BEFORE THE WELD COUNTY, COLORADO, PLANNING COMMISSION RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS Upon consideration and review of the proposed Longmont Coordinated Planning Agreement, and after hearing testimony and reviewing all the evidence presented,motion was made by Commissioner John Folsom to recommend to the Board of County Commissioners approval of the Agreement,with modification to Section 3.3 (f)to state the following: 3.3 Development in Urban Growth Area. The following shall apply to proposed Development in the Urban Growth Area: (f) At the COUNTY's discretion, the COUNTY may deny proposals for Non-Urban Development in the Urban Growth Area. Commissioner Folsom's motion was seconded by Bruce Fitzgerald. Voneen Macklin Secretary 2002-1970 I EXHIBIT MEMORANDUM WCTO: Weld County Planning Commission DATE: May 22, 2002 COLORADO FROM: Monica Daniels-Mika, Director SUBJECT: Intergovernmental Agreement for City of Longmont and Weld County Since 1995, Weld County has been working with communities in establishing Intergovernmental Agreements. For your consideration, the City of Longmont and Weld County agreement has been prepared. It is the Department of Planning Services recommendation that the above mentioned Intergovernmental Agreement meets the intent of the Weld County Code, Section 22-2-90, as follows: 1. Comprehensive Plan UGB.Goal 1 states that Weld County will encourage and assist each municipality in establishing an intergovernmental urban growth boundary agreement. The following UGB.Policy 1 states, Weld County recognizes that municipalities can and should plan their own futures in terms of the nature and rate of growth. The City of Longmont has worked with Weld County in establishing this proposed Intergovernmental Agreement. Through this agreement, the City of Longmont has indicated their interest in planning for responsible growth. A direct outcome of a commitment to conserve natural and managed resources while directing growth and enhancing economic development through efficient use of infrastructure. 2. Comprehensive Plan UGB.Goal 2 and UGB.Policy 2 indicate that urban development shall be concentrated in or adjacent to urban growth boundary areas that provide an official designation between future urban and non-urban uses. These boundaries shall be established through an intergovernmental agreement between the municipality and the County. The City of Longmont has delineated their Urban Growth Boundary on the attached map. Through this Intergovernmental Agreement, the City of Longmont has specified the future growth of their community. Further, it is noted that Weld County recognizes that it is appropriate for its municipalities to plan for growth at their current boundaries and in the surrounding areas. 3. Comprehensive Plan UGB.Goal3 states that the County and municipalities should coordinate land use planning in urban growth boundary areas, including development policies and standards, zoning, street and highway construction, open space, public infrastructure and other matters affecting orderly development. Through this Intergovernmental Agreement with the City of Longmont, these principles will be met. The county recognizes that an intergovernmental urban growth boundary agreement is by far the best tool for coordinating development for municipal/county interface. It is further noted that the County Commissioners imparted the following criteria to guide the municipalities in developing their urban growth boundaries. These guidelines are the impetus for many communities in establishing an Intergovernmental Agreement with Weld County: SERVICE,TEAMWORK,INTEGRITY,QUALITY 1. Growth should pay for itself in terms of initial costs, and in the long range, through good design and functional efficiency. 2. Annexation patterns should directly correlate with municipal service areas. 3. Infill of communities is a far more efficient use of land than urban sprawl. As outlined in Section 22-2-80 of the Weld County Code, the county recognizes that when growth at the municipal/county level is not coordinated, problems arise. Additionally, when a municipality and the County enter into an Urban Growth Boundary agreement, the County agrees to abide by the municipality's vision for future development in the area. Likewise, the municipality agrees to limit its expansion to the defined areas where it plans to provide municipal services. It is understood that urban growth is an ongoing process and Urban Growth Boundary agreements will be subject to revision as needed. 4. The County recognizes that through Intergovernmental Agreements the municipality agrees to limit its expansion to the defined areas where it plans to provide municipal services, therefore, participating in responsible growth. It is this belief that Weld County and the City of Longmont desire to enter into this Intergovernmental Agreement. The purpose of this Intergovernmental Agreement between the City of Longmont and Weld County is to establish procedures and standards pursuant to which the parties will move toward greater coordination in the exercise of their land use and related regulatory powers within unincorporated areas surrounding each municipality. The community of Longmont exercises governmental authority over the same matter within its own boundaries; including annexations. The premise for this Intergovernmental Agreement is similar to the thirteen others which this board has previously approved. It is the opinion of the Department of Planning Services staff and at the direction of the County Attorney that this Intergovernmental Agreement be forwarded to the Board of County Commissioners with favorable recommendation. