Moved by Joseph Bodine that the following resolution be introduced for passage by the Weld County Board
of Adjustment. Be it therefore resolved by the Weld County Board of Adjustment that the following be
adopted:

REQUEST: Weld County Board of Adjustment to grant a Variance from the Sign Requirements in the
A(Agricultural)Zone District from 16 square feet to 100 square feet.
LEGAL DESCRIPTION: NW4 of Section 2, T2N, R68W of the 61h P.M., Weld County, Colorado.
LOCATION: Southwest Weld County Administrative Office Complex
The criteria for review of this proposal is listed in Section 23-6-40.C. of the Weld County Code. The Board
of Adjustment recommends that this request be approved for the following reasons:
Section 23-6-40.C.1-Special conditions and circumstances exist which are peculiar to the lot, structure or
building involved and which are not applicable to other lots, structures or buildings in the same zoning
district. County Code Section 23-3-20 allows Police, Fire Stations or Facilities and Public Parks and
Recreation facilities to be built as a Use by Right in the A(Agricultural)zone district. While the County Code
allows for this type of use to occur in the Agricultural zone district it does not allow for a sign larger than(16)
square feet to be located in this zone district.
Section 23-6-40.C.2.-Literal interpretation of the provisions of this Chapter would deprive the appellant of
rights commonly enjoyed by other properties in the same zoning district under the terms of this Chapter. A
sign sixteen (16) square feet will not be adequate to identify the proposed use of the complex. A sixteen
(16) square feet sign would not only deprive the appellant a right enjoyed by others in the zone district it
would also be difficult for the traveling public to locate the building. There is an approximate ten (10)feet
change in grade between the site and Interstate 1-25. Access to the site is off Weld County Road 24.5 and
the change in slope does not present a visibility problem; however the speed limit is posted at 45 miles per
hour. The sign is proposed to be located facing Weld County Road 24.5.
Section 23-6-40.C.3- The special conditions and circumstances do not result solely from the actions of the
appellant. The appellant was allowed under the County Code to construct the public purpose facility
in the Ag zone district and needs to be afforded the opportunity to adequately identify the use.
Section 23-6-40.C.4 - The reasons set forth in the application and testimony justify the granting of the
variance, and the variance is the minimum variance that will make possible the reasonable use of the lot,
building or structure. The proposed sign is 100 square feet, and meets the conditions of Chapter 19 Article
III of the County Code. This section states that a sign can be either a freestanding sign that is a maximum
of twenty-five (25) feet in height or a ground-mounted sign that does not exceed one hundred fifty (150)
square feet in area. As defined, a sign can either be freestanding with a maximum of twenty-five (25)feet
in height or a ground mounted sign that does not exceed one hundred fifty(150)square feet in area. The
proposed ground mounted sign for the Southwest Weld County Administrative Office complex is ten (10)
feet in height, and is a total of one hundred square feet (100). As proposed, the size of the sign will likely
be smaller than other signs in the surrounding area.
Section 23-6-40.C.5 - The granting of the variance will be in harmony with the purpose and intent of this
Chapter, and will not be injurious to the neighborhood or otherwise detrimental to the public health, safety
or welfare. The proposed sign for the Southwest Weld County Administrative Office complex is smaller than
those signs allowed in the commercial zoned district. Signs in the commercial zone district may be unto

forty five(45)feet in height when adjacent to interstate interchanges,with a maximum of two signs permitted
per each lot, each having one hundred fifty (150) square foot face. All signs located in this area are
uniformly regulated by the Weld County Code and an Intergovernmental Agreement between the Towns of
Frederick and Firestone, the City of Dacono and Weld County. All parties to this Intergovernmental
Agreement concur with this request, as is demonstrated via verbal confirmation with municipal planners.
Based upon the submitted application materials and other relevant information regarding this request, the
Board of Adjustment's recommendation for approval is conditional upon the following:
1. A Weld County Building Permit is required for this sign.
2. The Southwest Weld County Administrative Complex buildings and sign shall meet all setbacks and
offset requirements required per this zone designation or applicable standards of Chapter 19,Article
III of the Weld County Code.
Joseph Bodine moved that Case BOA-1012,be approved along with the Conditions of Approval as proposed.
