Councilman Dwaine Kurtz and Councilman Douglas Rademacher were present, constituting a quorum of the members. Councilwoman Jody Malone and Vice President Mitchell Martin were excused. Also present: Commissioner Geile, Commissioner Jerke, Commissioner Long, Commissioner Masden, Commissioner Vaad, Frank Hempen, Kevin arst, Chip Marks, Don Smock, Jennifer Stanley, Dr. Mark Wallace, Don Warden, the Council secretary, Bev Thomas. ?jaded PRESENTATION BY BOARD OF COUNTY COMMISSIONERS: Commissioner Vaad 01.04;e4 introduced introduced Weld County's Finance Director, Don Warden, to present Commissioner's ,drat request to increase the 5% growth limitation on the County's annual tax levy, an option provided for in Weld County's Home Rule Charter. Mr. Warden said that the Council's approval could provide $1,711,302 additional tax revenue, and it would not raise the county's mill levy or property taxes for 2003. The $1,711,302 would be used as follows: Public Works: Strategic Road Improvements $869,047 -for the development of needed arterial, north-south roads in Weld County - specifically improvement to Weld County Road 13. Municipal Share Back $292,255 West Nile Virus Response $550,000 - for an integrated mosquito management program, in conjunction with the county's municipalities, including a county-wide education program to reduce the risk of WNV causing human deaths in Weld County. Total $1,711,302 Commissioner Geile explained the County's Strategic Road Plan and how the increased tax revenue would benefit it. Dr. Mark Wallace outlined the proposed /;- -;260 2002-3132 + V Weld County Council Public Hearing Minutes November 19,2002 Page 2 of 2 integrated mosquito management program, and answered Council members' questions. Mr. Warden said that the Commissioners have taken the position that given the status of budgets at the state and federal level, Weld County will have to take care of WNV at the local level. It was noted that while the increase in the 5% limitation is not a tax increase, property taxes on a $150,000 home would decrease $9.70. ROLL CALL: The meeting was called to order by President Joyce Smock. Councilman Dwaine Kurtz and Councilman Douglas Rademacher were present, constituting a quorum of the members. Councilwoman Jody Malone and Vice President Mitchell Martin were excused. Also present: Commissioner Geile, Commissioner Jerke, Commissioner Long, Commissioner Masden, Commissioner Vaad, Frank Hempen, /Kevin Karst, Chip Marks, Randy Propp, William Sanders, Margaret Smith, Don Smock, Jennifer Stanley, Dr. Mark Wallace, Don Warden, and the Council secretary, Bev 11-2-0z- Thomas. NitREVIEW PROGRAM: Mr. Randy Propp, Weld County Elections Supervisor, explained the following procedures of the Weld County Election Department to Council members: provisional ballots, absentee ballots, make-up of precincts, voting locations, post election office activities, voter registration software, scanning and tracking of voter signature cards, and automatic mailings. APPROVAL OF DOCUMENTATION: Councilman Douglas Rademacher made a motion to approve the following documentation: September 17, 2002 meeting minutes, October 15, 2002 meeting minutes, and the 3'° quarter Report to the People. Councilman Kurtz seconded the motion, and it was unanimously approved. PUBLIC COMMENT: There was no public comment at this time. NEW BUSINESS: Consider Increase to 5% Budget Limitation Council members considered a request from the Board of County Commissioners to raise the 5% tax limitation for 2003 to provide additional tax revenue for the County's Strategic Road Plan ($869,047) and Municipal Share Back ($292,255) and to provide an integrated mosquito management program to reduce the risk of West Nile Virus (WNV) causing human deaths in Weld County ($550,000.) Chairman of the Board of County Commissioners Glenn Vaad requested that should the Council decide not to fund the WNV program, the Council consider adding that $550,000 to the Strategic Road Plan. Weld County Council Minutes November 19,2002 Page 2 of 3 Mr. Don Warden explained that once the tax levy is approved by the Council those budgeted line items are then carried forward into the County's next year's budget. However, as WNV is a cyclical problem, when possible the $550,000 would be rolled into the Strategic Road Plan. Councilman Douglas Rademacher made a motion to approve the $75,000 for the education program for the WNV only. The motion failed for lack of a second. Councilman Dwaine Kurtz made a motion to accept the figure allocated to the Weld County Health Department totaling $550,000 for WNV as requested by the Commissioners. The motion failed for lack of a second. Pros and cons discussed regarding the Commissioners' request included: growth in the county justifies the need for additional tax revenue; concern the Commissioners were requesting additional tax revenue two years in a row; January 1, 2003 impact fees for roads in unincorporated Weld will provide monies for Weld's Strategic Road Plan; Council should be pro active rather than reactive; money for roads goes to a bottomless pit; second year of WNV is potentially more deadly than first year; mosquito spraying is an ineffective endeavor; WNV public education is vital; and no tax increase, but no tax cut. Councilman Douglas Rademacher made a motion to table the Commissioners' request to raise the 5% tax limitation for 2003 until a special meeting of the Council can be held before December 11, 2002. Councilman Kurtz seconded the motion, and it carried unanimously. UNFINISHED BUSINESS: Road Signs for South West Weld Administration Building Councilman Douglas Rademacher reported he had talked to Weld County's Public Works Director Frank Hempen and learned that road signs have been ordered to be installed near the South West Weld Administration Building. It is anticipated these signs will improve the visibility of Weld County's South West Administration Building and make it easier to locate. APPOINTMENTS AND ANNOUNCEMENTS: Councilman Douglas Rademacher made a motion to rescind the previous December 2002 meeting-time motion, and that a resolution be drafted to set the Weld County Council's December 2002 regular meeting for December 2, 2002, 9:00 a.m., at Weld County's Centennial Center in Greeley. Councilman Dwaine Kurtz seconded the motion, and it carried unanimously. CORRESPONDENCE: The Council reviewed the correspondence. Weld County Council Minutes November 19,2002 Page 3 of 3 COORDINATOR REPORTS: President Joyce Smock reported that she had a call from Chris Eikenberg regarding what she said was a hazardous situation that had been caused by Urban Renewal's contractor installing a furnace in her home. Councilman Dwaine Kurtz made a motion that the Weld County Council take no action regarding Ms. Eikenberg's issues because the Council has no authority to deal with the complex situation. Councilman Douglas Rademacher seconded the motion, and it carried unanimously. PAYMENT OF THE BILLS: Councilman Douglas Rademacher made a motion to approve the following bills: Mileage for Councilman Mitchell Martin $44.16 Mileage for Councilman Douglas Rademacher $ 19.32 Mileage for Councilwoman Joyce Smock $82.80 Subscription to Windsor Beacon $24.95 Councilman Douglas Rademacher made a motion to approve payment of the bills. The motion was seconded by Councilman Kurtz and approved unanimously. ADDITIONS: There were no additions to the agenda.