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. After I receive an electronic version of this map I will overlay the boundaries onto parcels. This way, a list of property owners can be obtained. As we discussed,the City of Longmont will need to notify these property owners prior the Planning Commission and the Board Hearing. I am still unclear as to the distinction between the three boundaries. My assumption is that the St. Vrain Planning Area(SW PA)will function merely in place of the three mile referral boundary. In to order to satisfy the urban service provision of this agreement I need to know if any agreements are in place between St.Vrain Sanitation District and or the water districts to provide municipal service in the three urban growth boundary areas. Recent development proposals around Union Reservoir have raised questions about provision of water and wastewater service to the area. The City would like our wastewater service area in the Plan to be expanded to include the properties west of Union Reservoir. On Tuesday, May 28, staff will ask City Council to approve a resolution supporting the request for a service area modification. The service area is designated in the Areawide Water Quality Management Plan, which has been developed by the NFRWQPA in compliance with Federal requirements contained in the Clean Water Act. The plan covers water quality issues in Larimer and Weld Counties and is used by State and local agencies as their primary water quality planning document. Among other things, the plan designates which agencies are responsible for management of water pollution and assigns the wastewater service areas associated with these agencies. Your property is shown in the plan as either being partially or entirely in the planning area for the Saint Vrain Sanitation District or not in a planned service area for any municipality or sanitation district. The City of Longmont's position is that the City should be the designated service agency for the areas west and northwest of Union Reservoir, for the following reasons: 1. The City's water and sewer infrastructure is readily available to the most of the area. A large wastewater interceptor (Interceptor G) runs through some of the proposed developments and there is a 12-inch City water line in Weld County Road 1 adjacent to the properties. The City is also planning to add water service to 17th Avenue and Weld County Road 1 in the future. 2. Gravity sewer service is possible for all of the properties to the west of Union Reservoir and some to the north. The City's water and sewer systems have the capacity to serve any development in the area. 3. The City has majority ownership of Union Reservoir and has purchased land around the reservoir for a planned expansion. The City is also purchasing open space around the reservoir. 4. Longmont already has a presence in the area. Sandstone Ranch, McLane Western and Concepts Direct have been annexed by the City. These properties are all served by City water and McLane Western and Sandstone Ranch receive City sewer service. Craig Lindberg , The Newby Group, Phillip and Marsha Willis , and Joe Eeewald providing that at the present time, Longmont does not possess any property rights to inundate or otherwise use property owned by these objectors for the enlargement of Union Reservoir as proposed in the subject application . These objectors further reserved all rights to receive any and all lawful compensation ] for any property taken from them as a result of the enlargement of Union Reservoir as proposed in the subject application. Subject to the terms of this 3tipu_ation , these oojectors ' statement of opposition were withdrawn . 3 . On October 28 , 198E at a regular meeting of the Longmont City Council , the mayor was authorized to sign contracts for option to purchase shares in Union Reservoir . Rocky mountain Consultants were also authorized to conduct a detailed analysis of the potential for exchanges cut of the reservoir including the ability to use the reservoir to re-regulate Windy Cap water. No mention of enlargement of the reservoir was reflected in the minutes of the meeting . 4 . On July 25 , 1989 at a regular meeting of the Longmont City Council , Resolution R-89-27 was passed confirming the intent to appropriate water for the enlargement of Union Reservoir. A copy of this resolution was not furnished to the court until September 14, 1989. 5. Longmont now owns 130 . 15 shares of the 250 shares in Union Reservoir. 5. All on site work was accomplished within the current high water line of Cnion Reservoir except for surveying Union Reservoir Enlargement high water line on a few selected parcels . 7 . Cal Youngberg responded at the May 28 Longmont City Council meeting that the high water line as shown on the map was accurate. The line as shown is in fact the high water line for the ultimate expansion of the reservoir that has been known for several years and shared with property owners adjacent to Union Reservoir. However, you are correct, that some adjustment of the high water line can be achieved with the extension of the proposed embankment along the western side of the reservoir. While this is typically an issue resolved during the design of the facility, our staff has agreed to evaluate the possibility of extending the embankment in order to determine if less of your land would be impacted by the project. As I mentioned to you at the meeting, Ken has not finished this evaluation because he has been working for the past two weeks preparing and issuing the City of Longmont's Drought Response Plan. Ken also let your consultant know that it would take longer to compete the evaluation. The evaluation should be completed early next week. In any event the basis for the City's decision to request an amendment to the 208 Water Quality Plan was clearly outlined in both the staff communication and Resolution R-2002-34 . Both