the location of the sign, if applicable shall be delineated on the Landscape/ Site Plan. All structures, including signs, on site must obtain the appropriate building permits. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation (access drive, parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera). The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. This violation is for the operation of a commercial roping/riding arena without an approved Use by Special Review Permit. This case was presented to the Board of County Commissioners for a Violation Hearing on February 12,2002. The Board of County Commissioners gave them an additional 60 days to submit a complete Use by Special Review permit. On March 6, 2002, Mr. Fernandez submitted a complete Use by Special Review (USR-1383) application for a commercial rodeo arena in the A (Agricultural)Zone District. Should this Use by Special Review (USR-1383) be approved and once a plat is recorded, this violation will be closed. If this Use by Special Review (USR-1383) is not approved,this case will be forwarded to the County Attorney's Office to proceed with legal action pending removal of the Rodeo Arena events.