documents are also available on the City's web page at www.ci.longmont.co.us under Council Agenda items for the May 28 meeting. The Resolution was approved unanimously by the Council at the May 28th meeting. Those reasons are as follows: The City has evaluated and determined that the City's Wastewater Utility is capable of providing service to the properties The City has existing wastewater trunk lines with sufficient capacity to provide service that are located within or in near proximity to the properties The City has a presence in the area having annexed Sandstone Ranch and the McLane Western and Concepts Direct Properties The City has majority ownership in Union Reservoir and has purchased several hundred acres adjacent to the reservoir for a planned expansion as well as for open space purposes. The City has always paid the fair market price for all land we have purchased based upon appraised values. It is also important to note all sales have been completed on a willing seller/willing buyer basis. I do not believe it is accurate to portray that the City somehow pays below the market price. I believe the discussions staff has held with several of the property owners along the western side of the reservoir have involved understanding the issues between the landowners and the City. We are prepared to continue those discussions. Concerning the provision of service outside the City, I noted at the May 28 meeting that the Longmont City Charter expressly allows for the extension of water and sewer service outside of the City limits subject to City Council approval. Current agreements for service outside the City do require the applicant to agree to annex to the City upon request by the City to do so. I believe it was Councilman McCoy who pointed out that the area MONICA Mika - Re: Longmont's Application to NFRWQPA Page 3 affected by the proposed extension of City of Longmont's sanitary sewer service area was small when the proposed Union Reservoir expansion high water line was taken into consideration. Councilman McCoy then asked staff(Calvin Youngberg) if there was any reason to believe that the high water mark on this map would not be the future Union Reservoir high water mark. Mr. Youngberg replied "No, that is going to be the mark". But that's not true. On May 10th, my husband and I, Mr. and Mrs. Phil Willis, and Don Lefler met with Ken Huson, Longmont Water Engineer, and Brad Schol, Longmont Planning Director, to discuss Longmont's interest in being the service provider in the Union Reservoir area and Longmont's interest in buying some of our land for the Union Reservoir expansion. This meeting was at Ken Huson's request and as he opened the meeting he stated that the location of the embankment was not yet fixed. And that it may be possible to extend the embankment through our property such that the city would only need to purchase 40 of our acres, rather than the 70 acres required for the high water mark shown on the map. Ken was to prepare more information about this revised embankment option and get back with us in approximately 1 week. Ken has not yet prepared this additional information due to other city priorities. Therefore, I believe, that the final location of the high water mark has not yet been determined. Another item that was discussed at the May 28 City Council Meeting, by Dale Rademacher, Longmont Water/Wastewater Director, was that Longmont does provide some water and/or sewer services to residences outside the city limits. That's true, we have a Longmont water tap, but live in unincorporated Weld County. Dale made it sound as if this area could be serviced by Longmont without requiring annexation to the city. However, we asked that question at the May 10th meeting with Brad and Ken. Brad said, at that time, that it would be"highly unlikely"that Longmont would provide water and sewer service to our proposed development without requiring annexation. It is clear to me that the City of Longmont has a conflict of interest with this proposed request for change to the City's wastewater service area. The city is trying to become the service provider to gain control of this area and limit the development options of the existing landowners. If the City successfully limits the property owner's development options the City will be able to purchase the property needed for the Union Reservoir expansion at below market prices. This may appear to some as unethical. I recommend that the Longmont City Council table this agenda item, until after additional discussions are held with the affected property owners. Options should be investigated that maintain property owners development rights while acknowledging Longmont's proposed Union Reservoir expansion plans. In addition I have provided some suggested language changes to the CPA. I attended the Weld County Planning Commission Meeting on Tuesday June 4, 2002 when the Intergovernmental Agreement between Weld County and the City of Longmont was on the agenda. Numerous property owners in the proposed Urban Growth Area voiced opposition to the agreement. The Planning Commission's vote to approve an amended version of the CPA failed. At the conclusion of the meeting, it appeared that the CPA would be forwarded to the County Commissioners without a formal recommendation. My major concern is with Section 3.3 paragraph(a). This paragraph requires landowners in Weld County to request annexation to Longmont before approval of a land use change. In the past this request for annexation has been voluntary on the part of the landowner, and the landowner has had the burden to show exceptional benefit to the city. This proposed CPA, would require the landowner to request annexation, but does not require the City of Longmont to show any benefit to the landowner or the citizens of Weld County. I recommend that requests for annexation remain voluntary for both the City and effected Weld County landowners. Secondly, as Longmont looks into extending its Municipal Service Area into Weld County, consideration should be made to the service providers already in that area. If Longmont also begins providing services in this area it may have a significant effect on existing service providers abilities to expand or improve their infrastructure to not only new customers but to their existing Weld County customers. I'm not just talking about the water and sewer providers in the area,but also the waste disposal contractors, electrical providers (electrical co-ops), and Fire Protection Districts. Annexation=No compete clause. The update to the Longmont Area Comprehensive Plan should address most of these issues. I recommend that this Cooperative Planning Agreement be signed only after the Longmont Area Comprehensive Plan has had an opportunity to address some of these issues and Longmont has had an opportunity to review the revised Weld County Comp Plan. Another issue to consider with this Cooperative Planning Agreement is the Weld County Mixed Use Development Area. The MUD currently has urban scale codes and ordinances that govern its land uses. If Longmont's Urban Growth Boundary extends partially into this area some land use criteria may become confusing. Weld County has urban-scale codes, ordinances, and criteria for land uses both inside and outside the MUD. These criteria have served the citizens of Weld County very well for many years. Many of these Weld County urban-scale standards are comparable to City of Longmont standards, without the requirements to meet politically driven benchmarks and give(as a requirement of annexation) all historical water rights to the City. I believe that the citizens of Weld County would be best served by utilizing the Comprehensive Plans, codes and ordinances developed under the direction of their own elected officials. I am in favor of Cooperative Planning, and I appreciate the work that both the City of Longmont and Weld County officials have done to start a dialog. But to summarize, 1) Annexation should remain voluntary for both the City and Weld County landowners, 2) The Longmont Area Comprehensive Plan should address the issues of extending the Municipal Service Area into competing service providers areas, and 3)Weld County citizens and landowners should be governed by Weld County codes until the City shows exceptional benefit EXHIBIT MONICA Mika- Part.000 Page 2 to Weld County to change to City of Longmont regulations. I respectfully submit the following language revisions to the CPA for your consideration: Section 3.2 Development Outside Urban Growth Area. To the extent legally possible the COUNTY will disapprove proposals for Urban Development in Areas of the MUNICIPAL Referral Area outside the Urban Growth Area. In reviewing proposals for Urban and/or Non- Urban Development in such areas of the MUNICIPAL Referral Area outside the Urban Growth Area,the COUNTY will apply its Comprehensive Plan and zoning and subdivision ordinances, and,where appropriate,the MUD Plan. Section 3.3 Development in Urban Growth Area. The following shall apply to proposed Development in the Urban Growth Area: (a)Upon receipt of any proposal for Development of property,then currently eligible for voluntary annexation to the MUNICIPALITY,the COUNTY will,in writing,notify the proponent of the opportunity for annexation and notify the MUNICIPALITY of the proposal. The COUNTY will not consider such proposal for Development unless the applicant or its predecessor has declined the option for voluntary annexation or has submitted a complete annexation petition and been denied said annexation by the MUNICIPALITY Board or electorate for a substantially similar development on the same property within the preceding 12 months. The COUNTY may consider such a proposal if,the applicant requests the option to develop under the County's codes and requirements or, after a period of seven months from the date of filing of a complete annexation petition pursued in good faith by the applicant or its predecessor, the MUNICIPALITY has failed to approve or deny such annexation. (f) To the extent legally possible, as determined by the COUNTY,the COUNTY will not deny proposals for Non-Urban Development in the Urban Growth Area. Nothing in this subsection shall restrict the COUNTY from approving the division of ownership parcels located in the Urban Growth Area having residential improvements served by septic systems,regardless of the size of resulting lots. Furthermore,the COUNTY shall not be restricted from allowing the expansion of legally existing non-urban uses provided adequate protection for future urban uses is included in any such approval. (g) If any MUNICIPALITY recommendation of disapproval of a Development proposal is based upon a conflict or incompatibility between proposed uses in the Development and anticipated MUNICIPALITY zoning classification for the property, and the MUNICIPALITY can show that the anticipated MUNICIPALITY zoning classification is in the best interest of COUNTY citizens,the COUNTY will not approve same unless the applicant demonstrates (i) that no such conflict or incompatibility will reasonably occur, (ii)that suitable mitigation measures to be imposed by the COUNTY as conditions of approval will eliminate or adequately mitigate adverse consequences of incompatibility or conflict, or(iii)that the MUNICIPALITY'S anticipated zoning classification of the property in unreasonable because of existing or planned uses of adjacent property. The MUNICIPALITY shall be given notice of, and may appear and be heard at any hearing or other proceeding at which the COUNTY will consider such issues.
